Mest\u00e1 reaguj\u00fa spr\u00eds\u0148ovan\u00edm regul\u00e1cie, no pod\u013ea prokurat\u00fary t\u00fdm \u010dasto prekra\u010duj\u00fa z\u00e1kon. Predseda parlamentu Richard Ra\u0161i (Hlas) preto zvolal na p\u00f4de N\u00e1rodnej rady SR okr\u00fahly st\u00f4l, ktor\u00fd m\u00e1 rie\u0161i\u0165 zistenia rozsiahlej kontroly Gener\u00e1lnej prokurat\u00fary o syst\u00e9mov\u00fdch chyb\u00e1ch samospr\u00e1v po celom Slovensku.&#13;\n<\/p>\n<p>\t\t\t\t\t \t\t\t\tVallo otvoril parkovac\u00ed dom na Dlh\u00fdch dieloch v bratislavskej Karlovej Vsi \t\t\t<\/p>\n<p>\t \t\t\t Video \t<\/p>\n<p>\t\t\t\t \t\t\t\t\t\t\t\t\t\t\t\t\tZdroj: TASR \t\t\t\t\t\t<\/p>\n<p>Diskusiu otvoril Ra\u0161i spolu so \u0161t\u00e1tnym tajomn\u00edkom ministerstva vn\u00fatra Michalom Kali\u0148\u00e1kom. Okr\u00fahleho stola sa z\u00fa\u010dastnil aj z\u00e1stupca gener\u00e1lnej prokurat\u00fary Peter Mih\u00e1l, ktor\u00fd tlmo\u010dil z\u00e1sadn\u00e9 zistenia kontroly. Potrebu kontroly parkovac\u00edch polit\u00edk vysvetlil slovami, \u017ee \u201eregul\u00e1cia parkovania je z\u00e1sah do pr\u00e1v ob\u010danov\u201c. Gener\u00e1lna prokurat\u00fara zistila nieko\u013eko hlavn\u00fdch probl\u00e9mov:<\/p>\n<p>\tPravidl\u00e1 neboli prijat\u00e9 spr\u00e1vnym sp\u00f4sobom: Mnoh\u00e9 mest\u00e1 nenastavili parkovanie cez v\u0161eobecne z\u00e1v\u00e4zn\u00e9 nariadenie (VZN), ale cez r\u00f4zne intern\u00e9 smernice alebo \u201eparkovacie poriadky\u201c \u010di nepriamo cez dopravn\u00e9 zna\u010dky. Probl\u00e9m je v\u00a0tom, \u017ee tak\u00e9to dokumenty nemaj\u00fa silu miestneho z\u00e1kona. Ak mesto chce \u013eu\u010fom uklada\u0165 povinnosti alebo pokuty, mus\u00ed to ma\u0165 schv\u00e1len\u00e9 riadnym nariaden\u00edm.<br \/>\n\tPokuty na z\u00e1klade sporn\u00fdch pravidiel: V\u00a0niektor\u00fdch pr\u00edpadoch boli vodi\u010di pokutovan\u00ed pod\u013ea pravidiel, ktor\u00e9 neboli pr\u00e1vne spr\u00e1vne nastaven\u00e9. Ak pravidl\u00e1 nemali z\u00e1konn\u00fd z\u00e1klad, sankcie m\u00f4\u017eu by\u0165 nez\u00e1konn\u00e9. To znamen\u00e1, \u017ee niektor\u00e9 pokuty by sa teoreticky museli vraca\u0165. \u201eNiektor\u00e9 obce prijali v\u0161eobecn\u00e9 z\u00e1v\u00e4zn\u00e9 nariadenia, napr\u00edklad z\u00e1kaz zastavenia v\u00a0celej obci, \u010do je a\u017e \u00fasmevn\u00e9, preto\u017ee to znamen\u00e1, \u017ee v\u0161etci, ktor\u00ed sa pres\u00favaj\u00fa v\u00a0motorovom vozidle, musia by\u0165 neust\u00e1le v\u00a0pohybe,\u201c uviedol prokur\u00e1tor po\u010das diskusie.<br \/>\n\tDiskrimina\u010dn\u00e9 podmienky pri parkovac\u00edch kart\u00e1ch: Ur\u010dit\u00e9 mest\u00e1 nastavili podmienky tak, \u017ee zv\u00fdhod\u0148ovali vybran\u00e9 skupiny\u00a0\u2013 napr\u00edklad zamestnancov obce. Inde sa rozli\u0161ovalo medzi vlastn\u00edkmi bytov a apartm\u00e1nov. Pod\u013ea prokurat\u00fary, ak na to nie je jasn\u00fd z\u00e1konn\u00fd d\u00f4vod, ide o\u00a0diskrimin\u00e1ciu. Pod\u013ea Mih\u00e1la sa \u010dastokr\u00e1t v\u00a0podnetoch od ob\u010danov stret\u00e1vaj\u00fa aj s\u00a0agres\u00edvnymi n\u00e1ladami vo\u010di mestsk\u00fdm parkovac\u00edm politik\u00e1m. \u201eKa\u017ed\u00fd chce parkova\u0165 pod oknom a ka\u017ed\u00fd si mysl\u00ed, \u017ee mu patr\u00ed verejn\u00fd priestor,\u201c kon\u0161tatoval prokur\u00e1tor.<br \/>\n\tDigit\u00e1lna diskrimin\u00e1cia: V\u00a0p\u00e1r mest\u00e1ch sa dalo parkovn\u00e9 plati\u0165 iba cez mobiln\u00fa aplik\u00e1ciu. Ak niekto nem\u00e1 smartf\u00f3n alebo nevie pou\u017e\u00edva\u0165 aplik\u00e1cie, prakticky sa nem\u00f4\u017ee zapoji\u0165 do syst\u00e9mu.<br \/>\n\tNeexistuj\u00faca mo\u017enos\u0165 plati\u0165 v\u00a0hotovosti: Viacer\u00e9 samospr\u00e1vy \u00faplne zru\u0161ili mo\u017enos\u0165 plati\u0165 parkovn\u00e9 v\u00a0hotovosti. Prokurat\u00fara upozor\u0148uje, \u017ee pr\u00e1vo plati\u0165 v\u00a0hotovosti mo\u017eno obmedzi\u0165 iba z\u00e1konom\u00a0\u2013 a tak\u00fd z\u00e1kon pri parkovan\u00ed neexistuje.<br \/>\n\tReziden\u010dn\u00e9 parkovanie ako pr\u00e1vna \u201e\u0161ed\u00e1 z\u00f3na\u201c: Slovensk\u00e9 z\u00e1kony presne neupravuj\u00fa, \u010do je reziden\u010dn\u00e9 parkovanie a ak\u00e9 pravidl\u00e1 pri \u0148om m\u00f4\u017eu mest\u00e1 nastavi\u0165. Neexistuje jasn\u00e1 defin\u00edcia ani presn\u00e9 hranice toho, \u010do si samospr\u00e1va m\u00f4\u017ee dovoli\u0165. Mest\u00e1 si preto vytv\u00e1raj\u00fa vlastn\u00e9 syst\u00e9my, podmienky a poplatky. Pr\u00e1ve tu v\u0161ak m\u00e1 vznika\u0165 riziko, \u017ee prekro\u010dia svoje pr\u00e1vomoci alebo nastavia pravidl\u00e1, ktor\u00e9 s\u00fa neprimeran\u00e9 \u010di diskrimina\u010dn\u00e9.<\/p>\n<p>\t<a class=\"promo-clanok\" href=\"https:\/\/ekonomika.pravda.sk\/ludia\/clanok\/786885-garaz-v-bratislave-stoji-tolko-ako-dom-na-strednom-slovensku-z-parkovania-sa-stal-luxus\/\" rel=\"nofollow noopener\" target=\"_blank\"> \t\t\t\t\t<img decoding=\"async\" src=\"https:\/\/www.europesays.com\/sk\/wp-content\/uploads\/2026\/02\/parkovaci-dom-garaz-parkovanie-parkovisko_04-stvorec.jpg\" class=\"promo-clanok-image\" alt=\"SR Tyr\u0161ovo n\u00e1bre\u017eie parkovanie spoplatnenie BAX\"\/> \t\t\t \t\t\t\t \t\t\t\t\t\t\t\t\t\t\t\u010c\u00edtajte viac \t\t\t\t\t\t\t\t\t \t\t\t\t \t\t\t\t\tGar\u00e1\u017e v Bratislave stoj\u00ed to\u013eko, ako dom na strednom Slovensku. Z parkovania sa stal luxusn\u00fd biznis \t\t\t\t \t\t\t \t\t\t<\/a><\/p>\n<p>Kontrola prebehla e\u0161te po\u010das roku 2025. \u201eCelkovo bolo presk\u00faman\u00fdch 577\u00a0v\u0161eobecne z\u00e1v\u00e4zn\u00fdch nariaden\u00ed a in\u00fdch spr\u00e1vnych aktov t\u00fdkaj\u00facich sa regul\u00e1cie parkovania\u00a0\u2013 r\u00f4zne prev\u00e1dzkov\u00e9 poriadky a z\u00e1sady parkovania, pri\u010dom a\u017e v\u00a0460\u00a0pr\u00edpadoch bolo zisten\u00e9 poru\u0161enie z\u00e1kona (\u010do predstavuje a\u017e 80\u00a0% nez\u00e1konn\u00fdch aktov), pri\u010dom na uveden\u00fa nez\u00e1konnos\u0165 bolo reagovan\u00e9 podan\u00edm 372\u00a0protestov a 79\u00a0upozornen\u00ed prokur\u00e1tora,\u201c uv\u00e1dza gener\u00e1lna prokurat\u00fara v\u00a0spr\u00e1ve. Nasledovalo 372\u00a0protestov prokur\u00e1tora a 79\u00a0upozornen\u00ed na poru\u0161enie z\u00e1kona. Len v\u00a0deviatich pr\u00edpadoch samospr\u00e1vy napravili chyby samy, bez z\u00e1sahu. Diskusie sa z\u00fa\u010dastnili aj z\u00e1stupcovia miest a obc\u00ed, predstavitelia Slovenskej parkovacej asoci\u00e1cie, Zdru\u017eenia miest a obc\u00ed Slovenska (ZMOS), \u00danie miest Slovenska (\u00daMS), ako aj \u00daradu komis\u00e1ra pre osoby so zdravotn\u00fdm postihnut\u00edm.<\/p>\n<p>Kto je rezident?<\/p>\n<p>Podpredseda ZMOS a starosta mestskej \u010dasti Ru\u017einov Martin Chren povedal, \u017ee nikto nechce zru\u0161i\u0165 rezidentsk\u00e9 parkovanie, ale \u017ee ho treba upravi\u0165. Tak to povedala aj gener\u00e1lna prokurat\u00fara. \u201eNajlep\u0161ie by bolo prija\u0165 do otvoren\u00e9ho z\u00e1kona o\u00a0cestnej prem\u00e1vke e\u0161te v\u00a0apr\u00edli \u00fapravu rezidentsk\u00e9ho parkovania, a nielen trval\u00e9ho a do\u010dasn\u00e9ho,\u201c mysl\u00ed si\u00a0Chren.<\/p>\n<p>\u201eMesto Vysok\u00e9 Tatry bude potrebova\u0165 rezidenta definova\u0165 inak ako mesto Bratislava. Potrebujeme, aby to bolo \u010do najv\u0161eobecnej\u0161ie,\u201c vysvetlil potrebu defin\u00edcie starosta Ru\u017einova. To, \u010do funguje v\u00a0Bratislave, nemus\u00ed vyhovova\u0165 turistick\u00e9mu mestu, ako s\u00fa Vysok\u00e9 Tatry, preto m\u00e1 by\u0165 pod\u013ea neho defin\u00edcia \u010do najv\u0161eobecnej\u0161ia a prisp\u00f4sobite\u013en\u00e1 miestnym podmienkam.<\/p>\n<p>\t<a class=\"promo-clanok\" href=\"https:\/\/nazory.pravda.sk\/komentare-a-glosy\/clanok\/787386-garaz-nad-zlato\/\" rel=\"nofollow noopener\" target=\"_blank\"> \t\t\t\t\t<img decoding=\"async\" src=\"https:\/\/www.europesays.com\/sk\/wp-content\/uploads\/2026\/02\/iris-kopcsayova-portret-stvorec.jpg\" class=\"promo-clanok-image\" alt=\"Iris Kopcsayova portret\"\/> \t\t\t \t\t\t\t \t\t\t\t\t\t\t\t\t\t\t\u010c\u00edtajte viac \t\t\t\t\t\t\t\t\t \t\t\t\t \t\t\t\t\tGar\u00e1\u017e nad zlato \t\t\t\t \t\t\t \t\t\t<\/a><\/p>\n<p>Dodal, \u017ee ak sa Gener\u00e1lna prokurat\u00fara rozhodne kona\u0165, mohli by pada\u0165 parkovacie politiky vo v\u0161etk\u00fdch mest\u00e1ch a obciach na Slovensku. \u201eChceme, aby t\u00e1 pr\u00e1vna \u00faprava bola \u010do najjednoduch\u0161ia. Ka\u017ed\u00e1 obec a ka\u017ed\u00e9 mesto si ju chce definova\u0165 pod\u013ea seba. Nechceme, aby bola jednotn\u00e1, lebo ani Slovensko nie je \u00faplne jednotn\u00e9. Chceme to tak, aby \u00faprava odkazovala na to, \u017ee si obec \u010di mesto potom uprav\u00ed VZN-kami osobitne,\u201c spresnil.<\/p>\n<p>Z\u00e1stupca ministerstva dopravy Peter Pova\u017ean sa na okr\u00fahlom stole vyjadril, \u017ee si zatia\u013e nevie predstavi\u0165, ako by legislat\u00edvne uchopili pojem rezident. \u201eAsi to vy\u017eaduje hlb\u0161iu anal\u00fdzu. Vieme pris\u013e\u00fabi\u0165 len to, \u017ee sme otvoren\u00ed tejto legislat\u00edvnej \u00faprave, ak to vieme uchopi\u0165 tak, aby to malo hlavu a p\u00e4tu,\u201c deklaroval Pova\u017ean.<\/p>\n<p>Nariadenia verzus dopravn\u00e9 zna\u010denie<\/p>\n<p>Do diskusie sa zapojil aj Martin Birnstein z\u00a0legislat\u00edvneho odboru ministerstva vn\u00fatra, ktor\u00fd v\u00a0reakcii na pripomienky prokurat\u00fary upozornil na z\u00e1v\u00e4znos\u0165 VZN aj v\u00a0pr\u00edpadoch, ke\u010f ch\u00fdba dopravn\u00e9 zna\u010denie. Ak by obec pod\u013ea neho prijala nariadenie a zverejnila ho napr\u00edklad na informa\u010dnej tabuli, bolo by pod\u013ea neho z\u00e1v\u00e4zn\u00e9 aj bez dopravn\u00e9ho zna\u010denia.<\/p>\n<p>Podobn\u00fd poh\u013ead predstavil Peter Pova\u017ean z\u00a0Ministerstva dopravy. \u201eNem\u00f4\u017eeme s\u00fahlasi\u0165 s\u00a0t\u00fdm, \u017ee parkovacia politika by mala by\u0165 ovl\u00e1dan\u00e1 len cez VZN. Prich\u00e1dza stavba, ktor\u00e1 m\u00e1 ukon\u010di\u0165 pravideln\u00e9 rozsiahle kol\u00f3ny a zasiahne tis\u00edce vodi\u010dov \t\t\t\t \t\t\t \t\t\t<\/a><\/p>\n<p>Z\u00e1stupca Gener\u00e1lnej prokurat\u00fary Slovenskej republiky zd\u00f4raznil, \u017ee prokurat\u00fara nie je za ru\u0161enie dopravn\u00e9ho zna\u010denia. \u201eNem\u00e1me probl\u00e9m s\u00a0nepriamou regul\u00e1ciou cez dopravn\u00e9 zna\u010denie,\u201c uviedol. Spresnil v\u0161ak, \u017ee cie\u013eom nie je ru\u0161i\u0165 zna\u010dky ako tak\u00e9, ale napr\u00edklad dodatkov\u00e9 tabu\u013eky s\u00a0ozna\u010den\u00edm \u201erezidenti\u201c pod\u00a0nimi.<\/p>\n<p>Diskusie sa z\u00fa\u010dastnili aj poslanci Marek Lackovi\u010d (PS) a Ondrej Dost\u00e1l (SaS), ktor\u00ed aj vyst\u00fapili v\u00a0diskusii. Dost\u00e1l uviedol, \u017ee n\u00e1vrh z\u00e1kona o\u00a0cestnej prem\u00e1vke by mal \u00eds\u0165 do druh\u00e9ho \u010d\u00edtania na apr\u00edlovej sch\u00f4dzi a do tretieho \u010d\u00edtania pravdepodobne v\u00a0m\u00e1ji alebo j\u00fani. Pod\u013ea neho ide o\u00a0zlo\u017eitej\u0161iu t\u00e9mu a je ot\u00e1zne, \u201e\u010di to viac s\u00fari\u0165, alebo \u010di by bolo lep\u0161ie \u00eds\u0165 \u0161tandardnou legislat\u00edvnou cestou\u201c.
