The President of the Constitutional Court of the Republic of
\nT\u00fcrkiye, Kadir \u00d6zkaya, received a delegation from the
\nConstitutional Court of Spain on a working visit to T\u00fcrkiye.
\nFollowing the meetings, a cooperation agreement was signed between
\nthe two constitutional courts. The visiting delegation, which held
\na series of high-level engagements in T\u00fcrkiye, was also received by
\nPresident Recep Tayyip Erdo\u011fan.<\/p>\n
The Spanish delegation, headed by Vice President Inmaculada
\nMontalb\u00e1n Huertas, visited T\u00fcrkiye on 15\u201316 June 2026 within the
\nframework of a mutual understanding reached during the Turkish
\nConstitutional Court\u2019s working visit to Spain in February 2026,
\nwhich envisaged the continuation of reciprocal exchanges.<\/p>\n
President Kadir \u00d6zkaya first met Vice President Huertas and her
\ndelegation in his office. This was followed by inter-delegation
\ntalks. The meetings were attended by Turkish Constitutional Court
\nVice Presidents Basri Ba\u011fc\u0131 and \u0130rfan Fidan, as well as judges
\nEngin Y\u0131ld\u0131r\u0131m, Recai Akyel, Y\u0131ld\u0131z Seferino\u011flu, Selahaddin Mente\u015f,
\nY\u0131lmaz Ak\u00e7il, \u00d6mer \u00c7\u0131nar, Metin K\u0131ratl\u0131, and Secretary-General
\nMurat Azakl\u0131. Discussions focused on potential areas of
\ncooperation, best practice examples, and the exchange of
\ninstitutional experience.<\/p>\n
In his remarks, \u00d6zkaya expressed satisfaction with the growing
\nstrength of relations between the two courts in recent years,
\nstating that this cooperation reflects the deep-rooted friendship
\nand partnership between T\u00fcrkiye and Spain in the field of
\nconstitutional justice. He emphasized that joint efforts within the
\nframework of the World Conference on Constitutional Justice and the
\nConference of European Constitutional Courts, guided by shared
\nvalues and objectives, have played an important role in
\nstrengthening institutional ties.<\/p>\n
Recalling that T\u00fcrkiye introduced its individual application
\nmechanism in 2012, \u00d6zkaya noted that European experiences were
\nexamined during its establishment, with Spain\u2019s constitutional
\ncomplaint system serving as one of the key reference models. He
\nstressed that over time, the individual application system has
\nbecome a fundamental component of the Turkish constitutional order,
\nsignificantly contributing to the protection of fundamental rights
\nand freedoms and the strengthening of the rule of law.<\/p>\n
Highlighting that T\u00fcrkiye and Spain share common values under
\nthe European Convention on Human Rights framework, \u00d6zkaya stated:
\n\u201cOur shared commitments to protecting human dignity, safeguarding
\nfundamental rights and freedoms, and strengthening the rule of law
\ncontinue unabated. In this regard, the jurisprudence of the
\nEuropean Court of Human Rights (ECtHR) has had a decisive influence
\non both Turkish and Spanish legal systems. Our constitutional
\ncourts serve as a bridge between the ECtHR and national legal
\norders. The use of ECtHR principles in interpreting and applying
\nconstitutional guarantees related to fundamental rights makes a
\nmeaningful contribution to the strengthening of a common European
\nlegal space.\u201d<\/p>\n
\u00d6zkaya further described the Spanish Constitutional Court as one
\nof the most respected institutions of constitutional adjudication,
\nnoting its internationally recognized contribution to human rights
\nprotection, the rule of law, and the development of democratic
\nconstitutional order.<\/p>\n
Referring to current global challenges, \u00d6zkaya emphasized that
\nwars, conflicts, and humanitarian crises once again highlight the
\nimportance of protecting human rights. He stated: \u201cIn particular,
\nin the face of the severe humanitarian tragedy currently unfolding
\nin Palestine, it is of great importance that strong emphasis is
\nplaced on international law, human rights, and the protection of
\ncivilians. In this context, we closely follow and appreciate
\nSpain\u2019s and Spanish legal circles\u2019 sensitivity toward the
\nprotection of international law and human rights. Every effort to
\ndefend universal legal values contributes to building a more just
\nand peaceful world.\u201d<\/p>\n
Drawing attention to contemporary issues such as digital
\ntransformation, artificial intelligence technologies, personal data
\nprotection, freedom of expression, and environmental rights, \u00d6zkaya
\nunderlined that these developments have made cooperation between
\nconstitutional courts more important than ever. Referring to the
\nnewly signed agreement, he said:<\/p>\n
\u201cWe regard this cooperation agreement not only as a document
\naimed at enhancing institutional collaboration between our two
\ncourts, but also as a strong expression of our shared commitment to
\ndemocracy, human rights, the rule of law, and the ideal of
\nuniversal justice. I believe this agreement will enhance the
\nexchange of knowledge and experience, encourage joint scientific
\nand academic work, strengthen professional relations between our
\njudges and rapporteurs, and further deepen the friendship between
\nour institutions.\u201d<\/p>\n
Vice President Inmaculada Montalb\u00e1n Huertas expressed her
\nsatisfaction at being in T\u00fcrkiye, thanking the Constitutional Court
\nfor its hospitality. She noted that reciprocal visits between the
\ntwo constitutional courts would further strengthen existing ties
\nand friendly relations. She emphasized that such exchanges provide
\nvaluable opportunities for sharing experience and significantly
\ncontribute to the development of constitutional justice.<\/p>\n
Huertas also underlined that the friendly relations between
\nT\u00fcrkiye and Spain positively influence judicial dialogue and
\ncooperation. She expressed confidence that the cooperation
\nagreement would elevate institutional relations to a higher level,
\nadding that maintaining constructive dialogue with the Turkish
\nConstitutional Court is a priority. She concluded by expressing
\nhope that strong ties between the two countries would continue
\nthrough joint projects and reciprocal visits.<\/p>\n
Following the talks, technical working sessions were held
\nfocusing on the exchange of knowledge and experience. In sessions
\ntitled \u201cConstitutional Complaint Mechanism\u201d and \u201cConstitutional
\nJurisdictional Conflicts and Resolution Procedures,\u201d presentations
\nwere delivered by Vice President Basri Ba\u011fc\u0131, Judge Engin Y\u0131ld\u0131r\u0131m,
\nand Spanish Constitutional Court members Mar\u00eda Luisa Segoviano
\nAstaburuaga and Jos\u00e9 Mar\u00eda Mac\u00edas Casta\u00f1o.<\/p>\n
During the visit, a bilateral cooperation agreement was signed
\nwith the aim of enhancing cooperation and dialogue between the two
\nconstitutional courts and promoting the exchange of knowledge and
\nexperience.<\/p>\n
\u00d6zkaya described the agreement as a natural outcome of the
\nconstructive dialogue initiated in Madrid in February 2026 and as a
\nnew phase in institutional relations, stressing its value in
\nstrengthening the fundamental principles of constitutional justice.
\nVice President Huertas also expressed her belief that the agreement
\nwould reinforce cooperation between the courts and contribute
\nsignificantly to the protection of the rule of law and fundamental
\nrights and freedoms.<\/p>\n
President Recep Tayyip Erdo\u011fan received Vice President
\nInmaculada Montalb\u00e1n Huertas and the accompanying delegation at the
\nPresidential Complex in Ankara, upon invitation from the Turkish
\nConstitutional Court. President \u00d6zkaya was also present at the
\nmeeting.<\/p>\n
The Spanish Constitutional Court delegation also met separately
\nwith the President of the Court of Cassation of T\u00fcrkiye (Yarg\u0131tay),
\n\u00d6mer Kerkez, and the President of the Council of State of T\u00fcrkiye
