The Supreme Court of the United States has struck down President Donald Trump\u2019s executive order eliminating birthright citizenship, upholding the 14th Amendment instead.<\/p>\n
Tuesday marked the last day of the Supreme Court\u2019s term and the decision was the last one issued.<\/p>\n
The case, Trump v. Barbara, focused on Trump\u2019s order that children born in the U.S. to parents in the country, either temporarily or illegally, are not American citizens,\u00a0The Washington Post<\/a>\u00a0reported.<\/p>\n The majority opinion was written by Chief Justice John Roberts, who said that citizenship dates back to English common law and being \u201cborn within the dominions.\u201d<\/p>\n \u201cCitizenship, then and now, was the right to have rights\u2014to freely participate in our political community. The Framers of the Fourteenth Amendment extended that promise to \u2018every free-born person in this land,\u2019\u201d Roberts wrote, according to\u00a0The Associated Press<\/a>. \u201cWe keep that promise today.\u201d<\/p>\n Liberal Justices Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson joined Roberts, along with conservative Justices Brett Kavanaugh and Amy Coney Barrett, on the majority opinion.<\/p>\n But Kavanaugh\u2019s dissent threaded a needle, saying that he was \u201cconcurring in the judgment,\u201d but also \u201cdissenting in part.\u201d That means, according to\u00a0CNN<\/a>, he agrees that the majority of the executive order was unconstitutional, but he disagrees that the statutes are required by the Constitution.<\/p>\n
