Nearly unbeatable on the race track in 2025 with eight IndyCar victories including the 109th Indianapolis 500, Alex Palou is hoping that success continues in the courtroom in the United Kingdom in a court case involving McLaren Racing.

A trial nearly three years in the making began this week in London. It involves McLaren Racing and four-time NTT IndyCar Series Champion Alex Palou over damages from a breach of contract in 2023.

Palou arrived at the Commercial Court in London on Monday, September 29 for the start of the breach-of-contract trial.

McLaren’s Lawsuit

McLaren is seeking $30 million in damages against the driver from Spain from a 2022 contract that Palou signed to drive for the Arrow McLaren IndyCar team. That contract was announced within hours of Chip Ganassi Racing announced Palou was remaining with the IndyCar team when CGR picked up the option year in 2023.

Although that dispute was settled in mediation in the United States, Palou’s McLaren contract was changed so that he would join the team in 2024. Also, Ganassi allowed him to be the Formula 1 reserve driver that year.

But Palou changed his mind in August 2023 as he was well on the way to his second IndyCar Series Championship. He decided to remain with Ganassi and informed McLaren he would not be joining the team in 2024.

Palou’s reasoning was there was no clear path to a ride in Formula 1 with McLaren because it also signed Oscar Piastri to join Lando Norris on the fabled team.

Those two drivers have elevated McLaren to Formula One’s best team and are battling each other for this year’s Formula 1 World Championship.

After informing McLaren he would not be joining the team in 2024, Palou signed a multi-year extension running from 2024 to 2026 with team owner Chip Ganassi in IndyCar.

Since that time, Palou and Ganassi have been the most formidable combination in IndyCar. Palou has won four NTT IndyCar Series Championships in the past five seasons, including the last three championships in a row.

Alex Palou Explains Why He Didn’t Join McLaren

I spent the day with Palou on September 18 in Tryon, North Carolina while he was working with sculptor William Behrends for Palou’s face on the Borg-Warner Trophy for winning the 109th Indianapolis 500 on May 25.

Palou would not speak on the record about the lawsuit but admitted he is prepared to see the legal dispute come to a resolution, hopefully by the end of 2025.

Palou clinched the 2025 NTT IndyCar Series Championship at Portland, Oregon on August 10. I asked Palou afterwards if his incredible streak of success in 2025, including eight wins in the 2025 season, could have been accomplished at Arrow McLaren.

“Absolutely, not,” Palou told me. “The team that I have behind me at Chip Ganassi Racing, it’s incredible. The ability they have to keep on working, keep on pushing the limits, it’s insane. And I know I wouldn’t be here without the team that I have behind me.”

I also asked Palou about his expensive legal lesson and how staying with Chip Ganassi Racing is an investment in that ongoing success.

“It’s something that if I could go back, I would change it,” Palou told me. “But the truth is that I cannot go back and change it. So, we just need to live with it.

“And the best way to say sorry to everybody at CGR is by winning races for them and championships.

“So, what’s left for us? More wins, more championships. That’s what we’re chasing. We know that we’re capable of doing it, and I cannot wait.”

McLaren’s Legal Stance

The lawsuit was filed in August of 2023 in the United Kingdom, between by McLaren Indy LLC and McLaren Racing LTD against ALPA Racing LLC, Mr. Alex Palou Montalbo, and Palou Motorsport SL.

According to Racer, it should bring an end to the matter at some point in the coming weeks or months.

The trial has moved to civil court after efforts to negotiate a settlement with McLaren were unsuccessful. The trial will be held in front of a judge who will hear McLaren’s complaint against Palou, which seeks a settlement approaching $30 million.

Palou’s legal team is contesting that huge figure.

McLaren would also pay for the use of his ‘name, fame, reputation, and likeness’ through a separate promotion agreement.

In January 2023, McLaren paid Palou $400,000 as a signing bonus. But Piastri joined McLaren’s Formula 1 team in 2023 after winning the Formula 2 championship.

Palou won the 2023 IndyCar Championship and Piastri was ninth in the world championship as a rookie with McLaren.

By August 2023, Palou’s lawyers informed McLaren by letter that Palou would not be joining McLaren. A few days later, McLaren sued Palou for breach of contract.

McLaren is seeking compensation from Palou for financial losses from the driver’s failure to honor the original contract. That includes loss of sponsor revenue, reduced manufacturer payments, and increased salary for Arrow McLaren driver Pato O’Ward.

Palou’s legal team is disputing the valuations filed by McLaren and hopes to have any judgement against Palou reduced.

According to Racer, veteran driver manager Julian Jokobi and Brian Marks will speak as “IndyCar Experts.” Former F1 team principals Otmar Szafnauer and Claire Williams, will serve the role as “F1 Experts.”

When To Expect A Resolution

The first week of the trial will see both camps present the judge with all relevant information to consider on their behalf.

The first week of trial began on Monday, September 29. A second week is scheduled for next week when the solicitors for McLaren and Palou will call their respective experts to present testimony and statements.

The judge has to step away on the third week to work on pre-existing cases but is expected to return later this month.

McLaren and Palou are close to finally having this dispute settled, but much has to happen before reaching the finish line.
