THE HAGUE, Netherlands \u2014 Nicaragua<\/a> told the United Nations\u2019 top court on Tuesday that Germany has breached the Genocide Convention by selling Israel weapons that were used in the country\u2019s war in Gaza<\/a>.<\/p>\n

Nicaragua argued that Germany is violating international law by \u201cfacilitating\u201d acts of\u00a0genocide\u00a0in Gaza<\/a> by providing arms and other military support to Israel, in proceedings at the International Court of Justice. Berlin denies the allegation.<\/p>\n

While the case centers on Germany, it indirectly takes aim at Israel\u2019s campaign in Gaza in response to the\u00a0deadly Oct. 7, 2023, attacks\u00a0by Hamas<\/a>. <\/p>\n

Israel, which isn\u2019t a party in the proceedings, strongly denies that its actions amount to acts of genocide<\/a>. <\/p>\n

The preliminary hearings focus on whether the court has jurisdiction.<\/p>\n

The proceedings are the latest legal attempt to rein in Israel\u2019s military campaign by a country with historic ties to the Palestinian people, after South Africa accused Israel of genocide\u00a0at the same court in 2023.<\/p>\n

\u201cIt is impossible that with the type of political, commercial and military relations of Germany with Israel, they could not be aware, or normally should have been aware, of the serious risk that acts that could amount to genocide<\/a> were being committed by Israel,\u201d Nicaragua\u2019s top lawyer, Carlos Jos\u00e9 Arg\u00fcello G\u00f3mez, told the court.<\/p>\n

Germany has been a\u00a0staunch supporter of Israel\u00a0for decades and is the second-largest supplier of arms to Israel after the United States.<\/p>\n

Nicaragua\u2019s government<\/a> has historical links with Palestinian organizations dating back to their support for the 1979 Sandinista revolution.<\/p>\n

On Monday, Germany told the court that the case was improperly filed and should be thrown out.<\/p>\n

\u201cNicaragua\u2019s conduct indicates that it was not interested in hearing Germany\u2019s view on its allegations, but simply in bringing Germany before this court,\u201d Julia Monar, Germany\u2019s top lawyer, told the judges. <\/p>\n

Countries are typically expected to attempt to resolve disputes before bringing them to the court.<\/p>\n

Lawyers for Nicaragua denied this, pointing to documents sent to the German foreign ministry as well as press releases describing the dispute.<\/p>\n
