{"id":34666,"date":"2026-06-04T13:44:23","date_gmt":"2026-06-04T13:44:23","guid":{"rendered":"https:\/\/www.europesays.com\/spain\/34666\/"},"modified":"2026-06-04T13:44:23","modified_gmt":"2026-06-04T13:44:23","slug":"spain-under-pressure-to-change-tax-rules-for-non-resident-property-owners","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/spain\/34666\/","title":{"rendered":"Spain under pressure to change tax rules for non-resident property owners"},"content":{"rendered":"<p>The European Commission has stepped up pressure on <a href=\"https:\/\/www.majorcadailybulletin.com\/tag\/Spain.html?utm_source=Inline-tag&amp;utm_medium=internal\" rel=\"nofollow noopener\" target=\"_blank\">Spain<\/a> over what it says is discriminatory tax treatment of foreign property owners who earn rental income from homes in the country.<\/p>\n<p>In a statement issued on Thursday, <a href=\"https:\/\/www.majorcadailybulletin.com\/tag\/Brussels.html?utm_source=Inline-tag&amp;utm_medium=internal\" rel=\"nofollow noopener\" target=\"_blank\">Brussels<\/a> confirmed it has sent Spain a further formal notice after concluding that changes made by the government have failed to address concerns first raised in 2019.<\/p>\n<p>Under current rules, Spanish tax residents can benefit from reductions of up to 60% on the taxable income they receive from renting out properties. However, the Commission says those tax breaks are not available to non-residents, creating an unequal system that may breach EU rules on the free movement of capital.<\/p>\n<p>Despite years of discussions with Spanish authorities, the Commission said Spain has not amended its legislation sufficiently to remove the discriminatory treatment and has instead introduced additional features to the tax regime.<\/p>\n<p>Brussels has now launched the next stage of infringement proceedings, requiring Spain to respond and explain how it intends to address the issues identified by the Commission.<\/p>\n<p>The dispute is one of several ongoing cases involving Spain&#8217;s treatment of non-resident taxpayers.<\/p>\n<p>The Commission is also examining Spain&#8217;s imputed income tax on properties owned by non-residents, a charge based on the cadastral value of a home that does not apply to Spanish residents.<\/p>\n<p>In a separate case, Brussels has referred Spain to the Court of Justice of the European Union over rules governing capital gains tax.
