{"id":19198,"date":"2026-04-22T02:59:22","date_gmt":"2026-04-22T02:59:22","guid":{"rendered":"https:\/\/www.europesays.com\/news\/19198\/"},"modified":"2026-04-22T02:59:22","modified_gmt":"2026-04-22T02:59:22","slug":"kash-patel-defamation-lawsuit-against-figliuzzi-dismissed","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/news\/19198\/","title":{"rendered":"Kash Patel defamation lawsuit against Figliuzzi dismissed"},"content":{"rendered":"<p>Kash Patel, director of the Federal Bureau of Investigation (FBI), during a House Intelligence Committee hearing on worldwide threats in Washington, DC, US, on Thursday, March 19, 2026. <\/p>\n<p>Daniel Heuer | Bloomberg | Getty Images<\/p>\n<p>A <a href=\"https:\/\/www.txs.uscourts.gov\/\" target=\"_blank\" rel=\"nofollow noopener\">Houston federal court<\/a> judge on Tuesday dismissed a <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.txsd.2011606\/gov.uscourts.txsd.2011606.1.0.pdf\" target=\"_blank\" rel=\"nofollow noopener\">lawsuit<\/a> by <a href=\"https:\/\/www.cnbc.com\/2026\/04\/20\/kash-patel-atlantic-lawsuit-alcohol-fbi.html\" rel=\"nofollow noopener\" target=\"_blank\">FBI Director Kash Patel<\/a> alleging that <a href=\"https:\/\/frankfigliuzzi.com\/\" target=\"_blank\" rel=\"nofollow noopener\">former FBI official Frank Figliuzzi<\/a> defamed him by saying Patel last year had &#8220;been visible at nightclubs far more than he has been on the seventh floor of&#8221; the bureau&#8217;s headquarters in Washington, D.C.<\/p>\n<p>&#8220;The Court finds that Figliuzzi&#8217;s statement is rhetorical hyperbole that cannot constitute defamation,&#8221; U.S. District Court Judge George Hanks Jr. wrote in his <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.txsd.2011606\/gov.uscourts.txsd.2011606.38.0.pdf\" target=\"_blank\" rel=\"nofollow noopener\">decision<\/a>. &#8220;Accordingly, Dir. Patel has failed to state a claim against Figliuzzi, and his lawsuit must be dismissed.&#8221;<\/p>\n<p>The dismissal came a day after Patel filed an unrelated <a href=\"https:\/\/www.cnbc.com\/2026\/04\/19\/kash-patel-atlantic-lawsuit-alcohol.html\" rel=\"nofollow noopener\" target=\"_blank\">$250 million defamation lawsuit<\/a> in D.C. federal court against <a href=\"https:\/\/www.theatlantic.com\" target=\"_blank\" rel=\"nofollow noopener\">The Atlantic<\/a> magazine over a <a href=\"https:\/\/www.theatlantic.com\/politics\/2026\/04\/kash-patel-fbi-director-drinking-absences\/686839\/\" target=\"_blank\" rel=\"nofollow noopener\">new article<\/a> that alleged he has abused alcohol.<\/p>\n<p>While ruling on the key question of defamation in Figliuzzi&#8217;s favor, the judge denied his request that he be awarded court costs and attorneys&#8217; fees under <a href=\"https:\/\/statutes.capitol.texas.gov\/\" target=\"_blank\" rel=\"nofollow noopener\">Texas&#8217; anti-SLAPP law<\/a>. SLAPP is an acronym for Strategic Litigation Against Public Participation.<\/p>\n<p>Figluizzi&#8217;s lawyer, Marc Fuller, in a statement to CNBC, said, &#8220;This is a victory for press freedom and the First Amendment.&#8221;<\/p>\n<p>&#8220;Director Patel&#8217;s claim against Frank was baseless, and we are pleased that the court dismissed it,&#8221; Fuller said.<\/p>\n<p>Patel&#8217;s lawyers did not immediately respond to a request for comment.<\/p>\n<p>Figliuzzi, former assistant director for counterintelligence at the FBI, made his crack about Patel on May 2, 2025, on the <a href=\"https:\/\/www.msnow.com\/\" target=\"_blank\" rel=\"nofollow noopener\">MS Now show &#8220;Morning Joe.&#8221;<\/a> <\/p>\n<p>&#8220;Yeah, well, reportedly, he&#8217;s been visible at nightclubs far more than he has been on the seventh floor of the Hoover building,&#8221; said Figliuzzi.<\/p>\n<p>Patel sued him in June, accusing Figliuzzi of &#8220;fabricating a specific lie&#8221; about the FBI because of Figliuzzi&#8217;s &#8220;clear animus&#8221; toward him.<\/p>\n<p>Read more CNBC politics coverage<\/p>\n<p> As evidence of that animus, Patel&#8217;s lawsuit referenced scathing statements about him by Figliuzzi, which questioned his competence and claimed that &#8220;his record shows no devotion to the Constitution, but blind allegiance to [President Donald] Trump.&#8221;<\/p>\n<p>&#8220;Since becoming Director of the FBI, Director Patel has not spent a single minute inside of a nightclub,&#8221; Patel&#8217;s suit said. <\/p>\n<p>In his decision Tuesday, Hanks wrote that Figliuzzi&#8217;s nightclub jibe, &#8220;when taken in context, cannot have been perceived by a person of ordinary intelligence as stating actual facts about Patel.&#8221;<\/p>\n<p>&#8220;A person of reasonable intelligence and learning would not have taken his statement literally: that Dir.
