The X owner testified as part of the trial in Oakland, California, last month.<\/p>\n<p>Before Musk left the witness stand on April 30, U.S. District Judge Yvonne Gonzalez Rogers asked the parties involved if there was any reason to hold Musk in \u201crecall status,\u201d <a data-ylk=\"slk:NBC News;elm:context_link;itc:0;sec:content-canvas;\" href=\"https:\/\/www.nbcnews.com\/tech\/elon-musk\/musk-flies-china-trump-ongoing-openai-trial-rcna344981\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">NBC News<\/a> reported. OpenAI\u2019s lawyers said, \u201cYes.\u201d<\/p>\n<p>\u200b\u201cOkay, Mr Musk, you are not excused, but you can leave for the day.\u201d Rogers told Musk, who was not required to attend in person for the whole of the case.\u200b At the time, the dates of the president\u2019s trip to China had not been confirmed.<\/p>\n<p><img alt=\"Elon Musk jetted to China despite a judge warning him that he could be recalled to a trial involving OpenAI (Getty)\" loading=\"lazy\" width=\"960\" height=\"640\" decoding=\"async\" data-nimg=\"1\" class=\"standard-img w-full w-full h-auto\" style=\"color:transparent\" src=\"https:\/\/www.europesays.com\/people\/wp-content\/uploads\/2026\/05\/https:\/\/media.zenfs.com\/en\/aol_the_independent_us_877\/8dfc8a6222ba253b9f7ba659767329ad.jpeg\"\/><\/p>\n<p>Elon Musk jetted to China despite a judge warning him that he could be recalled to a trial involving OpenAI (Getty)<\/p>\n<p>However, \u201ca typical witness would not leave the country if they were subject to recall,\u201d Jeffrey Bellin, a law professor at Vanderbilt University, told NBC News.<\/p>\n<p>He did note that there is no set rule for how near to a courthouse a witness must be if they are subject to recall. \u200bUsually, that was a matter for a judge to decide and attorneys would discuss the issue with them.<\/p>\n<p>Beijing is around 5,900 miles away from Oakland, and flying from the Chinese capital to nearby San Francisco would take around 14 hours.<\/p>\n<p>Musk boarded the flight Tuesday and the final day of testimony in the <a data-ylk=\"slk:trial;elm:context_link;itc:0;sec:content-canvas;\" href=\"https:\/\/www.aol.com\/news\/mother-4-elon-musk-kids-233727971.html\" rel=\"nofollow noopener\" target=\"_blank\">trial<\/a> was Wednesday, with closing arguments scheduled for Thursday. \u200b<\/p>\n<p>\u201cIf I were the attorney, I would have made sure that if my witness is subject to recall and he\u2019s left the country, that the judge is OK with that,\u201d Bellin added.<\/p>\n<p><img alt=\"Musk is seeking to have Sam Altman, the CEO of OpenAI, removed from his role (Reuters)\" loading=\"lazy\" width=\"960\" height=\"640\" decoding=\"async\" data-nimg=\"1\" class=\"standard-img w-full w-full h-auto\" style=\"color:transparent\" src=\"https:\/\/www.europesays.com\/people\/wp-content\/uploads\/2026\/05\/https:\/\/media.zenfs.com\/en\/aol_the_independent_us_877\/6a8761116b687b4cf1c68eab6fa74e23.jpeg\"\/><\/p>\n<p>Musk is seeking to have Sam Altman, the CEO of OpenAI, removed from his role (Reuters)<\/p>\n<p>It is not clear if Musk obtained permission or not. If recalled, the tech billionaire may have been required to show up at short notice, and the judge could be \u201cvery aggravated\u201d if they did not give permission in advance, Bellin said.<\/p>\n<p>Musk has yet to respond to reports of the recall requirement.
