{"id":42063,"date":"2026-09-01T08:12:07","date_gmt":"2026-09-01T08:12:07","guid":{"rendered":"https:\/\/www.europesays.com\/netherlands\/42063\/"},"modified":"2026-09-01T08:12:07","modified_gmt":"2026-09-01T08:12:07","slug":"india-says-hague-tribunal-lacks-authority-over-indus-waters-treaty","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/netherlands\/42063\/","title":{"rendered":"India says Hague tribunal lacks authority over Indus Waters Treaty"},"content":{"rendered":"<p><a href=\"https:\/\/qazinform.com\/tag\/india\" rel=\"nofollow noopener\" target=\"_blank\">India<\/a>\u2019s Ministry of External Affairs said New Delhi does not recognize the tribunal and rejected its findings, arguing that it has no jurisdiction over what <a href=\"https:\/\/qazinform.com\/tag\/india\" rel=\"nofollow noopener\" target=\"_blank\">India<\/a> describes as sovereign decisions.<\/p>\n<p>The ministry said the ruling would not affect <a href=\"https:\/\/qazinform.com\/tag\/india\" rel=\"nofollow noopener\" target=\"_blank\">India<\/a>\u2019s actions concerning water infrastructure projects covered by the dispute.<\/p>\n<p>In its latest decision, the Court of Arbitration found that the 1960 Indus Waters Treaty remains in force despite <a href=\"https:\/\/qazinform.com\/tag\/india\" rel=\"nofollow noopener\" target=\"_blank\">India<\/a>\u2019s decision to place it in abeyance.<\/p>\n<p>The tribunal also imposed interim restrictions on construction at the Ratle Hydro-Electric Plant in Kashmir. Under the measures, work on parts of the dam wall and power intake structure cannot proceed beyond specified levels.<\/p>\n<p>The restrictions are to remain in place until 90 days after a neutral expert appointed under the treaty\u2019s dispute-settlement mechanism issues a separate decision, expected by July 2027.<\/p>\n<p>The Permanent Court of Arbitration in The Hague administers the proceedings and serves as the Secretariat to the Court of Arbitration constituted under the treaty.<\/p>\n<p><a href=\"https:\/\/qazinform.com\/tag\/pakistan\" rel=\"nofollow noopener\" target=\"_blank\">Pakistan<\/a> welcomed the interim measures and said it was reviewing the decision to determine how it could support renewed engagement between the two countries under the treaty\u2019s legal framework.<\/p>\n<p>The arbitration proceedings were initiated by <a href=\"https:\/\/qazinform.com\/tag\/pakistan\" rel=\"nofollow noopener\" target=\"_blank\">Pakistan<\/a> in 2016 over disagreements concerning the design of Indian hydroelectric projects on rivers governed by the agreement. The dispute has continued alongside separate proceedings before a neutral expert.<\/p>\n<p><a href=\"https:\/\/qazinform.com\/tag\/india\" rel=\"nofollow noopener\" target=\"_blank\">India<\/a> placed the treaty in abeyance in April 2025 following an attack at a tourist site in Kashmir that killed 26 people. Indian authorities linked the decision to security concerns and identified two of the three assailants as Pakistani nationals. <a href=\"https:\/\/qazinform.com\/tag\/pakistan\" rel=\"nofollow noopener\" target=\"_blank\">Pakistan<\/a> denied involvement in the attack.<\/p>\n<p>Signed in 1960 with World Bank involvement, the Indus Waters Treaty established a framework for sharing the Indus River system between India and <a href=\"https:\/\/qazinform.com\/tag\/pakistan\" rel=\"nofollow noopener\" target=\"_blank\">Pakistan<\/a>.<\/p>\n<p>Under the agreement, the eastern rivers, Ravi, Beas and Sutlej, are allocated primarily to <a href=\"https:\/\/qazinform.com\/tag\/india\" rel=\"nofollow noopener\" target=\"_blank\">India<\/a>, while <a href=\"https:\/\/qazinform.com\/tag\/pakistan\" rel=\"nofollow noopener\" target=\"_blank\">Pakistan<\/a> has rights over the western rivers, Indus, Jhelum and Chenab, subject to certain uses permitted to <a href=\"https:\/\/qazinform.com\/tag\/india\" rel=\"nofollow noopener\" target=\"_blank\">India<\/a>, including hydroelectric power generation.<\/p>\n<p>The treaty also provides mechanisms for resolving disputes, including proceedings before neutral experts and courts of arbitration.<\/p>\n<p>Earlier, <a href=\"https:\/\/qazinform.com\/news\/kazakhstan-and-india-launch-dual-degree-programs-for-law-enforcement-1e0588\" target=\"_blank\" rel=\"noopener nofollow\">Qazinform reported<\/a> that Kazakhstan and India had officially launched dual-degree educational programs between the Academy of Management of the Ministry of Internal Affairs of Kazakhstan and India\u2019s National Forensic Sciences University (NFSU, Gandhinagar).<\/p>\n","protected":false},"excerpt":{"rendered":"India\u2019s Ministry of External Affairs said New Delhi does not recognize the tribunal and rejected its findings, arguing&hellip;\n","protected":false},"author":2,"featured_media":42064,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[5],"tags":[42],"class_list":["post-42063","post","type-post","status-publish","format-standard","has-post-thumbnail","category-the-hague","tag-the-hague"],"_links":{"self":[{"href":"https:\/\/www.europesays.com\/netherlands\/wp-json\/wp\/v2\/posts\/42063","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.europesays.com\/netherlands\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.europesays.com\/netherlands\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/netherlands\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/netherlands\/wp-json\/wp\/v2\/comments?post=42063"}],"version-history":[{"count":0,"href":"https:\/\/www.europesays.com\/netherlands\/wp-json\/wp\/v2\/posts\/42063\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/netherlands\/wp-json\/wp\/v2\/media\/42064"}],"wp:attachment":[{"href":"https:\/\/www.europesays.com\/netherlands\/wp-json\/wp\/v2\/media?parent=42063"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.europesays.com\/netherlands\/wp-json\/wp\/v2\/categories?post=42063"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.europesays.com\/netherlands\/wp-json\/wp\/v2\/tags?post=42063"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
