Meta<\/a> pirated millions of their copyrighted works to train its large language model (LLM) Llama.<\/p>\n“Meta\u2019s mass-scale infringement isn\u2019t public progress, and AI will never be properly realized if tech companies prioritize pirate sites over \u2060scholarship and imagination,” Maria Pallante, president of the Association of American Publishers, said in a statement.<\/p>\n
The lawsuit opens a new front in the ongoing copyright battle between creators and tech companies over AI training, in which dozens of authors, news outlets, visual artists and other plaintiffs have sued companies including Meta, OpenAI and Anthropic for infringement.<\/p>\n
All of the pending cases will likely \u200crevolve around whether AI systems make fair use of copyrighted \u200bmaterial by using it to create new, transformative content.<\/p>\n
The \u200cfirst two judges to consider the matter \u2060issued diverging rulings last year.<\/p>\n
Amazon- and Google-backed Anthropic was \u2060the first major AI company to settle one of the cases, agreeing last year to \u200cpay a group of authors $1.5 \u200bbillion to resolve a class-action \u200clawsuit that could have cost the company \u200bbillions more in damages for alleged piracy.<\/p>\n
The publishers \u200ballege \u2060that Meta pirated works ranging \u200cfrom textbooks to scientific articles to novels including The Fifth Season by N.K. Jemisin and The Wild Robot by Peter Brown for its AI training.<\/p>\n
They asked \u200cthe court for permission to represent a larger \u200cclass of copyright owners and an unspecified amount of monetary damages.<\/p>\n
In a statement on Tuesday, a Meta spokesperson said: \u201cAI is \u2060powering transformative innovations, productivity and creativity for \u200bindividuals \u2060and companies, and courts have rightly found that training AI on copyrighted material can qualify as fair use.\u201d<\/p>\n
