In <a href=\"https:\/\/www.documentcloud.org\/documents\/28475884-former-employees-v-meta\/#document\/p1\" rel=\"nofollow noopener\" target=\"_blank\">the lawsuit<\/a>, the employees allege Meta determined which workers to dismiss based on performance data collected by a \u201cconstellation\u201d of internal AI tools, but failed to exclude those on parental or medical leave from its ranking system:<\/p>\n<blockquote class=\"duet--article--blockquote _1lkuyz80 _19wv7tc9\">\n<p class=\"duet--article--dangerously-set-cms-markup _1lkuyz88 _19wv7tc1\">The result was that employees who took protected leaves were disproportionately selected for layoff, based on scoring that not only failed to account for their protected leaves, but in effect penalized the employees for exercising their legal rights to these leaves.<\/p>\n<\/blockquote>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1044qizi _18mzr4b1 _18mzr4b0 _19wv7tc1\">The layoffs mentioned in the lawsuit occurred in May as part of Meta\u2019s plans to slash <a href=\"https:\/\/www.theverge.com\/tech\/917690\/meta-is-laying-off-10-percent-of-its-staff\" rel=\"nofollow noopener\" target=\"_blank\">10 percent of its staff<\/a>, or around 8,000 workers.
