{"id":43597,"date":"2026-09-07T04:32:09","date_gmt":"2026-09-07T04:32:09","guid":{"rendered":"https:\/\/www.europesays.com\/netherlands\/43597\/"},"modified":"2026-09-07T04:32:09","modified_gmt":"2026-09-07T04:32:09","slug":"the-hague-arbitration-confirms-validity-of-indus-waters-treaty-dawn","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/netherlands\/43597\/","title":{"rendered":"The Hague arbitration confirms validity of Indus Waters Treaty \u2014 Dawn"},"content":{"rendered":"<p>An arbitration tribunal of the Permanent Court of Arbitration in The Hague, Netherlands, confirmed that the 1960 Indus Waters Treaty remains in force and binding on India and Pakistan. <a target=\"_blank\" rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.dawn.com\/news\/2028089\/the-hague-courts-decision-to-uphold-the-indus-waters-treaty-has-vindicated-pakistans-position\">Dawn<\/a> reported this, citing the decision in the \u201cIndus Western Rivers Arbitration\u201d case, issued on August 31, 2026.<\/p>\n<p>According to the publication, Pakistan initiated arbitration over India\u2019s construction of two hydropower projects. Islamabad stated that these projects did not comply with the engineering requirements of Annexes D and E to the treaty, which are intended to prevent obstruction of water flow to the downstream state.<\/p>\n<p>Positions of the parties<\/p>\n<p>India challenged the arbitration tribunal\u2019s jurisdiction and insisted that the dispute should be considered by a neutral expert as a technical matter under Annex F of the treaty. Despite these objections, the tribunal continued hearings on the hydropower projects.<\/p>\n<p>On April 23, 2025, following the attack in Pahalgam, India announced the suspension of the treaty. In particular, it assessed changes in circumstances since 1960: demographic shifts, India\u2019s growing demand for clean energy, developments in dam-construction technology, and the impact of climate change. None of these circumstances, according to the publication\u2019s account, met the threshold under international law for terminating or suspending the agreement.<\/p>\n<p>The tribunal also rejected India\u2019s argument that Pakistan\u2019s frequent use of dispute-settlement mechanisms allegedly constituted a material breach of the treaty.
