Somers Forge Ltd will appear at Walsall Magistrates Court on February 17 next year charged with failing to discharge its general heath, safety and welfare duty to an employee.
The case comes after a man died after sustaining injuries at the firm on Prospect Road on Friday December 8, 2023.
The man was taken to the QE hospital, but nothing could be done to save him.
Court documents state that on or around December 8, 2023 being an employer, the firm failed to ensure, so far as was reasonably practicable, the health, safety and welfare at work of all its employees in that it failed to ensure operatives did not use handheld emery cloth while operating the Morando (3PRZ) 110 Lathe contrary to the Health and Safety at Work Act 1974.
The case, which is brought by the Health and Safety Executive, was heard at Birmingham Magistrates’ Court on October 6 and was adjourned to February 17.
At the time of the incident the firm issued a statement saying: “On the evening of Friday 8th December one of our employees tragically lost his life whilst at work at Somers Forge.
“Our thoughts are with the family and friends of our late colleague – our hearts go out to them.
“We make no further comment at this stage other than to say that we take our responsibilities for the safety and welfare of our colleagues very seriously and are cooperating fully with the authorities as they carry out their enquiries into this tragic incident.”
The firm did not want to comment on the court case.
The HSE said it would comment when the court proceedings are concluded.
