{"id":23640,"date":"2026-05-02T19:21:14","date_gmt":"2026-05-02T19:21:14","guid":{"rendered":"https:\/\/www.europesays.com\/news\/23640\/"},"modified":"2026-05-02T19:21:14","modified_gmt":"2026-05-02T19:21:14","slug":"trump-administration-is-increasingly-ignoring-us-courts-new-analysis-shows-trump-administration","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/news\/23640\/","title":{"rendered":"Trump administration is increasingly ignoring US courts, new analysis shows | Trump administration"},"content":{"rendered":"<p class=\"dcr-130mj7b\">When a federal judge shot down a <a href=\"https:\/\/www.theguardian.com\/us-news\/trump-administration\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">Trump administration<\/a> policy of holding immigrants without bond last December, it seemed like a serious blow to the US president\u2019s mass deportation effort.<\/p>\n<p class=\"dcr-130mj7b\">Instead, a top justice department official insisted the ruling wasn\u2019t binding, and the administration continued denying detainees around the country a chance for release.<\/p>\n<p class=\"dcr-130mj7b\">By February, the district court judge in question, Sunshine Sykes, was fed up. Sykes accused the Trump administration of <a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/feb\/20\/trump-administration-immigration-ice-judge-decision\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">terrorizing immigrants and recklessly<\/a> violating the law in <a href=\"https:\/\/www.theguardian.com\/us-news\/ng-interactive\/2025\/jul\/23\/trump-ice-data-deportations-detention\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">its efforts<\/a> to deport millions of people. She also said she regarded it <a href=\"https:\/\/lawandcrime.com\/high-profile\/make-sure-to-never-mention-the-constitution-judge-mocks-trump-admins-three-step-maneuver-to-lull-courts-to-sleep-says-it-wont-work-with-her\/\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">as seeking<\/a> \u201cto erode any semblance of separation of powers\u201d, adding that it could \u201conly do so in a world where the constitution does not exist\u201d.<\/p>\n<p class=\"dcr-130mj7b\">Hardly isolated, the case illustrates a <a href=\"https:\/\/www.theguardian.com\/us-news\/ng-interactive\/2025\/mar\/09\/trump-assault-rule-of-law\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">broader pattern<\/a> by the US government\u2019s executive branch, in Donald Trump\u2019s second term, of defiance of decisions by the lower courts that are part of the judicial branch, with the tone set early by Trump <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/feb\/10\/jd-vance-judges-trump\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">and JD Vance<\/a>, his vice-president. The US constitution\u2019s creation of the <a href=\"https:\/\/www.usa.gov\/branches-of-government#:~:text=The%20Constitution%20of%20the%20United%20States%20divides,branches:%20*%20Legislative.%20*%20Judicial.%20*%20Executive.\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">three branches of government<\/a>, with the legislative branch being the third, was intended to ensure checks and balances so that no branch had too much power.<\/p>\n<p class=\"dcr-130mj7b\">The repeated refusal of Trump officials to follow court orders has been highlighted most notably in individual <a href=\"https:\/\/www.theguardian.com\/us-news\/usimmigration\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">immigration<\/a> cases.<\/p>\n<p class=\"dcr-130mj7b\">But a review of hundreds of pages of court records by the Associated Press also shows an extraordinary record of violations in lawsuits over policy changes and other moves.<\/p>\n<p class=\"dcr-130mj7b\">In the first 15 months since Trump <a href=\"https:\/\/www.theguardian.com\/us-news\/donald-trump-inauguration\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">returned to the White House<\/a>, district court judges ruled the administration was violating an order in at least 31 lawsuits over a wide range of issues, including mass layoffs, deportations, spending cuts and immigration practices, the AP\u2019s review found. That\u2019s about one out of every eight lawsuits in which courts have at least temporarily blocked the administration\u2019s actions.<\/p>\n<p class=\"dcr-130mj7b\">The Republican administration\u2019s power struggle with federal courts, which is testing basic tenets of US democracy, reflects an expansive view of executive authority that has also challenged the independence of federal agencies, a president\u2019s ethical obligations and the US\u2019s role in <a href=\"https:\/\/www.theguardian.com\/world\/2026\/may\/02\/dark-era-trump-creating-new-approach-global-politics\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">the international order<\/a>.<\/p>\n<p class=\"dcr-130mj7b\">The Trump administration violations in the 31 lawsuits are in addition to more than 250 instances of noncompliance that judges, some appointed by Democratic presidents, some by Republicans, have recently highlighted in individual immigration petitions \u2013 from failing to return property to keeping <a href=\"https:\/\/www.theguardian.com\/us-news\/ng-interactive\/2025\/aug\/29\/trump-immigration-ice-cbp-data\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">immigrants locked up<\/a> past court-ordered release dates.<\/p>\n<p class=\"dcr-130mj7b\">Legal scholars and former federal judges said they could recall at most a few violations of court rulings over the full four-year terms of other recent presidential administrations, including Trump\u2019s first time in office before he <a href=\"https:\/\/www.theguardian.com\/us-news\/ng-interactive\/2020\/nov\/24\/us-election-results-2020-joe-biden-defeats-donald-trump-to-win-presidency\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">lost to Joe Biden<\/a> in the <a href=\"https:\/\/www.theguardian.com\/us-news\/us-elections-2020\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">2020 presidential election<\/a>. They also noted previous administrations were generally apologetic when confronted by judges; the Trump administration\u2019s justice department has been <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/mar\/18\/trump-judge-impeachment-venezuelan-deportations\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">outright combative<\/a> in some cases. Trump himself does not shy from vilifying judges, up to <a href=\"https:\/\/www.theguardian.com\/commentisfree\/2026\/feb\/24\/trump-supreme-court-judges-attacks\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">and including<\/a> members of the US supreme court.<\/p>\n<p class=\"dcr-130mj7b\">\u201cWhat the court system is experiencing in the last year and a half is just qualitatively completely different from anything that\u2019s preceded it,\u201d said Ryan Goodman, a law professor at New York University who studies federal courts and is tracking litigation against the <a href=\"https:\/\/www.theguardian.com\/us-news\/trump-administration\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" rel=\"nofollow noopener\" target=\"_blank\">Trump administration<\/a>.<\/p>\n<p class=\"dcr-130mj7b\">Though Trump officials eventually backed down in about a third of the 31 lawsuits, legal experts say their treatment of court orders poses serious dangers.<\/p>\n<p class=\"dcr-130mj7b\">\u201cThe federal government should be the institution most devoted to the rule of law in this country,\u201d said David Super, a constitutional law scholar at Georgetown University. \u201cWhen it ceases to feel itself bound, respect for the rule of law is likely to break down across the country.\u201d<\/p>\n<p class=\"dcr-130mj7b\">The White House\u2019s aggressive policy moves have prompted a barrage of lawsuits \u2013 more than 700 and counting.<\/p>\n<p class=\"dcr-130mj7b\">In October, the US district judge William Smith took little time to conclude that Department of Homeland Security (<a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/jan\/19\/donald-trump-immigration-crackdown\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">DHS<\/a>) officials were flouting one of his orders. Smith had blocked them from making billions of dollars in disaster relief funding to states contingent on cooperation with the president\u2019s immigration priorities.<\/p>\n<p class=\"dcr-130mj7b\">The DHS responded by keeping the immigration requirement on some grants, but making it contingent on a higher court overriding Smith\u2019s injunction. The judge called the move \u201cham-handed\u201d and said the DHS was trying to \u201cbully the states\u201d.<\/p>\n<p class=\"dcr-130mj7b\">In a case over the <a href=\"https:\/\/www.theguardian.com\/commentisfree\/2025\/oct\/21\/us-refugee-program-trump-overhaul-racism\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">suspension of refugee<\/a> admissions, the US district judge Jamal Whitehead accused the justice department last May of \u201challucinating new text\u201d in an appellate court order and \u201crewriting\u201d it to achieve the government\u2019s preferred outcome.<\/p>\n<p class=\"dcr-130mj7b\">In four additional cases the AP reviewed, judges stopped short of a clear written finding of noncompliance but still criticized the administration\u2019s response to their orders. Of the judges who have confirmed violations, 22 were appointed by Democratic presidents and seven by Republican presidents.<\/p>\n<p class=\"dcr-130mj7b\">Former federal judges Jeremy Fogel and Liam O\u2019Grady said judges are losing trust in the integrity of the Department of Justice.<\/p>\n<p class=\"dcr-130mj7b\">That\u2019s making them \u201cmore aggressive in accusing the government of bad faith\u201d, said O\u2019Grady, who along with Fogel is now part of the nonpartisan democracy group Keep Our Republic.
