{"id":12706,"date":"2026-04-02T00:26:18","date_gmt":"2026-04-02T00:26:18","guid":{"rendered":"https:\/\/www.europesays.com\/news\/12706\/"},"modified":"2026-04-02T00:26:18","modified_gmt":"2026-04-02T00:26:18","slug":"supreme-court-likely-to-rule-for-black-death-row-inmate-from-mississippi","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/news\/12706\/","title":{"rendered":"Supreme Court likely to rule for Black death row inmate from Mississippi"},"content":{"rendered":"<p>WASHINGTON (AP) \u2014 The <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/hub\/us-supreme-court\" rel=\"nofollow noopener\" target=\"_blank\">Supreme Court<\/a> on Tuesday seemed likely to rule for a <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/supreme-court-mississippi-racial-bias-jury-2ad7c6c707471ec891eeee66decb4c1b\" rel=\"nofollow noopener\" target=\"_blank\">Black death row inmate from Mississippi<\/a> who claims there was racial bias in the makeup of the jury that convicted him. <\/p>\n<p>The justices took up an appeal from Terry Pitchford in a case with similarities to that of another Black man on Mississippi\u2019s death row, whose conviction the high court overturned seven years ago.<\/p>\n<p>The jury that sentenced Pitchford to death for his role in the killing of a grocery store owner in northern Mississippi had one Black juror. <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/mississippi-prosecutor-resigns-black-jurors-a4b23a50402282a0c195cbb56205f324\" rel=\"nofollow noopener\" target=\"_blank\">Doug Evans<\/a>, a now-retired prosecutor with a history of dismissing Black jurors for discriminatory reasons, had excused four other Black people.<\/p>\n<p>The Supreme Court ruled 40 years ago in <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/www.courtlistener.com\/opinion\/111662\/batson-v-kentucky\/?page=2546\" target=\"_blank\" rel=\"noopener nofollow\">Batson v. Kentucky<\/a> that jurors could not be excused from service because of their race and set up a system by which trial judges could evaluate claims of discrimination and the race-neutral explanations by prosecutors.<\/p>\n<p>Pitchford\u2019s case focuses on whether his lawyers did enough to object to Judge Joseph Loper\u2019s rulings and whether the state Supreme Court acted reasonably in ruling they had not.<\/p>\n<p>    <a class=\"AnchorLink\" id=\"more-section-display-name\"\/><\/p>\n<p>    <a class=\"Link\" aria-label=\"Supreme Court blocks law against schools outing transgender students to their parents in California\" href=\"https:\/\/apnews.com\/article\/supreme-court-transgender-students-california-cca311ae39d267f31c1392a0bcf780cd\" rel=\"nofollow noopener\" target=\"_blank\"><\/p>\n<p><img decoding=\"async\" class=\"Image\" alt=\"The Supreme Court is photographed, Feb. 6, 2026, in Washington. Reading from the trial transcript, Kavanaugh said, \u201cShe\u2019s trying to make the objections right there.\u201d<\/p>\n<p>There was broad agreement that neither the judge nor the lawyers performed especially well when the jury was chosen.<\/p>\n<p>\u201cThis is the most timid and reticent defense counsel that I have ever encountered,\u201d Justice Samuel Alito said.<\/p>\n<p>But Alito also faulted Loper, who accepted Evans\u2019 explanations and moved on without analyzing whether race was the reason. \u201cThe judge didn\u2019t handle this the way it should have been handled,\u201d Alito said.<\/p>\n<p>In 2019, the Supreme Court overturned the death sentence and conviction of <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/13cc50ff8dba44528bfbcc127bb582aa\" rel=\"nofollow noopener\" target=\"_blank\">Curtis Flowers<\/a>, because of what <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/www.supremecourt.gov\/opinions\/18pdf\/17-9572_k536.pdf\" target=\"_blank\" rel=\"noopener nofollow\">Kavanaugh described<\/a> as a \u201crelentless, determined effort to rid the jury of Black individuals.\u201d<\/p>\n<p>Mississippi Solicitor General Scott Stewart sought to distinguish Pitchford\u2019s case from Flowers\u2019.<\/p>\n<p>\u201cIn Flowers versus Mississippi, this Court faced an extraordinary case and ruled against the state,\u201d Stewart said. \u201cThis case is also extraordinary but in a very different way that requires a very different result.\u201d<\/p>\n<p>The Supreme Court could rule for Pitchford but still leave it to lower courts to sort out whether his conviction should be overturned.<\/p>\n<p>Pitchford, now 40, was 18 when he and a friend decided to rob the Crossroads Grocery, just outside Grenada in northern Mississippi. The friend shot store owner Reuben Britt three times, fatally wounding him, but was ineligible for the death penalty because he was younger than 18. Pitchford was tried for capital murder and sentenced to death.<\/p>\n<p>The case has been making its way through the court system for 20 years. In 2023, U.S District Judge Michael P. Mills <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.msnd.40419\/gov.uscourts.msnd.40419.216.0.pdf\" target=\"_blank\" rel=\"noopener nofollow\">overturned Pitchford\u2019s conviction,<\/a> holding that the trial judge did not give Pitchford\u2019s lawyers enough of a chance to argue that the prosecution was improperly dismissing Black jurors.<\/p>\n<p>Mills wrote that his ruling was partially motivated by Evans\u2019 actions in prior cases. A unanimous panel of the <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/www.ca5.uscourts.gov\/opinions\/pub\/23\/23-70009-CV1.pdf\" target=\"_blank\" rel=\"noopener nofollow\">5th U.S. Circuit Court of Appeals<\/a> reversed the ruling.<\/p>\n<p>Kavanaugh, in an exchange with Stewart, praised Mills\u2019 handling of the case. \u201cMills is a very experienced district judge. He had been a former Mississippi Supreme Court justice. He knows what he\u2019s doing.
