Rather, she argued that the question before the court is whether the conduct attributed to him creates a legal flaw that disqualifies him from leading the Mossad.

Gofman has rejected the allegations, arguing in his response to the court that he did not operate Elmakayes, directly or indirectly, and that there is no basis for the court to intervene in the appointment.

The advisory committee has also asked the court to dismiss the petitions, saying its majority decision was lawful and that there was no defect justifying judicial intervention.

However, committee chairman and former Supreme Court president Asher Grunis dissented from the majority approval, finding that flaws related to the Elmakayes affair made Gofman unsuitable for the post.

Grunis was the lone dissenting voice in the committee, finding integrity flaws in Gofman’s conduct and concluding that it was not appropriate to appoint him Mossad chief.

Tuesday’s hearing will test not only the appointment itself, but the extent to which the court is prepared to intervene in the prime minister’s choice for the head of Israel’s foreign intelligence agency.

The hearing will be held before Justices Dafna Barak-Erez, Ofer Grosskopf, and Alex Stein.
