Pete Aguilar (D-CA) speaks during a news conference with House Democratic leadership at the U.S. Capitol in Washington, D.C., January 10, 2023.<\/p>\n<p>Sarah Silbiger | Reuters<\/p>\n<p>A monthslong stalemate over <a href=\"https:\/\/www.cnbc.com\/immigration\/\" rel=\"nofollow noopener\" target=\"_blank\">immigration<\/a> enforcement could come to an end on Tuesday, as the <a href=\"https:\/\/www.cnbc.com\/congress\/\" rel=\"nofollow noopener\" target=\"_blank\">U.S. House<\/a> is poised to vote on a <a href=\"https:\/\/www.cnbc.com\/2026\/04\/21\/senate-republicans-immigration-dhs-shutdown-ice.html\" rel=\"nofollow noopener\" target=\"_blank\">$70 billion funding package<\/a> despite Democrats&#8217; vows to fight back. It&#8217;s a major test for House Speaker <a href=\"https:\/\/www.cnbc.com\/mike-johnson\/\" rel=\"nofollow noopener\" target=\"_blank\">Mike Johnson<\/a> as he tries to cement one of President Donald Trump&#8217;s top domestic priorities.<\/p>\n<p>Rep. <a href=\"https:\/\/www.cnbc.com\/2026\/01\/27\/house-democrats-kristi-noem-impeachment-trump.html\" rel=\"nofollow noopener\" target=\"_blank\">Pete Aguilar<\/a>, D-Calif., chair of the House Democratic Caucus, called the package a &#8220;$70 billion blank check for ICE and border patrol, with no strings attached.&#8221; <\/p>\n<p>&#8220;This comes after Republicans already cut healthcare, food assistance, and they&#8217;ve a already give ICE $140 billion in their Big Ugly Bill,&#8221; Aguilar said at a press conference on Tuesday, referring to Republicans&#8217; 2025 tax and spending package more commonly known as the One Big Beautiful Bill. &#8220;On top of that, this doesn&#8217;t do a single thing to help Americans with their daily costs of living.&#8221;<\/p>\n<p>Read more CNBC politics coverage<\/p>\n<p>The package, which has broad support among Republican congressional leadership, would fund\u00a0<a href=\"https:\/\/www.cnbc.com\/immigration\/\" rel=\"nofollow noopener\" target=\"_blank\">Immigration and Customs Enforcement<\/a>\u00a0and Customs and Border Protection, both of which are Department of Homeland Security subagencies that were left out of an\u00a0<a href=\"https:\/\/www.cnbc.com\/2026\/04\/30\/congress-dhs-tsa-funding.html\" rel=\"nofollow noopener\" target=\"_blank\">earlier spending bill<\/a>\u00a0amid\u00a0<a href=\"https:\/\/www.cnbc.com\/democrats\/\" rel=\"nofollow noopener\" target=\"_blank\">Democratic<\/a>\u00a0opposition. The $70 billion would extend through the end of <a href=\"https:\/\/www.cnbc.com\/donald-trump\/\" rel=\"nofollow noopener\" target=\"_blank\">Trump<\/a>&#8216;s presidency. And it could bring to an end a drawn-out debate over immigration enforcement policy that began in January \u2013 after federal law enforcement agents <a href=\"https:\/\/www.cnbc.com\/2026\/01\/25\/alex-pretti-minneapolis-shooting-videos-trump.html\" rel=\"nofollow noopener\" target=\"_blank\">killed two U.S. citizens<\/a> in Minneapolis as part of an immigration crackdown \u2014 and led to a government shutdown.<\/p>\n<p>Trump had called for the bill to reach his desk by June 1. The package advanced out of the Senate last Friday, on a <a href=\"https:\/\/x.com\/SenateCloakroom\/status\/2062819659624116494?s=20\" target=\"_blank\" rel=\"nofollow\">52-47 vote<\/a> with no Democratic support.<\/p>\n<p>The House is due to take an initial procedural vote early in the afternoon, followed by a final vote later on Tuesday. But the fate of the package is far from certain even though it only needs a simple-majority vote to be approved. Johnson has struggled to get the Republican Party aligned as lawmakers on the right have said the measure doesn&#8217;t go far enough and some centrists with tough elections ahead in November express concerns about immigration enforcement practices.<\/p>\n<p>Republican Rep. <a href=\"https:\/\/www.cnbc.com\/video\/2025\/08\/28\/rep-chip-roy-on-congressional-stock-trading-ban-u-s-governments-stake-in-intel.html\" rel=\"nofollow noopener\" target=\"_blank\">Chip Roy<\/a>, a Texas hardliner, <a href=\"https:\/\/www.politico.com\/live-updates\/2026\/06\/09\/congress\/what-were-watching-00954166\" target=\"_blank\" rel=\"nofollow noopener\">told House leadership<\/a> that he was undecided, according to Politico. And Rep. <a href=\"https:\/\/www.cnbc.com\/2026\/02\/10\/gop-tariffs-trump-house-johnson.html\" rel=\"nofollow noopener\" target=\"_blank\">Kevin Kiley<\/a>, who switched his party affiliation from Republican to independent in March but still caucuses with the GOP, has said he opposes the package without changes to immigration enforcement.<\/p>\n<p>Republicans have a <a href=\"https:\/\/pressgallery.house.gov\/member-data\/party-breakdown\" target=\"_blank\" rel=\"nofollow noopener\">narrow majority<\/a> in the House and can afford to lose a handful of votes if Democrats are united in opposition.<\/p>\n<p>Passage of the immigration funding package would be an important hurdle for Johnson to clear, as he struggles to get other Trump priorities over the finish line with a dwindling number of days Congress will be in session before the <a href=\"https:\/\/www.cnbc.com\/elections\/\" rel=\"nofollow noopener\" target=\"_blank\">2026 midterm elections<\/a>.<\/p>\n<p>Johnson huddled with Trump on Tuesday about ICE and CBP funding, as well as an attempt to extend a <a href=\"https:\/\/www.cnbc.com\/2026\/04\/17\/section-702-fisa-congress-surveillance.html\" rel=\"nofollow noopener\" target=\"_blank\">section of the Foreign Intelligence Surveillance Act<\/a> of 1978 that allows the government to collect the communications of people outside the U.S., including when they are interacting with Americans.<\/p>\n<p>Section 702 of the act is <a href=\"https:\/\/www.cnbc.com\/2026\/04\/30\/fisa-section-702-congress-extension.html\" rel=\"nofollow noopener\" target=\"_blank\">due to expire June 12<\/a> unless Congress extends it. Privacy hawks on both sides of the aisle have called to amend the policy to protect U.S. citizens from government overreach, meaning Johnson will need to rely on some Democratic support to get any extension over the finish line. FISA Section 702  has traditionally had both supporters and foes in each political party.<\/p>\n<p>Democrats, meanwhile, are threatening to withhold support after Trump named Federal Housing Finance Agency Director <a href=\"https:\/\/www.cnbc.com\/video\/2014\/11\/25\/bill-pulte-expects-housing-starts-to-increase-.html\" rel=\"nofollow noopener\" target=\"_blank\">Bill Pulte<\/a> as director of national intelligence. Pulte has <a href=\"https:\/\/www.cnbc.com\/2026\/06\/02\/intelligence-trump-bill-pulte-tulsi-gabbard.html\" rel=\"nofollow noopener\" target=\"_blank\">no known prior intelligence experience<\/a> and has shown a willingness to use his position to go after Trump&#8217;s foes.<\/p>\n<p>&#8220;The negotiations prior to Trump&#8217;s announcement with respect to Bill Pulte were already in a very sensitive place,&#8221; House Minority Leader <a href=\"https:\/\/www.cnbc.com\/video\/2026\/06\/08\/hakeem-jeffries-on-democrats-midterm-strategy-and-priorities.html\" rel=\"nofollow noopener\" target=\"_blank\">Hakeem Jeffries<\/a>, D-N.Y., said at a press conference on Monday. &#8220;And then Donald Trump, as he often does, tosses a hand grenade into those sensitive negotiations by elevating Bill Pulte as the director of national intelligence.&#8221;<\/p>\n<p>Asked if he&#8217;d let FISA expire,\u00a0Jeffries said conversations were ongoing &#8220;but clearly to get to good faith negotiations, the effort to elevate Bill Pulte as the acting director of national intelligence should be reversed immediately. And then let&#8217;s see where we wind up at the end of the week.&#8221;<\/p>\n<p> Some Republicans have also called on Trump to drop Pulte as acting director of national intelligence.<\/p>\n<p>&#8220;FISA gives us over 50% of our most sensitive intelligence and has enabled the U.S. to stop multiple terrorist attacks,&#8221; Rep. <a href=\"https:\/\/www.cnbc.com\/2025\/06\/28\/house-republican-don-bacon-of-nebraska-will-not-seek-reelection.html\" rel=\"nofollow noopener\" target=\"_blank\">Don Bacon<\/a>, R-Neb., a moderate who is retiring at the end of this Congress, <a href=\"https:\/\/x.com\/RepDonBacon\/status\/2063956995778937346?s=20\" target=\"_blank\" rel=\"nofollow\">posted to X<\/a> on Monday. &#8220;Letting FISA lapse would reflect a nation paralyzed by hyper-partisanship and dysfunction.
