{"id":62822,"date":"2026-05-08T19:07:09","date_gmt":"2026-05-08T19:07:09","guid":{"rendered":"https:\/\/www.europesays.com\/people\/62822\/"},"modified":"2026-05-08T19:07:09","modified_gmt":"2026-05-08T19:07:09","slug":"gop-lawmakers-urge-high-court-to-reinstate-abortion-pill-restrictions","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/people\/62822\/","title":{"rendered":"GOP lawmakers urge high court to reinstate abortion pill restrictions\u00a0"},"content":{"rendered":"<p>More than 100 <a target=\"_blank\" rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/republican\/\" type=\"post_tag\" id=\"926\">Republican<\/a> lawmakers filed an amicus brief with the <a target=\"_blank\" rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.washingtonexaminer.com\/section\/supreme-court\/\" type=\"link\" id=\"https:\/\/www.washingtonexaminer.com\/section\/supreme-court\/\">Supreme Court<\/a> urging the justices to reinstate restrictions on the <a target=\"_blank\" rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/abortion\/\" type=\"post_tag\" id=\"200\">abortion<\/a> pill mifepristone, arguing the Biden administration unlawfully loosened safety requirements for the drug.<\/p>\n<p><a target=\"_blank\" rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25A1207\/408275\/20260507122624693_25A1207%20and%2025A1208_Amicus%20Brief.pdf\" type=\"link\" id=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25A1207\/408275\/20260507122624693_25A1207%20and%2025A1208_Amicus%20Brief.pdf\">The brief<\/a>, signed by Speaker of the House <a target=\"_blank\" rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/mike-johnson\/\" type=\"post_tag\" id=\"7043\">Mike Johnson <\/a>(R-LA), Senate Majority Leader <a target=\"_blank\" rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/john-thune\/\" type=\"post_tag\" id=\"178\">John Thune<\/a> (R-SD), and House Majority Leader <a target=\"_blank\" rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/steve-scalise\/\" type=\"post_tag\" id=\"1757\">Steve Scalise<\/a> (R-LA), among 113 GOP lawmakers, asked the high court to uphold a 5th U.S. Circuit Court of Appeals ruling restoring stricter regulations on the drug and reject emergency appeals from manufacturers Danco Laboratories and GenBioPro.<\/p>\n<p>On May 1, the 5th Circuit <a target=\"_blank\" rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/4553456\/samuel-alito-halts-appeals-court-ruling-mifepristone-abortion-pills\/\" type=\"post\" id=\"4553456\">temporarily blocked<\/a> mifepristone from being prescribed online and shipped through the mail, reinstating requirements for in-person medical visits before patients can obtain the medication.<\/p>\n<p>The Supreme Court temporarily halted that ruling Monday, with Justice <a target=\"_blank\" rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/samuel-alito\/\" type=\"post_tag\" id=\"1232\">Samuel Alito<\/a> issuing an administrative stay through May 11 to give the justices time to consider requests from the drugmakers to preserve nationwide access while the court weighs whether to take up the case.<\/p>\n<p>In their filing, Republicans argued the <a target=\"_blank\" rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/fda\/\" type=\"post_tag\" id=\"1169\">Food and Drug Administration<\/a> exceeded its authority by loosening restrictions on chemical abortion drugs and permitting them to be distributed by mail despite long-standing federal laws restricting the mailing of abortion-inducing drugs.<\/p>\n<p>The lawmakers also argued that removing the in-person dispensing requirement prevents doctors from screening for serious medical conditions, including ectopic pregnancies, and makes it harder to identify cases of coercion or abuse.<\/p>\n<p>\u201cIt also increases the likelihood that some women are being coerced into taking these drugs against their will,\u201d the lawmakers wrote, citing the experience of plaintiff Rosalie Markezich.<\/p>\n<p>Rep. Chris Smith (R-NJ) accused the Biden administration of using the FDA to \u201csubvert\u201d the Supreme Court\u2019s decision in <a target=\"_blank\" rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/dobbs-v-jackson-womens-health-organization\/\" type=\"post_tag\" id=\"2202\">Dobbs v. Jackson Women\u2019s Health Organization<\/a> by eliminating mifepristone\u2019s in-person dispensing requirement.<\/p>\n<p>Smith called the FDA\u2019s decision \u201creckless,\u201d arguing it prioritized \u201cpro-abortion ideology above medical due diligence.\u201d<\/p>\n<p><a target=\"_blank\" rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/healthcare\/4561089\/trump-fire-fda-chief-marty-makary\/\">TRUMP PLANS TO FIRE FDA CHIEF MARTY MAKARY, WHO HAS CAUGHT FLAK FROM ALL DIRECTIONS<\/a><\/p>\n<p>Smith further argued that mailing the drug without in-person screenings leaves women without adequate medical oversight or evaluation for contraindications, coercion, and other health concerns.
