Germany’s
Visa

Germany’s new Freelance Visa presents an exciting opportunity for Indian professionals and creatives seeking to work independently in Europe. By offering a pathway for non-EU citizens to live and work without the constraints of employer sponsorship, this visa allows individuals to pursue their careers with greater autonomy and flexibility. With eligibility criteria designed to ensure financial stability and professional demand, the Freelance Visa is a game-changer for Indian workers, providing them the freedom to build successful, self-directed careers in Germany’s thriving economy.

This visa grants individuals the freedom to work autonomously, without the obligation to be associated with a particular employer.

In a positive development for Indian professionals and creatives, Germany has launched the Freelance Visa, formally known as the Freiberufler Visa. This new visa enables non-European Union (EU) nationals to live and work independently in Germany for up to a year or more, according to a report by Firstpost.

What is the German Freelance Visa?

The Freelance Visa offers individuals the opportunity to work for themselves without the need for a specific employer. It is designed for professionals in various liberal fields, offering both flexibility and independence compared to other visa types.

Applicants must show proof of professional skill and the ability to support themselves financially. Unlike a tourist visa, which restricts employment, or a standard work visa that demands employer sponsorship, the Freelance Visa offers individuals the freedom to work independently.

This visa is tailored for a variety of professions, including:

  • Artists, musicians, and teachers
  • Journalists and photographers
  • Engineers, architects, and IT consultants
  • Lawyers, interpreters, tax advisors, and notaries
  • Doctors, dentists, and therapists
  • Business consultants and economists

A full list of qualifying professions, recognized under Section 18 of Germany’s Income Tax Act, is provided by the German Missions in India.

Eligibility and Required Documents

To qualify for this visa, applicants must demonstrate that their services are in demand in Germany and prove their financial self-sufficiency. Below are the key requirements:

  • A valid passport (issued in the last 10 years)
  • Proof of freelance work and educational qualifications
  • Evidence of financial stability, with a monthly income of at least €1,280 (approximately Rs 1.27 lakh)
  • A business plan and CV
  • Contracts or letters of agreement from clients based in Germany or Europe.
  • Valid health insurance
  • Proof of accommodation in Germany
  • For those above 45 years old: proof of retirement planning
  • Payment of a €75 visa fee (roughly Rs 7,500)

How Can Indian Citizens Apply?

Indian nationals must first apply for a National D Visa before entering Germany. The process is as follows:

  1. Complete the National D Visa application form.
  2. Schedule an appointment at the nearest German consulate (e.g., German Embassy or Missions in India).
  3. Submit the application in person, including biometric data.
  4. Upon approval, the visa will be valid for 3-6 months.
  5. Upon arrival in Germany, complete your address registration and submit an application for a long-term freelance residence permit at the local Foreigners’ Office.

Two Types of Self-Employed Visas

  1. Freelancer (Freiberufler): For those providing professional services independently.
  2. Self-employed (Selbständiger): For individuals running a business or holding a trade license.

The Freiberufler Visa is specifically designed for individuals who wish to work independently and provide professional services on a freelance basis. This visa does not allow holders to seek employment with a German company, meaning that if you intend to work as an employee rather than as a self-employed professional, you will not be permitted to do so under this visa category. The primary purpose of the Freiberufler Visa is to support those who offer specialized services on a freelance basis, such as artists, consultants, or IT professionals.

For those looking to take up employment with a German employer, the Freiberufler Visa is not sufficient. In such cases, it is necessary to apply for a separate work visa tailored to the needs of employees. This work visa would grant the right to be employed by a German company and carry the specific conditions and requirements set forth for employment-based residency in Germany. It is crucial to understand these distinctions to ensure you apply for the correct visa that aligns with your intended work arrangements.
