{"id":71644,"date":"2026-08-17T13:07:08","date_gmt":"2026-08-17T13:07:08","guid":{"rendered":"https:\/\/www.europesays.com\/spain\/71644\/"},"modified":"2026-08-17T13:07:08","modified_gmt":"2026-08-17T13:07:08","slug":"ceuta-threatens-legal-action-over-migrant-crisis-pitting-italy-against-spain","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/spain\/71644\/","title":{"rendered":"Ceuta threatens legal action over migrant crisis pitting Italy against Spain"},"content":{"rendered":"<p class=\"defaultstyled__StyledText-sc-11u52t4-1 eVvrYS margin-lg-bottom\" id=\"el-0-GX7ZQSGPPVHW3PWA33MOX3MS5M\">The <a href=\"https:\/\/www.thenationalnews.com\/tags\/spanish\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.thenationalnews.com\/tags\/spanish\">Spanish<\/a> government has 30 days to resolve the migrant crisis in <a href=\"https:\/\/www.thenationalnews.com\/news\/europe\/2026\/08\/06\/ceuta-seeks-transfer-of-more-than-1000-child-migrants-to-mainland-spain\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.thenationalnews.com\/news\/europe\/2026\/08\/06\/ceuta-seeks-transfer-of-more-than-1000-child-migrants-to-mainland-spain\/\">Ceuta<\/a> or face the courts, the city&#8217;s mayor-president has warned, after new attempts to reach the exclave were thwarted at the weekend.<\/p>\n<p class=\"defaultstyled__StyledText-sc-11u52t4-1 eVvrYS margin-lg-bottom\" id=\"el-1-ZIR3FGMS2NAJLH5GRGSLAQOKHU\">Juan Jesus Viva escalated his rhetoric on Monday after hundreds of migrants still in Ceuta staged a protest on the beach urging Spanish authorities to grant them asylum instead of sending them back to <a href=\"https:\/\/www.thenationalnews.com\/tags\/morocco\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.thenationalnews.com\/tags\/morocco\">Morocco<\/a>.<\/p>\n<p class=\"defaultstyled__StyledText-sc-11u52t4-1 eVvrYS margin-lg-bottom\" id=\"el-3-CEG4VM3DZZAAPEIEEGRGLDPBKU\">An estimated 5,000 to 8,000 migrants are still in the North African exclave after a mass border crossing two weeks ago. Hundreds of these migrants staged a protest on \u200ba \u200bpopular urban beach on Sunday, \u200burging Spanish authorities to grant them asylum instead of sending \u2060them back to Morocco. <\/p>\n<p class=\"defaultstyled__StyledText-sc-11u52t4-1 eVvrYS margin-lg-bottom\" id=\"el-5-D3O36HL7XZHGPPJNRB5V2UANHM\">The protesters held up Spanish \u200bflags and \u2060banners reading \u201cWe don&#8217;t want to go back \u200cto Morocco\u201d and \u201cWe are also human\u201d, while chanting slogans such as \u201cWe&#8217;re tired\u201d and \u201cWe need a solution\u201d.<\/p>\n<p class=\"defaultstyled__StyledText-sc-11u52t4-1 eVvrYS margin-lg-bottom\" id=\"el-7-L7UGMUWQHNF7JGBKZBZWL4OBLA\">Mr Viva accused the government of \u201calmost total inaction\u201d over the crisis and said he would take the issue to Spanish courts. \u201cMy intention is to explain the situation to the president of the Supreme Tribunal and the president of the Constitutional Court, if they will accept me. Judicial powers are the cornerstone of the state. Ceuta is living in exceptional times,\u201d he said at an extraordinary meeting of the governing council.<\/p>\n<p class=\"defaultstyled__StyledText-sc-11u52t4-1 eVvrYS margin-lg-bottom\" id=\"el-8-NTW4DHK3CZARFON4QS3JOLXLQE\">During the mass border crossing two weeks ago, more than 72,000 people entered the territory, which has a population of about 80,000. The vast majority returned either through deportation or voluntarily in the following days. <\/p>\n<p class=\"defaultstyled__StyledText-sc-11u52t4-1 eVvrYS margin-lg-bottom\" id=\"el-9-KPK3DI2ZDFFWXCFGJA7DBQC6MY\">The crisis triggered a diplomatic <a href=\"https:\/\/www.thenationalnews.com\/news\/europe\/2026\/08\/10\/is-free-movement-in-europe-threatened-by-ceuta-crisis\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.thenationalnews.com\/news\/europe\/2026\/08\/10\/is-free-movement-in-europe-threatened-by-ceuta-crisis\/\">stand-off<\/a> with Italy and other European countries, with Rome introducing additional passport checks for Spanish citizens, putting strain on the border-free movement normally afforded to EU citizens. Spain introduced reciprocal checks in retaliation.<\/p>\n<p class=\"defaultstyled__StyledText-sc-11u52t4-1 eVvrYS margin-lg-bottom\" id=\"el-10-SJATULRCIBHXTILKKUV22V7JHM\">The Italian government said on Monday that it was waiting for its intelligence agency&#8217;s report on the crisis before lifting the ban. There had been suggestions last week that it could be lifted if a second incursion planned for August 15 failed to materialise.<\/p>\n<p>Forewarned<\/p>\n<p class=\"defaultstyled__StyledText-sc-11u52t4-1 eVvrYS margin-lg-bottom\" id=\"el-13-HBI7YAZEPNHE7P5KKFT6Z4MFJU\">Border workers say they warned Spain&#8217;s central government that more people, spurred on \u2060by social media, were arriving by sea, adding they feared an escalation. But the government did not heed their warnings and took little action, \u2060they said.<\/p>\n<p class=\"defaultstyled__StyledText-sc-11u52t4-1 eVvrYS margin-lg-bottom\" id=\"el-14-3O33UPW2XRFZFJIZ5NJ6EH5TVM\">A Spanish court ruling published on June 29 stated that migrants could only be immediately pushed back from \u200bentering Ceuta if they crossed a physical barrier, specifying that this would not apply to anyone swimming to the exclave. News of this ruling and videos of migrants successfully entering Ceuta encouraged more and more to try their luck.<\/p>\n<p class=\"defaultstyled__StyledText-sc-11u52t4-1 eVvrYS margin-lg-bottom\" id=\"el-15-AKHIDSMHU5DOVALBD3A2AWJ7C4\">Spain&#8217;s government initially blamed the \u2060rush of July 29-30 on misinformation about the ruling spread by criminal networks. Spanish authorities say 80 people died in the rush and Moroccan authorities said 14 bodies were recovered in their territory, putting the number of confirmed deaths at 94. Human rights groups say more remain missing, and that \u2060the death toll could be higher.<\/p>\n<p>Social media<\/p>\n<p class=\"defaultstyled__StyledText-sc-11u52t4-1 eVvrYS margin-lg-bottom\" id=\"el-18-DEG4TJEXDNHHZLMS737M2FCGKA\">Concerns persist over online disinformation campaigns. False posts were shared on WhatsApp and Facebook promoting the claim that Spain would open its border on August 15, a national holiday marking the Catholic festival of the Assumption of Mary.<\/p>\n<p class=\"defaultstyled__StyledText-sc-11u52t4-1 eVvrYS margin-lg-bottom\" id=\"el-19-Z2VTU56VR5CONCD37MO4QCE7D4\">The calls spread, with hundreds of sub-Saharan African migrants gathered in the border town of Fnideq. But they were pushed back using tear gas by Moroccan security forces, who had been deployed in the border area since July. State media reported that 111 were arrested.<\/p>\n<p class=\"defaultstyled__StyledText-sc-11u52t4-1 eVvrYS margin-lg-bottom\" id=\"el-20-SIOXZBXWS5E3PJP2KUIJNDTNRU\">The EU has contacted social media giants regarding Ceuta, according to Henna Virkkunen, executive VP for tech sovereignty, security and democracy of the European Commission.<\/p>\n<p class=\"defaultstyled__StyledText-sc-11u52t4-1 eVvrYS margin-lg-bottom\" id=\"el-21-VXKQXZCFCBCXJAHSW3G3ARNRMU\">\u201cWe met again with Meta and TikTok to advance our co-operation on the Ceuta situation.
