{"id":59761,"date":"2026-08-01T20:44:07","date_gmt":"2026-08-01T20:44:07","guid":{"rendered":"https:\/\/www.europesays.com\/news\/59761\/"},"modified":"2026-08-01T20:44:07","modified_gmt":"2026-08-01T20:44:07","slug":"in-dropping-reflecting-pool-case-pirro-draws-trumps-wrath","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/news\/59761\/","title":{"rendered":"In Dropping Reflecting Pool Case, Pirro Draws Trump\u2019s Wrath"},"content":{"rendered":"<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">Jeanine Pirro faced the cameras on July 2 with characteristic self-assurance to announce the indictment of the 67-year-old ex-Olympian David Hearn for trashing \u201csacred\u201d government property, President Trump\u2019s highly prized but shoddily renovated Reflecting Pool.<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">\u201cThis is not only a priority for the president, but for myself,\u201d said Ms. Pirro, the U.S. attorney for the District of Columbia, disclosing felony vandalism charges against Mr. Hearn for touching the lining of the pool in front of the Lincoln Memorial. She added: \u201cWe will prove beyond a reasonable doubt that Hearn willfully destroyed property.\u201d<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">This was not the case.<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">Ms. Pirro\u2019s office <a class=\"css-bhdv0x-linkClass\" href=\"https:\/\/www.nytimes.com\/2026\/07\/31\/us\/politics\/david-hearn-reflecting-pool-vandalism-charges.html\" title=\"\" rel=\"nofollow noopener\" target=\"_blank\">dramatically reversed course<\/a> on Friday, not only withdrawing the charge against Mr. Hearn but blasting the Interior Department for the rushed and \u201cbotched\u201d renovation, along with U.S. Park Police officials who fed bad information that led her to publicly cite \u201ctremendous evidence\u201d against Mr. Hearn. In the process, intentionally or not, she skated perilously close to contradicting Mr. Trump \u2014 and he noticed.<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">Ms. Pirro\u2019s <a class=\"css-bhdv0x-linkClass\" href=\"https:\/\/eaccess.dccourts.gov\/eaccess\/search.page.3.1?x=qqjX8T4BNkYYoTHgHNlyuUvKgPQJhDWaa36zwwQ1nxt3rh2uGz*gfeJz97uGNylEDwfvF57yb8ToHKtD3keXJ0c0Vr96rjoVJdt06OXLIcnu-bQCqXtHnKrorXGykRlmmW0NjU7CUc8hhr1*JwnZ1Q\" title=\"\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">20-page filing<\/a> did not refer to, much less rebuke, Mr. Trump for claiming the damage was caused by left-wing vandals rather than his administration\u2019s missteps. But it raised innate doubts about his assertion that criminals had slashed the pool\u2019s lining with a \u201cknife or blade.\u201d<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">That Ms. Pirro, a former Westchester, N.Y., district attorney and Fox News personality was aiming much of her criticism not at Mr. Trump, but his interior secretary, Doug Burgum, who oversaw the issuance of a no-bid contract to renovate the pool, did not appear to matter much.<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">On Saturday morning, Mr. Trump dashed off a post on Truth Social that made clear he was unhappy with Ms. Pirro, a friend and ally since the 1980s.<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">\u201cI disagree 100% with Jeanine Pirro,\u201d Mr. Trump wrote.<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">\u201cI don\u2019t know what she was thinking? To me, it was a pure case of VANDALISM,\u201d he wrote, adding, \u201cThere may have been some contractor difficulty, but the major damage was caused by VANDALS!\u201d<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">Ms. Pirro\u2019s U-turn was a rare instance in which a Trump-appointed U.S. attorney publicly acknowledged that a prosecution once embraced was fatally compromised, in an administration in which admitting fault is seen as weakness and in which taking actions that contradict the boss is seen as self-destruction.<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">\u201cTrump is mad at Pirro because she finally admitted what we made clear in our legal filings all along: Trump\u2019s botched renovation was responsible for the damage, not Davey Hearn,\u201d said Norman L. Eisen a member of Mr. Hearn\u2019s defense team and a co-founder of Democracy Defenders Fund, which has represented people targeted by the Trump administration.<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">\u201cHer claim that she and her office were previously duped by Interior is nonsense,\u201d he added. \u201cStarting immediately after the arraignment, our motions repeatedly proved that the administration was to blame, not Davey.\u201d<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">Tim Lauer, a spokesman for the U.S. attorney\u2019s office, declined to comment. \u201cThe filing speaks for itself,\u201d he wrote in an email.<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">The about-face also underscored a recurrent pattern that has diminished the Justice Department\u2019s once-sterling standing with federal judges and juries \u2014 the rush by Trump- appointed U.S. attorneys across the country to take quick action against those accused by the president of transgressions, even petty ones.<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">It is now much more common for grand juries around the country, particularly in Washington, to reject indictments brought by the department. <a class=\"css-bhdv0x-linkClass\" href=\"https:\/\/www.nytimes.com\/2025\/09\/06\/us\/trump-dc-national-guard-grand-juries-crime.html\" title=\"\" rel=\"nofollow noopener\" target=\"_blank\">In years past, this almost never happened<\/a>.<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">Last December, grand jurors in Virginia rejected the department\u2019s effort <a class=\"css-bhdv0x-linkClass\" href=\"https:\/\/www.nytimes.com\/2025\/12\/11\/us\/politics\/grand-jury-letitia-james.html\" title=\"\" rel=\"nofollow noopener\" target=\"_blank\">to indict Letitia James<\/a>, the New York attorney general, on mortgage-related charges <a class=\"css-bhdv0x-linkClass\" href=\"https:\/\/www.nytimes.com\/2025\/12\/04\/us\/politics\/letitia-james-indict-trump.html\" title=\"\" rel=\"nofollow noopener\" target=\"_blank\">for the second time in a one-week<\/a> period. Earlier, a jury in the district halted an attempt by Ms. Pirro\u2019s office to prosecute a Justice Department employee <a class=\"css-bhdv0x-linkClass\" href=\"https:\/\/www.nytimes.com\/2025\/08\/27\/us\/politics\/trump-sandwich-assault-indictment-justice-department.html\" title=\"\" rel=\"nofollow noopener\" target=\"_blank\">who tossed a sandwich at federal officers<\/a>. Around the same time, <a class=\"css-bhdv0x-linkClass\" href=\"https:\/\/www.nytimes.com\/2025\/09\/06\/us\/trump-dc-national-guard-grand-juries-crime.html\" title=\"\" rel=\"nofollow noopener\" target=\"_blank\">she thrice tried and failed<\/a> to indict a woman who pushed an F.B.I. agent during a protest.<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">Ms. Pirro\u2019s filing is, in a sense, an effort to replace <a class=\"css-bhdv0x-linkClass\" href=\"https:\/\/www.nytimes.com\/2026\/07\/02\/us\/reflecting-pool-indictment-david-hearn.html\" title=\"\" rel=\"nofollow noopener\" target=\"_blank\">the case against Mr. Hearn<\/a> in federal court with a case in the court of public opinion against Mr. Burgum; the contractor, Atlantic Industrial Coatings; and Park Police officials.<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">In the filing, she said that her staff relied almost exclusively on claims by Interior Department officials that the extensive damage to the lining of the pool was caused by Mr. Hearn and other vandals who were observed tugging at or removing pieces of material from the wall.<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">That information, coupled with police testimony about Mr. Hearn\u2019s movements, convinced prosecutors to bring the case before the grand jury on July 2. They opted for a felony, which carried a potential 10-year prison sentence, rather than a misdemeanor, because the damage exceeded the legal threshold of $1,000.<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">At the time, Ms. Pirro wrote, her office \u201cwas not in possession of any information from D.O.I. indicating that any damage to the Reflecting Pool was caused by anything other than the actions of the defendant and other vandals who damaged the pool\u2019s lining.\u201d<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">It all began to unravel, however, after prosecutors followed up by asking for \u201ceverything\u201d \u2014 government reports, police and witness statements, photographs, body camera footage and, critically, internal assessments of the high-profile renovation project.<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">By late July, Ms. Pirro\u2019s office obtained 695 megabytes of documents that led Ms. Pirro to conclude the damage observed was \u201cthe result of flawed installation by the contractor,\u201d coupled with \u201cthe rush to complete the project prior to events associated with the America250 celebration.\u201d<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">But Ms. Pirro\u2019s critics, including Mr. Eisen, said her account ignored the fact that problems with the renovation of the algae-choked pool had been widely known and reported in the press and in their own court filings.<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">Mr. Hearn\u2019s team maintained that he had merely \u201ctouched a piece of coating that had already detached, released it when asked to do so by a park employee, and left the pool in no worse condition in which he found it.\u201d<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">Photos and testimony introduced in the case had indicated that substantial cracks had already appeared, and water started leaking from the pool, before Mr. Hearn\u2019s visit.
