Craig Inglis, 37, struck Gerard Paterson, 43, on the head with a vape in Glasgow’s Whiteinch on August 1, 2024.
Sound engineer Mr Paterson told Glasgow Sheriff Court that he had bought breakfast from a food van that morning.
He stated that as he walked back to his car, he was attacked from behind by Inglis, of Clydebank, with an object.
Mr Paterson told the court that he fell to the ground and may have hit his eyebrow off the back of his vehicle.
The victim stated that floor fitter Inglis was “angry” and shouted at him.
Mr Paterson staggered away with a ripped t-shirt before he went back to the food van to get tissues to clean the blood.
A colleague collected Mr Paterson and took him to hospital where he was found to have suffered a wound to the side of his head.
When prosecutor Caitlin McAlister asked about his injury, Mr Paterson said it was “half-moon shaped” and was closed with glue.
Mr Paterson then touched his head to say that he could still feel the wound.
The court was shown hospital pictures taken by Mr Paterson of his bloodied head.
Inglis told the court in his evidence that he acted in self-defence and that Mr Paterson was the aggressor.
Inglis said: “I approached him and he punched me on the face. I got away as quick as possible.”
Miss McAllister asked why he did not walk away after being punched and he replied: “I had to defend myself.”
Inglis also claimed that he was hit with a bottle of Irn Bru and his top was also ripped.
The court heard that Inglis handed himself into police at midnight.
Inglis told officers in reply to caution and charge: “He had an affair with my wife.”
Witness Stuart Elder earlier stated to the court that he saw Inglis “hovering about” and approached Mr Paterson.
Miss McAlister stated in her closing speech: “Mr Elder said that it was a vape that Inglis struck Mr Paterson with – he was seen behind the victim.”
Inglis was found guilty of assaulting Mr Paterson to his severe injury.
When convicting him, Sheriff Tony Kelly said: “It is clear that something did happen.
“All the witnesses gave accounts that Mr Paterson was assaulted.
“In my view, an assault was perpetrated by Mr Inglis which was not excused or justified on the basis of acting in self-defence and I find you guilty.”
