For the third time in US history, a parent has been held criminally responsible for the murderous actions of their child.<\/p>\n

Colin Gray, 55, was sentenced in the state of Georgia on Thursday local time to 15 years in prison for second-degree murder, two days after his son Colt Gray was jailed for life over a school shooting.<\/p>\n

Prosecutors argued the father abetted his son’s crimes by providing him with the weapon he ultimately used to kill four people and injure nine others.<\/p>\n

They also argued the father ignored clear red flags of his son’s deteriorating mental health before the shooting.<\/p>\n

Legal experts have suggested Gray’s jailing marks a turning point in American prosecutors pursuing a crackdown on parents for the criminal actions of their children.<\/p>\n

How the Apalachee High School shooting unfolded<\/p>\n

On September 4, 2024, then-14-year-old Colt Gray brought an AR-15-style assault rifle to school hidden in his backpack.<\/p>\n

Driven by a desire to achieve a level of notoriety associated with infamous US school shooters before him, he began firing indiscriminately in a classroom and hallway.<\/p>\n

Two 14-year-old students, Mason Schermerhorn and Christian Angulo, and two teachers, Richard Aspinwall and Cristina Irimie, were shot dead.<\/p>\n

A third teacher and eight other students were injured, including seven hit by gunfire.<\/p>\n

Prosecutors argued the teenager had planned the shooting for some time, and wrote a detailed step-by-step guide for himself \u2014 including estimates of how many people he aimed to kill and injure.<\/p>\n

Investigators previously interviewed Colt and his father more than a year earlier over an online threat linked to the teen, which he denied.<\/p>\n

In the wake of the Apalachee High School shooting, authorities found a shrine in Colt’s bedroom dedicated to Nikolas Cruz, the shooter in the 2018 Marjory Stoneman Douglas High School massacre in Florida.<\/p>\n

Teen gets life for school shooting<\/a><\/p>\n

A judge in the US has sentenced a teenager who killed two students and two teachers in a shooting at Apalachee High School in Georgia to serve life in prison without the possibility of parole.<\/p>\n

Colt told one investigator he had experienced uncontrollable urges and heard people tell him to do things.<\/p>\n

He said right before the shooting he felt things were getting really bad and he feared he was going to be attacked. He repeatedly mentioned believing teachers, and possibly students, were plotting against him.<\/p>\n

On Tuesday, local time, the 16-year-old \u2014 who pleaded guilty to 55 counts including murder and assault charges \u2014 was sentenced to life in prison without the possibility of parole<\/a>.<\/p>\n

Judge says father ‘failed as a parent’<\/p>\n

In sentencing Colin Gray to 15 years in prison, Georgia Judge Nicholas Primm said he was faced by a “nearly impossible task” to penalise the 55-year-old without his decision being skewed by emotion.<\/p>\n

He said punishing crimes of negligence was particularly challenging because there was no intent by Gray to commit a crime.<\/p>\n

“My heart aches for everyone that was there that day, for all of you that have been impacted by it,” he said.<\/p>\n

“But the law requires that I set aside emotion. I don’t get to sentence with passion.<\/p>\n

“You were convicted because the warning lights were flashing brighter and brighter and you didn’t get him help and you didn’t remove his access to the guns.”<\/p><\/blockquote>\n

During the father’s jury trial, prosecutors said he had given his son the assault rifle as a Christmas gift along with ammunition, a gun sight and other shooting accessories.<\/p>\n

Marcee Gray, the teen’s mother who was separated from his father, told investigators she argued with her estranged husband weeks before the shooting, asking him to secure his guns and restrict their son’s access.<\/p>\n

Gray’s defence lawyer asked Judge Primm for a 10-year prison sentence, followed by 10 years on probation, while prosecutors initially pushed for an 80-year term.<\/p>\n

The defence team argued Colt Gray “actively hid the depth of his involvement” in the online community obsessed with mass shooters from his parents and others, and the red flags raised by prosecutors were outliers among happier moments.<\/p>\n

Prosecutors argued the father had simply ignored his son’s “substantial and unjustifiable risk.”<\/p>\n

In handing down the 15-year prison term, Judge Primm said there would have been no crime if Colt had not brought a gun to school and shot people, but his father could have locked up or restricted access to the weapon and ammunition and sought counselling for the teenager.<\/p>\n

Why lawyers are pursuing child school shooters’ parents<\/p>\n

Colin Gray is the latest US parent to be prosecuted for a mass shooting committed by a child, in what is becoming an emerging legal strategy employed by prosecutors in a bid to tackle gun violence in American schools.<\/p>\n

Jennifer and James Crumbley were the first US parents jailed over shootings conducted by their son, Ethan, who killed four students and injured others at Michigan’s Oxford High School in 2021.<\/p>\n

They were also unaware of their son’s plans and had gifted him a gun before the shooting.<\/p>\n

Rachel Fiset, a lawyer at the US-based ZFZ Law firm, told ABC NewsRadio<\/a> the jail terms represent a new push by American prosecutors to hold parents legally responsible for the criminal actions of their children.<\/p>\n

“The judge was considering that it’s fairly unusual circumstances that someone who didn’t pull the trigger or wasn’t even present at the scene was being convinced of murder, even under these types of circumstances,” she said.<\/p>\n

“The idea here is: they’re handling dangerous weapons at home, and if you are going to handle dangerous weapons at home, you need to be aware of what your children are doing.<\/p>\n

“It is charging the parents with responsibility over the child, which we do in all kinds of aspects of life of course, but it is extending it to intentional crimes the children might commit that parents would have an obligation to try to stop.”<\/p>\n

Harry Melkonian, a legal expert from the US Studies Centre in Sydney, told the ABC that American prosecutors had become more motivated to pursue parents of child criminals because school violence had “become a drastic situation”.<\/p>\n

“It’s a means of trying to stop this kind of violence,” he said.<\/p>\n

“One of the purposes of criminal law is deterrence, to try to prevent crimes.<\/p>\n

“The American society is undoubtedly fed up with shootings at schools and churches and synagogues and mosques. It’s got to stop.”<\/p><\/blockquote>\n

He compared the relation of Colin Gray to his son’s actions to the legal definition of someone committing a conspiracy to another person’s crime.<\/p>\n

Mr Melkonian also said the rulings in Georgia and Michigan could provide a legal precedent for similar court decisions in the future, but that they would need to satisfy the “extreme” conditions of cases such as Gray’s.<\/p>\n

“The facts are really extreme \u2026 The facts, as we know them, are of people really behaving badly,” he said.<\/p>\n

“I don’t think you’re going to find many situations of such extreme parental idiocy.”<\/p>\n
