In 2023, both Air France and Airbus were acquitted of involuntary manslaughter after a court ruled that, although mistakes had been made, there was insufficient proof that they directly caused the crash.<\/p>\n<p>If the companies are convicted in the appeal ruling, each could face fines of up to \u20ac225,000, alongside potentially serious reputational consequences.<\/p>\n<p>Flight AF447 departed Rio de Janeiro for Paris on 1 June 2009, carrying 216 passengers and 12 crew aboard an Airbus A330. While crossing the Atlantic during stormy weather, the aircraft\u2019s <a href=\"https:\/\/aviation-safety.net\/wikibase\/321502\" target=\"_blank\" rel=\"nofollow noopener\">pilots lost control<\/a> and the plane plunged into the ocean. There were no survivors.<\/p>\n<p class=\"a-read-more\"><a href=\"https:\/\/www.rfi.fr\/en\/international\/20221010-air-france-airbus-face-trial-over-fatal-2009-rio-paris-plane-disaster\" target=\"_self\" class=\"a-read-more__link\" rel=\"nofollow noopener\">Air France, Airbus face trial over fatal 2009 Rio-Paris plane disaster<\/a><\/p>\n<p>Among those killed were 72 French nationals and 58 Brazilians, with victims also coming from several other countries, reflecting the international scale of the tragedy.<\/p>\n<p>The earlier acquittal <a href=\"https:\/\/www.rfi.fr\/en\/france\/20190905-victims-furious-judges-dismiss-2009-Rio-crash-cases-against-Airbus-Air-France\" target=\"_self\" rel=\"nofollow noopener\">deeply angered<\/a> many relatives of the victims, who argued that the judgment failed to recognise the responsibility of two major aviation companies. Although prosecutors initially recommended dropping the charges, they later pursued an appeal in order to allow what they described as the \u201cfull potential\u201d of the legal process to be explored.<\/p>\n<p>The appeal hearings began in <a href=\"https:\/\/www.rfi.fr\/en\/france\/20250929-air-france-airbus-back-in-court-over-deadly-2009-rio-paris-flight\" target=\"_self\" rel=\"nofollow noopener\">September 2025<\/a>, and for many families they have represented a final opportunity to secure criminal convictions.<\/p>\n<p>Philippe Linguet, who lost his brother in the crash, described the proceedings as the \u201clast resort\u201d.<\/p>\n<p>\u201cWe want a justice system that is combative, that goes beyond the usual procedures to convict two European and multinational companies,\u201d he said.<\/p>\n<p class=\"a-read-more\"><a href=\"https:\/\/www.rfi.fr\/en\/france\/20221013-black-box-recording-of-deadly-rio-paris-flight-to-be-played-in-court\" target=\"_self\" class=\"a-read-more__link\" rel=\"nofollow noopener\">Black box recording of deadly Rio-Paris flight to be played in court<\/a><\/p>\n<p> Pitot tube failures at centre of case <\/p>\n<p>Central to the trial has been the role of the aircraft\u2019s pitot tubes \u2013 instruments used to measure airspeed. Investigators found that the tubes became blocked by ice crystals during a mid-Atlantic storm, causing conflicting speed readings, cockpit alarms and the disconnection of the autopilot system.<\/p>\n<p>Technical experts told the court that, after the <a href=\"https:\/\/www.acielouvert.ipsa.fr\/en\/post\/the-major-french-air-disaster-in-recent-times-flight-af447\" target=\"_blank\" rel=\"nofollow noopener\">instruments malfunctioned<\/a>, the pilots placed the aircraft into a climb that ultimately caused it to stall before crashing into the ocean.<\/p>\n<p>Lawyers representing the victims\u2019 families have argued that Airbus and Air France were already aware of problems linked to pitot tubes before the disaster. They also contend that pilots had not received sufficient training to handle such a high-altitude emergency.<\/p>\n<p>Prosecutors accuse Airbus of underestimating the seriousness of repeated pitot probe failures and failing to properly warn airline crews about the risks. Air France, meanwhile, is accused of not <a href=\"https:\/\/www.flyingmag.com\/emergency-descents\/\" target=\"_blank\" rel=\"nofollow noopener\">providing adequate training<\/a> for pilots dealing with pitot tube icing incidents and failing to sufficiently inform flight crews.<\/p>\n<p>The prosecution\u2019s criticism became particularly forceful during the hearings.<\/p>\n<p>\u201cWe will seek to overturn the judgment and secure the conviction of both companies,\u201d prosecutor Agnes Labreuil said in November.<\/p>\n<p>Another prosecutor, Rodolphe Juy-Birmann, sharply criticised the conduct of the companies over the past 16 years.<\/p>\n<p>\u201cNothing has come of it \u2013 not a single word of sincere comfort. It\u2019s a rock-solid defence.
