(That\u2019s something that Cohen struggled to explain last week.) Now the question is whether Cohen will drop his long-shot bid \u2014 or try to run a hostile takeover. <\/p>\n<p>\u201cBelow them, above them, around them\u201d <\/p>\n<p class=\"css-ac37hb evys1bk0\">The trial pitting Elon Musk against OpenAI promised appearances by some of the artificial intelligence industry\u2019s biggest names, including Musk himself and, later this week, Sam Altman.<\/p>\n<p class=\"css-ac37hb evys1bk0\">Monday featured another major mogul, the Microsoft C.E.O. Satya Nadella, <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2026\/05\/11\/technology\/satya-nadella-openai-sam-altman.html\" title=\"\" rel=\"nofollow noopener\" target=\"_blank\">who faced a major question<\/a>: How much power did he have over OpenAI?<\/p>\n<p class=\"css-ac37hb evys1bk0\">\u201cWe are below them, above them, around them,\u201d Nadella once told the tech journalist Kara Swisher of Microsoft\u2019s relationship with OpenAI, comments that Musk\u2019s lawyers asked him about in court.<\/p>\n<p class=\"css-ac37hb evys1bk0\">Nadella testified that they were a technical description of sorts, <a class=\"css-yywogo\" href=\"https:\/\/www.theverge.com\/ai-artificial-intelligence\/928046\/below-them-above-them-around-them\" title=\"\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">referring to<\/a> how Microsoft technology supported OpenAI and made use of its products. But the implication by Musk\u2019s legal team was that OpenAI was beholden to the tech giant.<\/p>\n<p class=\"css-ac37hb evys1bk0\">Nadella was also asked about a seeming veto that Microsoft had over some prospective OpenAI board members. In a <a class=\"css-yywogo\" href=\"https:\/\/www.theinformation.com\/briefings\/nadella-testifies-musk-never-complained-openai-deals\" title=\"\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">series of text messages<\/a>, Altman asked about Diane Greene, the former C.E.O. of Google\u2019s cloud business. Nadella responded, \u201cNo.\u201d<\/p>\n<p class=\"css-ac37hb evys1bk0\">Kevin Scott, Microsoft\u2019s chief technology officer, added \u201cStrong strong no,\u201d a comment that Nadella liked.<\/p>\n<p class=\"css-ac37hb evys1bk0\">But Nadella denied that Microsoft was perverting OpenAI\u2019s founding mission, creating A.I. that is safe for the world. Remember that Musk has accused OpenAI of forsaking that mission when it took an initial $1 billion investment from Microsoft, and later became a for-profit company.<\/p>\n<p class=\"css-ac37hb evys1bk0\">Echoing a defense of OpenAI\u2019s, Nadella said that as Altman\u2019s start-up grew and Microsoft invested more money, he never heard anything from Musk, even though \u201cwe have each other\u2019s phone numbers.\u201d <\/p>\n<p class=\"css-ac37hb evys1bk0\">Ilya Sutskever, another OpenAI founder, also took the stand on Monday. As an OpenAI director, Sutskever famously helped push Altman out in 2023 over his lack of candor with the board, only to change his mind and support his return.<\/p>\n<p class=\"css-ac37hb evys1bk0\">Why? Altman\u2019s firing risked killing OpenAI, Sutskever testified. Trump said on Monday that the U.S.-Iran cease-fire was on \u201c<a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/live\/2026\/05\/11\/world\/iran-war-trump-hormuz\/heres-the-latest?smid=url-share\" title=\"\" rel=\"nofollow noopener\" target=\"_blank\">massive life support<\/a>.\u201d<\/p>\n<p>OpenAI and private equity join forces <\/p>\n<p class=\"css-ac37hb evys1bk0\">Artificial intelligence companies are under pressure to prove that their technology can deliver productivity gains for businesses. Private equity firms want new ways to revive <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/12\/23\/business\/private-equity-stock-market.html\" title=\"\" rel=\"nofollow noopener\" target=\"_blank\">their lagging performance<\/a> by squeezing costs from their portfolio companies.<\/p>\n<p class=\"css-ac37hb evys1bk0\">The two industries are increasingly teaming up, Niko Gallogly reports.<\/p>\n<p class=\"css-ac37hb evys1bk0\">On Monday, OpenAI announced the OpenAI Deployment Company, a <a class=\"css-yywogo\" href=\"https:\/\/openai.com\/index\/openai-launches-the-deployment-company\/\" title=\"\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">joint venture<\/a> seeded with a $4 billion investment that <a class=\"css-yywogo\" href=\"https:\/\/www.axios.com\/2026\/05\/11\/openai-deployco-private-equity\" title=\"\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">values it at $14 billion<\/a>. The round was led by TPG, with additional funding from private equity firms including Bain Capital and Advent International, and consulting firms like McKinsey &amp; Company and Bain &amp; Company.<\/p>\n<p class=\"css-ac37hb evys1bk0\">The new company will embed applied A.I. engineers in businesses to \u201cdesign, build, test and deploy production systems,\u201d OpenAI said. As part of the DeployCo launch, OpenAI said, it is acquiring Tomoro, an applied A.I. consulting firm that will bring about 150 engineers.<\/p>\n<p class=\"css-ac37hb evys1bk0\">Fast follow: OpenAI introduced DeployCo a week after Anthropic <a class=\"css-yywogo\" href=\"https:\/\/www.anthropic.com\/news\/enterprise-ai-services-company\" title=\"\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">announced<\/a> a similar partnership with Blackstone, Hellman &amp; Friedman, Goldman Sachs and other partners.<\/p>\n<p class=\"css-ac37hb evys1bk0\">Private equity is hoping A.I. will solve its problems. The industry has struggled with a flood of capital into the market over the past decade, which pushed up deal prices and made it harder to sell investments at an acceptable profit. <\/p>\n<p class=\"css-ac37hb evys1bk0\">More recently, A.I. has threatened the business model of private software companies, which many private equity firms acquired in recent years.<\/p>\n<p class=\"css-ac37hb evys1bk0\">\u201cThe private equity business needs a new value creation tool,\u201d David Roux, the executive chairman of the private equity firm BayPine, told DealBook. A.I. might be that, he said, because it\u2019s a clear way to make portfolio companies better \u2014 \u201cand that\u2019s what you get paid for.\u201d<\/p>\n<p class=\"css-ac37hb evys1bk0\">In September, BayPine <a class=\"css-yywogo\" href=\"https:\/\/www.baypine.com\/news\/baypine-powers-firm-and-its-portfolio-success-with-openai\" title=\"\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">announced its own partnership<\/a> with OpenAI, separate from DeployCo.<\/p>\n<p class=\"css-ac37hb evys1bk0\">\u201cExpect funds to hire a lot more application engineers,\u201d Roux said. \u201cIt\u2019s going to be the hottest job in the next 10 years.\u201d<\/p>\n<p>Crypto\u2019s Iran problem <\/p>\n<p class=\"css-ac37hb evys1bk0\">The war with Iran has dominated Washington politics since the first missiles were fired. It could also spoil the cryptocurrency sector\u2019s hard-fought lobbying gains over the Clarity Act, Grady McGregor reports.<\/p>\n<p class=\"css-ac37hb evys1bk0\">The latest: The bill looked to be <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2026\/01\/15\/business\/dealbook\/crypto-bill-coinbase.html\" title=\"\" rel=\"nofollow noopener\" target=\"_blank\">on shaky ground<\/a> in January before key senators reached a compromise in recent weeks to salvage it. Now, the legislation, which would establish a regulatory framework for cryptocurrencies, is set for a <a class=\"css-yywogo\" href=\"https:\/\/www.reuters.com\/sustainability\/boards-policy-regulation\/us-senate-committee-set-consider-long-awaited-crypto-bill-next-week-2026-05-09\/\" title=\"\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">Senate Banking Committee vote<\/a> on Thursday.<\/p>\n<p class=\"css-ac37hb evys1bk0\">But it still faces uncertain odds.<\/p>\n<p class=\"css-ac37hb evys1bk0\">Democrats insist that the bill include tougher antiterrorism financing provisions. But others, <a class=\"css-yywogo\" href=\"https:\/\/www.newsmax.com\/world\/globaltalk\/ayatollah-clarity-genius\/2026\/05\/07\/id\/1255528\/\" title=\"\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">including Alexander Gray<\/a>, a national security aide during President Trump\u2019s first term, disagree. <\/p>\n<p class=\"css-ac37hb evys1bk0\">That demand grew more urgent in recent weeks, people with knowledge of the matter told DealBook, as national security hawks on Capitol Hill became alarmed over Iran\u2019s reported demand last month that ships <a class=\"css-yywogo\" href=\"https:\/\/www.ft.com\/content\/02aefac4-ea62-48db-9326-c0da373b11b8\" title=\"\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">pay a toll <\/a><a class=\"css-yywogo\" href=\"https:\/\/www.ft.com\/content\/02aefac4-ea62-48db-9326-c0da373b11b8\" title=\"\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">in crypto<\/a> to pass through the Strait of Hormuz.<\/p>\n<p class=\"css-ac37hb evys1bk0\">Democratic opponents to the bill have <a class=\"css-yywogo\" href=\"https:\/\/www.banking.senate.gov\/newsroom\/minority\/warren-calls-for-treasury-and-department-of-justice-to-investigate-how-illicit-actors-are-exploiting-decentralized-finance-services-to-threaten-national-security\" title=\"\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">long argued<\/a> that the bill does not adequately address national security risks, and that it shields major parts of the crypto ecosystem \u2014 think decentralized exchanges \u2014 from anti-money-laundering rules and sanctions.<\/p>\n<p class=\"css-ac37hb evys1bk0\">Conflict of interest is another sticking point. Without an ethics provision, the bill will fail, Senator <a class=\"css-yywogo\" href=\"https:\/\/www.theblock.co\/post\/400275\/sen-gillibrand-no-crypto-bill-without-ethics-provision-amid-president-trumps-ties-through-memecoins-world-liberty\" title=\"\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">Kirsten Gillibrand<\/a>, Democrat of New York, predicted last week at Consensus Miami 2026, a crypto industry conference. \u201cWe cannot allow members of Congress, senior administration officials, presidents or vice presidents to get rich off these industries because of their insider status,\u201d she said.<\/p>\n<p class=\"css-ac37hb evys1bk0\">But the White House has pushed back, warning that it <a class=\"css-yywogo\" href=\"https:\/\/www.coindesk.com\/policy\/2026\/02\/03\/trump-adviser-says-white-house-won-t-allow-crypto-bill-to-attack-president-on-ethics\" title=\"\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">will not sign into law<\/a> any bill that carries conflict-of-interest provisions that it does not like.<\/p>\n<p class=\"css-ac37hb evys1bk0\">And then there\u2019s the fight between crypto and the banks. For months, Congress and the White House have sought to resolve differences between the two over stablecoin yield. Banks warn that yield-bearing digital coins could <a class=\"css-yywogo\" href=\"https:\/\/bpi.com\/wp-content\/uploads\/2026\/05\/Joint-Trades-Letter-Section-404-of-the-CLARITY-Act-05.08.26.pdf\" title=\"\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">siphon deposits<\/a> from the banking system, while <a class=\"css-yywogo\" href=\"https:\/\/x.com\/faryarshirzad\/status\/2050325150747484421\" title=\"\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">crypto firms argue<\/a> that a sweeping ban would be bad for the consumer and stifle innovation.<\/p>\n<p class=\"css-ac37hb evys1bk0\">Senators Thom Tillis, Republican of North Carolina, and Angela Alsobrooks, Democrat of Maryland, reportedly reached <a class=\"css-yywogo\" href=\"https:\/\/www.politico.com\/live-updates\/2026\/03\/20\/congress\/senators-strike-deal-with-white-house-to-resolve-bank-crypto-clash-00837464\" title=\"\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">a compromise on the matter<\/a> in March. Leading figures in crypto, including Brian Armstrong of Coinbase, <a class=\"css-yywogo\" href=\"https:\/\/x.com\/brian_armstrong\/status\/2050325975226081308\" title=\"\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">support it<\/a>. But banks say <a class=\"css-yywogo\" href=\"https:\/\/www.aba.com\/about-us\/press-room\/press-releases\/banking-trades-statement-on-crypto-market-structure-yield-language\" title=\"\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">it falls short<\/a>.<\/p>\n<p class=\"css-ac37hb evys1bk0\">Iran may have muddled the Clarity Act\u2019s future.
