The Supreme Court has released its judgment in a case related to women’s inheritance rights. The seven-page decision was authored by Justice Athar Minallah before his resignation.
According to the ruling, petitioner Abid Hussain has been fined Rs. 500,000 for delaying the transfer of inheritance to rightful heirs.
The court upheld the Sindh High Court’s earlier decision, which had dismissed his appeal. The fine must be deposited with the Supreme Court Registrar within seven days and will be distributed among the heirs.
The written judgment states that Abid Hussain failed to prove his claim that the property in question had been gifted to him.
The court emphasized that inheritance is a divine right and depriving women of their share violates both the Constitution and clear Islamic teachings. It added that property ownership automatically transfers to heirs immediately after the owner’s death.
The verdict further noted that the state is responsible for ensuring that women receive their inheritance without delays, fear, or lengthy legal battles, and that anyone who blocks rightful inheritance must be held accountable under the law.
