Schneider with multiple felony charges and 40-year-old Nicole C. Valencia with one count of child abuse after New Mexico State Police responded May 8 to a request for a welfare check on three children, ages 13, 12 and 7. One child told NMSP officers that their parents were using narcotics and selling cocaine and crack cocaine from the home, according to an arrest affidavit filed in San Miguel Magistrate Court.<\/p>\n<p class=\"p1\">Arriving officers found \u201cpoor living conditions\u201d in the home that had no electricity and spoiled food in the refrigerator, the affidavit stated. Valencia admitted to police that she used crack cocaine, and police contacted the Children, Youth, and Families Department, who removed the children from the home.<\/p>\n<p class=\"p1\">Investigators spoke to the children, and one said that Schneider often threw Valencia to the ground, punched her, choked her and that he pulled her hair, according to the affidavit. One of the children said that, on at least one occasion, Schneider climbed over them to strike Valencia, and one child said that they\u2019d once seen Schneider pull Valencia\u2019s hair to \u201cforce her into the car,\u201d and that afterward, Schneider had a \u201cbig chunk\u201d of her hair in his hand.<\/p>\n<p class=\"p1\">Another child told investigators they\u2019d seen Schneider strike Valencia multiple times, and that on one occasion, Schneider chased her into a bathroom and began choking her, the affidavit stated. The child further described another incident where Schneider pointed a gun at Valencia, and they said that a relative of Valencia had witnessed the incident.<\/p>\n<p class=\"p1\">\u00a0That woman confirmed to investigators that it happened and said that when she told Schneider to stop, he pointed the gun at her head instead, the affidavit stated. The woman said she pushed the gun away, but Schneider pointed it at her a second time. On a separate occasion, the woman said Schneider shoved her into a wall hard enough to cause bruising on her back.<\/p>\n<p class=\"p1\">When an investigator asked one of the children if they knew what crack or cocaine was, the child said they did because Schneider and Valencia sold it and that Valencia had shown it to them and explained what it was, according to the affidavit. The child also said they\u2019d been in a car with Schneider and Valencia while they sold crack.<\/p>\n<p class=\"p1\">Valencia is charged with one felony count of child abuse. Schneider is charged with three felony child abuse counts and one count of felony aggravated assault with a deadly weapon. He has a lengthy criminal history in New Mexico, including convictions for trafficking controlled substances,\u00a0 possession of a controlled substance and resisting arrest.<\/p>\n<p class=\"p1\">Following the NMSP investigation, Valencia and Schneider were both arrested on May 28 and booked into the San Miguel County Detention Center.<\/p>\n<p class=\"p1\">During a May 29 hearing, Judge Philip Leger set an unsecured $10,000 bond for Valencia and she was released ahead of trial.<\/p>\n<p class=\"p1\">Judge Leger initially set bond for Schneider at $25,000, citing an \u201cextensive criminal history\u201d and that he\u2019s previously failed to appear for court hearings on at least five occasions.
