Minnesota\u2019s first-in-the-nation ban on \u200bAI-generated fake nude images will remain in effect as \u200ca constitutional challenge by Elon Musk\u2019s xAI proceeds, \u200bafter a federal judge on Friday \u2060declined to block the law at an early stage of the case.<\/p>\n

Musk\u2019s xAI company argues the measure restricts \u200cfree speech protected by the U.S. Constitution, while Minnesota says the law is narrowly \u200ctailored to curb the spread of nonconsensual \u200csexual imagery \u2060created with artificial intelligence.<\/p>\n

U.S. District Judge \u2060Donovan Frank rejected xAI\u2019s request for a preliminary injunction against the law, which took effect on August 1 and prohibits \u200bwebsite operators, software \u200cdevelopers and others from allowing users to \u201cnudify\u201d images of identifiable people using AI technology.<\/p>\n

Frank\u2019s order said xAI failed to show it would suffer harm while \u200cit pursues a lawsuit alleging the new \u200blaw violates the Constitution\u2019s First Amendment by restricting protected expressive activity.<\/p>\n

\u201cThe constitutional issues raised \u2060by the parties are complex, particularly when considered in the context of this new technology and the \u200crisks that it poses to the public,\u201d Frank wrote. \u201cThese issues deserve, and will receive, full consideration.\u201d<\/p>\n

xAI and the Minnesota attorney general\u2019s office did not immediately respond to requests for comment.<\/p>\n

The judge earlier turned down Musk\u2019s bid in July to \u200cstop the law from taking effect but agreed to fast-track \u200bhis review of the measure.<\/p>\n

Musk\u2019s Grok AI chatbot has faced criticism over its creation of \u2060sexually explicit content.<\/a> Regulators have sought stronger safeguards and \u2060imposed bans to help curb the spread of artificially created illegal material.<\/p>\n

xAI has begun \u200csuing users it alleges are evading Grok\u2019s technological blockers to create sexual images of \u200bpeople without their consent.<\/p>\n
