A second man has been charged with murder after a dad died following a Birmingham house fire.

Daniel Gardner died following the blaze at a property in Saxons Way in Highters Heath last Friday (September 19) shortly after 1am.

Six ambulance service crews attended the scene and gave the 37-year-old advanced life support.

He was then taken to hospital under emergency conditions but sadly died a short while after arriving at hospital.

Now Tyler Phythian, aged 18, of Cherrywood Road in Bordesley Green has been charged with murder.

He is set to appear at Birmingham Magistrates’ Court on Tuesday (September 23) morning.

Stephen Dale, 47, also of Cherrywood Road in Bordesley Green was charged with murder on Sunday (September 21) and appeared before city magistrates on Monday.

Earlier Daniel’s family paid tribute to a ‘devoted son, daddy, brother, and nephew’.

In a tribute they said: “Words cannot describe the unbearable pain and devastation we all feel.

“You gave everything and never expected anything in return.

“Gives me comfort that you are with Nan & Grandad now who will once again look after you for me.

“My heart will always be broken but I hope I can find the strength to carry on without you.

“All my love is with you Dan. Miss you every minute of the day. Mum & Nick Ryan & Liv Elliot & Charlie Lynn & Phi.”

A spokesperson for West Midlands Police said: “We were called alongside fire and ambulance colleagues to the property on Saxons Way, Highters Heath, shortly before 1.10am on 19 September.

“Daniel, aged 37, was found seriously injured and taken to hospital for treatment but tragically died a short time later.

“Our thoughts remain with Daniel’s family at this tragic time and we continue to offer them our full support as our investigation continues.

“We are still asking anyone with information or footage which could help our enquiries to call us on 101, quoting log 174 of 19 September.
