To this end, the nurse, who has worked for NHS Fife for nearly 30 years, is already pursuing a claim of discrimination and harassment against the board and her colleague, transgender medic Dr Beth Upton, after she was suspended following an incident in a hospital changing room on Christmas Eve 2023.

The new action relates to evidence heard during the tribunal and also in response to a controversial press release sent out by the health board.

Ms Peggie’s solicitor, Margaret Gribbon, said new action was raised on August 6 against Fife Health Board (FHB), Dr Kate Searle, Dr Maggie Currer and Esther Davidson.

The latest claim is brought under the Equality Act 2010 and alleges harassment and victimisation linked to Ms Peggie’s gender-critical beliefs.

It is separate from her ongoing case against Dr Upton and the health board.

Ms Gribbon added that further claims of harassment and victimisation would also be lodged in the coming months against NHS Fife and “possibly other” employees.

During the July hearings, Charlotte Myles, a service manager, testified that she decided to lift Ms Peggie’s suspension on March 7, 2024, as she believed there were no patient safety issues and the dispute was a “she said/she said” situation with no corroborating evidence.

However, Ms Myles stated that Dr Searle, Dr Currer, and Ms Davidson “weren’t happy” and objected to her decision to allow Ms Peggie to return to work.

Ms Myles explicitly warned the medics that they would be “culpable” if patient safety concerns, which they alleged, had not been correctly reported at the time of the incident.

Ms Peggie was suspended on January 3, 2024, following Dr Upton’s allegations of bullying and harassment, and was later informed on March 28 of additional claims, including two patient care failings.

The disciplinary hearing, originally scheduled for February 2025, eventually took place on June 25, 2025.

Crucially, Ms Peggie was cleared of all four gross misconduct allegations on July 14, 2025, just hours before the tribunal reconvened.

On July 18, NHS Fife released a statement midway through the tribunal, mentioning threats of “physical harm and sexual violence” to staff that had required Police Scotland’s involvement.

The statement criticised Sex Matters, the campaign group supporting Ms Peggie, for “steering public opinion”.

This statement caused “some concern” to Ms Peggie’s legal team, with Ms Peggie’s junior counsel, Charlotte Elves, highlighting the apparent link between Sex Matters and the threats.

The statement was subsequently amended multiple times, with all references to Sex Matters eventually removed.

Her legal team has demanded that NHS Fife disclose the names of the staff who authorised the statement, citing the board’s corporate communications policy, which requires press releases to be signed off by the communications team and senior executives.

In a statement released on Wednesday morning, Ms Gribbon said: “I can confirm that on 6th August 2025 my client, Sandie Peggie, raised further legal proceedings in the employment tribunal against Fife Health Board (FHB), Dr Kate Searle, Dr Maggie Currer and Esther Davidson.

“All four Respondents’ legal defences to the claim are expected to be received within the next fortnight.

“The claim arises from these senior managers’ opposition to the decision by another FHB manager in March 2024 to lift Sandie’s suspension as set out by the evidence of the suspension review manager during the tribunal hearing in July.

“The claim is one of alleged harassment and victimisation under the Equality Act 2010 relating to Sandie’s gender critical beliefs and is a separate legal case from her ongoing claim against FHB and Dr Beth Upton.
 
“Further claims of harassment and victimisation will also be lodged in the coming months on Sandie’s behalf against FHB and possibly other FHB employees.

“These additional claims relate to the decision to subject Sandie to a disciplinary hearing process and the issuing of a FHB media statement on 18th July 2025. 

“FHB’s Solicitors have been asked to confirm the names of the FHB employees who authorised the media statement in order that consideration can be given to raising legal proceedings against them as individuals.

“Since 19th July 2025 FHB has failed to respond to repeated written requests to disclose the names.”

Ms Peggie’s first tribunal centres on her objection to sharing a women’s changing room with Dr Upton at Victoria Hospital in Kirkcaldy. Her legal team claims she was the victim of a “witch hunt” for challenging the health board’s “gender identity belief.”

The employment tribunal, which began in February, is due to resume for further deliberations this autumn, with a final judgment not expected before November.

A spokesperson for NHS Fife said: “NHS Fife can confirm that a second Employment Tribunal claim has been raised against the organisation and members of its staff.

“NHS Fife will provide a formal response to this additional claim in due course.”
