Gavin Newsom&#8217;s taxpayer-funded diaper program, including a $6.2 million contract awarded to the nonprofit Baby2Baby without a formal competitive bid.\u00a0<\/p>\n<p>The\u00a0<a href=\"https:\/\/www.documentcloud.org\/projects\/225249-dipaergate-public\/\" target=\"_blank\" rel=\"noopener nofollow\">356 pages<\/a> the state released include the executed contract, internal analyses, vendor proposals and email threads between the California Department of Health Care Access and Information (HCAI) and the organizations that responded to the state&#8217;s request for information.<\/p>\n<p>CBS California Investigates <a href=\"https:\/\/www.cbsnews.com\/news\/california-diaper-program-baby2baby-newsom\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\" rel=\"nofollow noopener\">reviewed every page<\/a>.<\/p>\n<p>Nothing in the released records reveals illegal conduct. The\u00a0<a href=\"https:\/\/www.cbsnews.com\/news\/newsoms-office-diaper-contract-reporting-demonstrably-false-corrections\/\" data-invalid-url-rewritten-http=\"\" rel=\"nofollow noopener\" target=\"_blank\">exemption lawmakers added to the budget<\/a>\u00a0made it legal for the administration to bypass ordinarily required competitive bidding and state contract review.<\/p>\n<p>Instead, the records raise questions about why the state designed a program its own agency warned could waste taxpayer-funded diapers. They also show the state selected Baby2Baby even though the state&#8217;s recommendation identified the other finalist as ready to provide the planned direct-to-consumer component.\u00a0<\/p>\n<p>The records reveal repeated warnings that Newsom&#8217;s taxpayer-funded California diaper program could &#8220;lead to waste.&#8221;\u00a0<\/p>\n<p><a href=\"https:\/\/www.cbsnews.com\/news\/california-records-newsom-baby2baby-diaper-contract\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\" rel=\"nofollow noopener\">Read the full investigation here.<\/a><\/p>\n<p>These are some of the other key findings.\u00a0<\/p>\n<p>Records\u00a0<a href=\"https:\/\/www.cbsnews.com\/news\/california-diaper-program-baby2baby-newsom\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\" rel=\"nofollow noopener\">reveal repeated warnings <\/a>that Baby2Baby&#8217;s plan to send every baby home with 400 diapers in limited sizes could lead to waste. The other finalist offered more diapers, more sizes and a direct-to-consumer option.<br \/>The contract locks in the same design that prompted those waste concerns raised by applicants and state staff. Families receive 400 diapers at hospital discharge, limited to Newborn and Size 1, with\u00a0<a href=\"https:\/\/www.documentcloud.org\/documents\/28515463-contract-hcai-b2b-agreement-25-26096-executed\/?q=%22return%20or%20exchange%22#document\/p8\" target=\"_blank\" rel=\"noopener nofollow\">no right to return or exchange<\/a>\u00a0them if the baby outgrows the supply. \u00a0<br \/>The state\u00a0<a href=\"https:\/\/bcp.dof.ca.gov\/2526\/FY2526_ORG4140_BCP8112.pdf\" target=\"_blank\" rel=\"noopener nofollow\">designed the program<\/a> around Baby2Baby&#8217;s existing hospital-distribution model before officially seeking information from other potential vendors, then signed a contract that adopted Baby2Baby&#8217;s<a href=\"https:\/\/www.documentcloud.org\/documents\/28515431-baby2baby-response-for-rfi-email-attachment-rfi-24-25068\/?q=%22packed%20200%20per%22#document\/p9\" target=\"_blank\" rel=\"noopener nofollow\"> specific plan<\/a>.The\u00a0<a href=\"https:\/\/www.documentcloud.org\/projects\/225249-dipaergate-public\/\" target=\"_blank\" rel=\"noopener nofollow\">356-page record release<\/a> contains no bid scoring sheets, evaluation criteria or rankings showing how proposals were assessed against one another. The state&#8217;s\u00a0<a href=\"https:\/\/www.documentcloud.org\/documents\/28517211-hcai-diaper-rfi-response-summary-matrix-redacted-readable-8-page\/?q=%22Not%20answered%22\" target=\"_blank\" rel=\"noopener nofollow\">comparison spreadsheet<\/a> contains numerous &#8220;Not answered&#8221; cells, and the closest thing to an evaluation in the released records is the agency&#8217;s\u00a0<a href=\"https:\/\/www.documentcloud.org\/documents\/28513748-hcai-diaper-finalist-recommendation-revised-20251202\/\" target=\"_blank\" rel=\"noopener nofollow\">final recommendation<\/a>.<br \/>That\u00a0<a href=\"https:\/\/www.documentcloud.org\/documents\/28513748-hcai-diaper-finalist-recommendation-revised-20251202\/\" target=\"_blank\" rel=\"noopener nofollow\">recommendation<\/a> identifies two finalists and documents significant advantages offered by the other finalist. SupplyBank.org offered\u00a0<a href=\"https:\/\/www.documentcloud.org\/documents\/28515419-supply-bank-rfi-24-25068-sbo-supplemental-questions-contacts-pricing-redacted\/#document\/p2\" target=\"_blank\" rel=\"noopener nofollow\">more diapers, in more sizes<\/a>, along with direct-to-consumer distribution.<br \/>Other proposals offered families more flexibility but are absent from the state&#8217;s final comparison documents. Amazon<a href=\"https:\/\/www.documentcloud.org\/documents\/28515427-amazon-dhca-rfi-24-25068-amazon-business-copy\/\" target=\"_blank\" rel=\"noopener nofollow\"> proposed vouchers<\/a> that would allow families to select diaper sizes, receive them at home and make returns, but Amazon does not appear in the\u00a0<a href=\"https:\/\/www.documentcloud.org\/documents\/28517211-hcai-diaper-rfi-response-summary-matrix-redacted-readable-8-page\/\" target=\"_blank\" rel=\"noopener nofollow\">comparison<\/a> or\u00a0<a href=\"https:\/\/www.documentcloud.org\/documents\/28513748-hcai-diaper-finalist-recommendation-revised-20251202\/\" target=\"_blank\" rel=\"noopener nofollow\">finalist records<\/a>.<br \/>The state&#8217;s own records do not agree on how many organizations responded. Different documents identify\u00a0<a href=\"https:\/\/www.documentcloud.org\/documents\/28513753-hcai-executive-summary-of-rfi-responses\/\" target=\"_blank\" rel=\"noopener nofollow\">11<\/a>,<a href=\"https:\/\/www.documentcloud.org\/documents\/28513748-hcai-diaper-finalist-recommendation-revised-20251202\/\" target=\"_blank\" rel=\"noopener nofollow\"> 14<\/a> and<a href=\"https:\/\/hcai.ca.gov\/golden-state-start-contract\/\" target=\"_blank\" rel=\"noopener nofollow\"> 15<\/a> respondents. At least one applicant says it submitted a response but never received a meeting.The contract requires taxpayers to cover<a href=\"https:\/\/www.documentcloud.org\/documents\/28515463-contract-hcai-b2b-agreement-25-26096-executed\/?q=%22including%20Golden%20State%22#document\/p12\" target=\"_blank\" rel=\"noopener nofollow\"> California branding<\/a>. The records say a simpler design<a href=\"https:\/\/www.documentcloud.org\/documents\/28513752-hcai-california-diaper-rfi-internal-questions-4-24-25\/?q=%22could%20reduce%22\" target=\"_blank\" rel=\"noopener nofollow\"> &#8220;could reduce&#8221;<\/a> costs and warn that diaper quality could affect<a href=\"https:\/\/www.documentcloud.org\/documents\/28515463-contract-hcai-b2b-agreement-25-26096-executed\/?q=%22reputation%22\" target=\"_blank\" rel=\"noopener nofollow\"> &#8220;the State&#8217;s reputation.&#8221;<\/a><br \/>Confidentiality and coordinated messaging are written into the agreement. The program&#8217;s oversight committee meetings are<a href=\"https:\/\/www.documentcloud.org\/documents\/28515463-contract-hcai-b2b-agreement-25-26096-executed\/?q=%22or%20public%20meetings%22#document\/p9\" target=\"_blank\" rel=\"noopener nofollow\"> &#8220;not open or public,&#8221;<\/a> and the state and Baby2Baby must<a href=\"https:\/\/www.documentcloud.org\/documents\/28515463-contract-hcai-b2b-agreement-25-26096-executed\/?q=%22mutually%20approved%20communications%22#document\/p9\" target=\"_blank\" rel=\"noopener nofollow\"> mutually approve<\/a> the communications strategy and talking points.<br \/>Baby2Baby<a href=\"https:\/\/www.documentcloud.org\/documents\/28515422-baby2baby-diaper-rfi-follow-up-questions-q-baby2baby-2025-august-copy\/?q=%22the%20diaper%20manufacturer%22#document\/p1\" target=\"_blank\" rel=\"noopener nofollow\"> declined to identify its diaper manufacturer<\/a> during the selection process.<a href=\"https:\/\/www.documentcloud.org\/documents\/28515431-baby2baby-response-for-rfi-email-attachment-rfi-24-25068\/?q=%22Mexico%22#document\/p4\" target=\"_blank\" rel=\"noopener nofollow\"> The manufacturer is in Mexico<\/a>.<br \/>The executed contract originally cited a prescription-drug law as authority to bypass contract oversight. In the released copy, that citation is<a href=\"https:\/\/www.documentcloud.org\/documents\/28515463-contract-hcai-b2b-agreement-25-26096-executed\/#document\/p3\" target=\"_blank\" rel=\"noopener nofollow\"> crossed out and replaced<\/a> with the budget exemption beside a notation dated eight days after CBS California Investigates requested the records.<br \/>Despite concerns about transparency, oversight and the optics of the Baby2Baby deal, lawmakers renewed both the diaper program and its contracting exemption for a second year.<\/p>\n<p>CBS California Investigates sent the state several follow-up questions July 20 and is still waiting for answers.<\/p>\n<p>(Document links in this story open the individual state records on DocumentCloud, redacted to remove personal contact information and confidential pricing information.)<\/p>\n<p>CBS California Investigates has been following the state&#8217;s no-bid Baby2Baby diaper deal since May, when our<a href=\"https:\/\/www.cbsnews.com\/news\/california-diaper-gate-taxpayer-costs-fact-check\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\" rel=\"nofollow noopener\"> fact-check found the loudest criticisms of the program were wrong<\/a>, but the state refused to release the contract.<\/p>\n<p>The Newsom administration then<a href=\"https:\/\/www.cbsnews.com\/news\/california-baby2baby-diaper-contract-public-records-delays\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\" rel=\"nofollow noopener\"> delayed releasing the records<\/a> for 66 days while lawmakers weighed giving agencies even more time to respond to requests like these.<\/p>\n<p>In the meantime, the investigation revealed that what the governor called a &#8220;competitive bid process&#8221; <a href=\"https:\/\/www.cbsnews.com\/news\/california-diapergate-non-competitive-exemptions-buried-in-budget\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\" rel=\"nofollow noopener\">was actually &#8220;non-competitively bid&#8221;<\/a>. It was legal, exempted by a single sentence in the state budget, one of dozens of similar exemptions covering more than $1 billion in state contracts.\u00a0<\/p>\n<p>Six hours after that investigation was published, the state released the <a href=\"https:\/\/www.cbsnews.com\/news\/california-records-newsom-baby2baby-diaper-contract\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\" rel=\"nofollow noopener\">356 pages of records<\/a>.\u00a0<\/p>\n<p>Thirty minutes later, the governor&#8217;s office responded, calling our reporting &#8220;demonstrably false.&#8221; CBS California then published a<a href=\"https:\/\/www.cbsnews.com\/news\/newsoms-office-diaper-contract-reporting-demonstrably-false-corrections\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\" rel=\"nofollow noopener\"> point-by-point review, checking every claim against the state&#8217;s own records<\/a>. That review also revealed that the governor&#8217;s proposed budget funded the Baby2Baby program at the expense of traditional diaper bank funding, which lawmakers later restored.<\/p>\n<p>CBS California Investigates then<a href=\"https:\/\/www.cbsnews.com\/news\/california-records-newsom-baby2baby-diaper-contract\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\" rel=\"nofollow noopener\"> summarized the key findings in the 356 pages of records<\/a> that Californians waited 66 days to see.
