{"id":53173,"date":"2026-05-01T23:25:09","date_gmt":"2026-05-01T23:25:09","guid":{"rendered":"https:\/\/www.europesays.com\/people\/53173\/"},"modified":"2026-05-01T23:25:09","modified_gmt":"2026-05-01T23:25:09","slug":"jonathan-turley-calling-the-court-illegitimate-is-the-lefts-latest-assault-on-the-constitution","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/people\/53173\/","title":{"rendered":"JONATHAN TURLEY: Calling the court illegitimate is the left\u2019s latest assault on the Constitution"},"content":{"rendered":"<p>The <a href=\"https:\/\/www.foxnews.com\/category\/politics\/judiciary\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Supreme Court;elm:context_link;itc:0;sec:content-canvas\" class=\"link rapid-noclick-resp\">Supreme Court<\/a><a href=\"https:\/\/www.foxnews.com\/category\/politics\/judiciary\/supreme-court\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:&#039;s;elm:context_link;itc:0;sec:content-canvas\" class=\"link rapid-noclick-resp\">&#8216;s<\/a> decision in Louisiana v. Callais took 36 pages to explain why Section 2 of the Voting Rights Act is about combating intentional racial discrimination, not allowing racial gerrymandering. However, House Minority Leader Hakeem Jeffries wrapped it up in one word: &#8220;illegitimate.&#8221;<\/p>\n<p>Jeffries was not speaking of the case, but of the court. The man who would become the next speaker of the House if Democrats retake power in November has joined other radicals in denying the legitimacy of the nation&#8217;s highest court.<\/p>\n<p>Just for the record, the Supreme Court did not strike down Section 2, but it said neither the <a href=\"https:\/\/www.foxnews.com\/category\/politics\/executive\/law\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:law;elm:context_link;itc:0;sec:content-canvas\" class=\"link rapid-noclick-resp\">law<\/a> nor the Constitution allows legislators to manipulate district lines to guarantee that candidates of a particular race will be elected. It was written not to give any race an advantage, but to prevent a state from creating a disadvantage for voters based on their race. The act prevents any state from intentionally drawing districts &#8220;to afford minority voters less opportunity because of their race.&#8221;<\/p>\n<p>This is a matter upon which people of good faith can disagree. Many of the justices have long opposed racial criteria in areas ranging from <a href=\"https:\/\/www.foxnews.com\/category\/us\/education\/college\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:college;elm:context_link;itc:0;sec:content-canvas\" class=\"link rapid-noclick-resp\">college<\/a> admissions to voting districts. Chief Justice John Roberts stated it bluntly in 2006: &#8220;It is a sordid business, this divvying us up by race.&#8221; Like others, Roberts abhors racial discrimination but declared in another case that &#8220;the way to stop discriminating on the basis of race is to stop discriminating on the basis of race.&#8221;<\/p>\n<p><a href=\"https:\/\/www.aol.com\/news\/supreme-court-rules-key-voting-141443559.html\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Supreme Court Rules On Key Voting Rights Act Rule As Republicans And Democrats Wage Redistricting War;elm:context_link;itc:0;sec:content-canvas\" class=\"link rapid-noclick-resp\">Supreme Court Rules On Key Voting Rights Act Rule As Republicans And Democrats Wage Redistricting War<\/a><\/p>\n<p>You will find no such distinctions in much of the press, where experts declared the death of equal voting laws in America. UCLA Law professor Richard Hasen dispenses with any nuance and simply ran a Slate column titled, &#8220;The Slaying of the Voting Rights Act by the Coward Alito.&#8221;<\/p>\n<p><a href=\"https:\/\/foxnews.onelink.me\/xLDS\/mvaj7wvj\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Read On The Fox News App;elm:context_link;itc:0;sec:content-canvas\" class=\"link rapid-noclick-resp\">Read On The Fox News App<\/a><\/p>\n<p>For years, liberal law professors have been <a href=\"https:\/\/www.foxnews.com\/opinion\/jonathan-turley-justice-jackson-plays-pundit-dismay-scotus-colleagues\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:trashing conservative justices;elm:context_link;itc:0;sec:content-canvas\" class=\"link rapid-noclick-resp\">trashing conservative justices<\/a>, including Berkeley Law Dean Erwin Chemerinsky, who called them &#8220;partisan hacks.&#8221;<\/p>\n<p>However, the name-calling has mutated into a movement to scrap the court or the Constitution, or both. Chemerinsky wrote a book recently, &#8220;No Democracy Lasts Forever: How the Constitution Threatens the <a href=\"https:\/\/www.foxnews.com\/category\/us\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:United States;elm:context_link;itc:0;sec:content-canvas\" class=\"link rapid-noclick-resp\">United States<\/a>.&#8221;<\/p>\n<p><a href=\"https:\/\/www.aol.com\/news\/media-outrage-over-supreme-court-155010697.html\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Media Outrage Over Supreme Court\u2019s Voting Rights Act Decision Collides With Reality;elm:context_link;itc:0;sec:content-canvas\" class=\"link rapid-noclick-resp\">Media Outrage Over Supreme Court\u2019s Voting Rights Act Decision Collides With Reality<\/a><\/p>\n<p>Rep. Jamie Raskin, D-Md., joined Jeffries in calling for changing the Supreme Court after the decision, saying, &#8220;We\u2019re going to have to try to transform the way the Supreme Court has been gerrymandered itself and stacked and packed with MAGA appointees.&#8221;<\/p>\n<p>There was, of course, no such movement during the decades with a liberal majority that set aside an array of long-standing cases. It was only when a stable conservative majority emerged that law professors declared the court illegitimate or dangerous, with many calling for <a href=\"https:\/\/www.aol.com\/news\/jonathan-turley-ex-conservative-icon-215808240.html\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:packing the court with an instant liberal majority;elm:context_link;itc:0;sec:content-canvas\" class=\"link rapid-noclick-resp\">packing the court with an instant liberal majority<\/a> once Democrats retake power.<\/p>\n<p>I discuss some of these voices as the &#8220;new Jacobins&#8221; in my book &#8220;<a href=\"https:\/\/www.amazon.com\/Rage-Republic-Unfinished-American-Revolution\/dp\/1668205025\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Rage and the Republic;elm:context_link;itc:0;sec:content-canvas\" class=\"link rapid-noclick-resp\">Rage and the Republic<\/a>,&#8221; figures echoing the radical concepts and means used in France before what became known as the Terror.<\/p>\n<p>Law professors Ryan D. Doerfler of Harvard and Samuel Moyn of Yale have called for the nation to &#8220;<a href=\"https:\/\/www.foxnews.com\/opinion\/jonathan-turley-elites-call-constitution-broken-americans-know-its-our-greatest-gift\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:reclaim America from constitutionalism;elm:context_link;itc:0;sec:content-canvas\" class=\"link rapid-noclick-resp\">reclaim America from constitutionalism<\/a>.&#8221; Last December, they published a column, &#8220;It\u2019s Time to Accept that the US Supreme Court is Illegitimate and Must Be Replaced.&#8221;<\/p>\n<p><a href=\"https:\/\/www.foxnews.com\/politics\/judges-say-redraw-louisiana-congressional-map-themselves-lawmakers\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Judges Say They&#039;ll Redraw Louisiana Congressional Map Themselves If Lawmakers Can&#039;t;elm:context_link;itc:0;sec:content-canvas\" class=\"link rapid-noclick-resp\">Judges Say They&#8217;ll Redraw Louisiana Congressional Map Themselves If Lawmakers Can&#8217;t<\/a><\/p>\n<p>They insist that citizens must be rid of this <a href=\"https:\/\/www.aol.com\/news\/latest-scotus-leak-gift-liberals-220046514.html\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:meddlesome court;elm:context_link;itc:0;sec:content-canvas\" class=\"link rapid-noclick-resp\">meddlesome court<\/a>: &#8220;remaking institutions like the US Supreme Court so that Americans don\u2019t have to suffer future decades of oligarchy-facilitating rule that makes a parody of the democracy they were promised.&#8221;<\/p>\n<p>Many Democrats realize that the public is rather attached to both the Constitution and its core institutions. That is why various Democratic politicians and pundits have been pledging to <a href=\"https:\/\/www.aol.com\/news\/morning-glory-end-filibuster-pack-090015655.html\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:pack the court once they;elm:context_link;itc:0;sec:content-canvas\" class=\"link rapid-noclick-resp\">pack the court once they<\/a> are back in power. Some have suggested that if they are going to change the political system and retain power, they will have to do it with the help of a compliant court.<\/p>\n<p>Democratic strategist James Carville stated matter-of-factly, &#8220;They\u2019re going to recommend that the number of <a href=\"https:\/\/www.foxnews.com\/category\/politics\/judiciary\/supreme-court\/supreme-court-oral-arguments\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Supreme Court justices;elm:context_link;itc:0;sec:content-canvas\" class=\"link rapid-noclick-resp\">Supreme Court justices<\/a> go from nine to 13. That\u2019s going to happen, people.&#8221;<\/p>\n<p>He added recently, &#8220;Don\u2019t run on it. Don\u2019t talk about it. Just do it.&#8221;<\/p>\n<p><a href=\"https:\/\/www.foxnews.com\/opinion\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Click Here For More Fox News Opinion;elm:context_link;itc:0;sec:content-canvas\" class=\"link rapid-noclick-resp\">Click Here For More Fox News Opinion<\/a><\/p>\n<p>To do that, you must first <a href=\"https:\/\/www.aol.com\/news\/john-yoo-left-war-supreme-110037524.html\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:delegitimize the court;elm:context_link;itc:0;sec:content-canvas\" class=\"link rapid-noclick-resp\">delegitimize the court<\/a>. You must attack both the individual justices and the institution itself. You need true rage to get the people to tear apart the core institution of a republic on its 250th anniversary.<\/p>\n<p>Now you have the next possible speaker of the United States declaring the Supreme Court illegitimate because he disagrees with its interpretation of the law.<\/p>\n<p><a href=\"https:\/\/foxnews.onelink.me\/xLDS?pid=AppArticleLink&amp;af_dp=foxnewsaf%3A%2F%2F&amp;af_web_dp=https%3A%2F%2Fwww.foxnews.com%2Fapps-products\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Click Here To Download The Fox News App;elm:context_link;itc:0;sec:content-canvas\" class=\"link rapid-noclick-resp\">Click Here To Download The Fox News App<\/a><\/p>\n<p>What these figures do not mention is that the majority of opinions by the Supreme Court are unanimous or nearly unanimous. Comparatively, few cases break along strict ideological 6-3 lines. Indeed, just last week, it was President <a href=\"https:\/\/www.foxnews.com\/category\/person\/donald-trump\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Donald Trump;elm:context_link;itc:0;sec:content-canvas\" class=\"link rapid-noclick-resp\">Donald Trump<\/a> who was denouncing the conservative justices as disloyal and weak for, again, ruling against his administration.<\/p>\n<p>It is not the voting record nor the underlying interpretations that are motivating this campaign of delegitimization. It is power.
