CCR a clarificat c\u0103 eliminarea unei liste stricte de cheltuieli din textul legii nu reprezint\u0103 un \u201ecec \u00een alb\u201d pentru manageri, at\u00e2ta timp c\u00e2t sumele r\u0103m\u00e2n plafonate la valoarea a dou\u0103 indemniza\u021bii lunare \u0219i sunt monitorizate riguros de Agen\u021bia pentru Monitorizarea \u0219i Evaluarea Performan\u021belor \u00centreprinderilor Publice.<\/p>\n<p>Sesizarea viza<br \/>\nLegea de aprobare a Ordonan\u021bei de urgen\u021b\u0103 a Guvernului nr. 22\/2025, care<br \/>\nmodific\u0103 \u0219i completeaz\u0103 OUG nr. 109\/2011 privind guvernan\u021ba corporativ\u0103 a<br \/>\n\u00eentreprinderilor publice, precum \u0219i Legea nr. 187\/2023.\u00a0<\/p>\n<p>\u00cen esen\u021b\u0103,<br \/>\njudec\u0103torii au analizat dispozi\u021biile care permit includerea \u00een contractele de<br \/>\nmandat ale administratorilor companiilor publice a unor \u201ealte beneficii\u201d, f\u0103r\u0103<br \/>\na fi necesar\u0103 o enumerare strict\u0103 a acestora, iar la final CCR a decis c\u0103<br \/>\naceast\u0103 formulare nu \u00eencalc\u0103 principiul legalit\u0103\u021bii \u0219i nici celelalte prevederi<br \/>\ninvocate \u00een sesizare, respectiv rolul Parlamentului, procedura de legiferare<br \/>\nsau obliga\u021biile statului privind protejarea intereselor economice.<\/p>\n<p>\t\t\tArgumentele Cur\u021bii<br \/>\nConstitu\u0163ionale<\/p>\n<p>V\u0103 reamintim c\u0103 Nicu\u015for<br \/>\nDan a semnalat, \u00een sesizarea sa, c\u0103 procesul legislativ a \u00eenc\u0103lcat principiul<br \/>\nbicameralismului, deoarece modific\u0103rile adoptate de Senat au fost eliminate de<br \/>\nCamera Deputa\u021bilor, iar unele prevederi introduse de aceasta nu au mai fost<br \/>\ndezb\u0103tute \u00een Senat.<\/p>\n<p>publicitate&#8221;); background-position: center center; background-repeat: no-repeat;&#8221;&gt;<\/p>\n<p>\u00cen acest context, judec\u0103torii<br \/>\nau ar\u0103tat, pe de o parte, c\u0103 modific\u0103rile adoptate de Parlament nu reprezint\u0103 o<br \/>\nabatere de la scopul ini\u021bial al legii \u0219i nu \u00eencalc\u0103 principiul bicameralismului,<br \/>\niar pe de alt\u0103 parte, eliminarea enumer\u0103rii explicite a unor tipuri de<br \/>\nbeneficii a fost considerat\u0103 o op\u021biune legislativ\u0103 care r\u0103m\u00e2ne \u00een cadrul marjei<br \/>\nde reglementare a Parlamentului.<\/p>\n<p>\u201eEliminarea enumer\u0103rii exprese a categoriilor de<br \/>\nbeneficii [&#8230;] nu are semnifica\u021bia unei deturn\u0103ri de la scopul ini\u021bial al<br \/>\nlegii\u201d, se arat\u0103 \u00een comunicatul<br \/>\nCur\u0163ii Constitu\u0163ionale.<\/p>\n<p>\u00cen ceea ce prive\u0219te<br \/>\ncriticile de fond, Curtea a subliniat c\u0103 lipsa unei liste exhaustive \u00a0a termenului \u201ealte beneficii\u201d, nu elimin\u0103<br \/>\ncontrolul asupra cheltuielilor \u0219i nici nu \u00eenl\u0103tur\u0103 limitele financiare<br \/>\nstabilite prin lege.<\/p>\n<p>Astfel, beneficiile<br \/>\nacordate administratorilor r\u0103m\u00e2n plafonate la echivalentul a dou\u0103 indemniza\u021bii<br \/>\nfixe brute lunare, iar tipurile de cheltuieli precum cele de reprezentare,<br \/>\ntransport sau diurn\u0103 pot fi \u00een continuare prev\u0103zute \u00een contractele de mandat.<\/p>\n<p>\u201eEliminarea enumer\u0103rii lor nu semnific\u0103 \u00een mod automat<br \/>\nfaptul c\u0103 aceste cheltuieli sunt excluse de la decontare\u201d, arat\u0103 Curtea.<\/p>\n<p>De asemenea,<br \/>\nAgen\u021bia pentru Monitorizarea \u0219i Evaluarea Performan\u021belor \u00centreprinderilor<br \/>\nPublice r\u0103m\u00e2ne responsabil\u0103 de controlul \u0219i autorizarea acestor cheltuieli, \u00een<br \/>\nlimita plafonului legal stabilit.<\/p>\n<p>\u201eAgen\u021bia va controla \u0219i autoriza \u00een continuare orice<br \/>\ncheltuial\u0103 care se circumscrie \u00een totalul beneficiilor acordate \u00eentr-un an de<br \/>\nmandat\u201d, precizeaz\u0103 CCR.<\/p>\n<p>Decizia este<br \/>\ndefinitiv\u0103 \u0219i general obligatorie, ceea ce \u00eenseamn\u0103 c\u0103 legea \u00ee\u0219i produce<br \/>\nefectele \u00een forma adoptat\u0103 de Parlament.<\/p>\n<p>publicitate&#8221;); background-position: center center; background-repeat: no-repeat;&#8221;&gt;<\/p>\n","protected":false},"excerpt":{"rendered":"Curtea Constitu\u021bional\u0103 a respins \u00een unanimitate sesizarea pre\u0219edintelui Nicu\u0219or Dan privind modific\u0103rile aduse Legii companiilor de stat.
