Hager made the request in February.<\/p>\n<p>\u201cThe government agrees that Hager is entitled to the return of those funds,\u201d Assistant U.S. Attorney Adam Dreher wrote in the filing.<\/p>\n<p>Presidential pardon<\/p>\n<p><a href=\"https:\/\/www.usatoday.com\/news\/politics\/donald-trump\/\" target=\"_blank\" rel=\"noopener\">President Donald Trump<\/a>\u00a0pardoned <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/elections\/2025\/01\/20\/donald-trump-pardons-jan-6-defendants\/77490839007\/\" data-type=\"link\" data-id=\"https:\/\/www.usatoday.com\/story\/news\/politics\/elections\/2025\/01\/20\/donald-trump-pardons-jan-6-defendants\/77490839007\/\" target=\"_blank\" rel=\"noopener\">more than 1,500 people on his first day<\/a> in office, keeping a campaign promise to release people charged in the\u00a0<a href=\"https:\/\/www.usatoday.com\/in-depth\/graphics\/2022\/07\/01\/trump-jan-6-breakdown\/9959018002\/\" target=\"_blank\" rel=\"noopener\">Capitol attack Jan. 6, 2021<\/a>.<\/p>\n<p>Following Trump\u2019s decision, appeals courts halted all proceedings and \u201cvacated\u201d convictions, essentially erasing them.<\/p>\n<p>Dreher said that Hager, from Waco, Texas, should be reimbursed because the case was actively being appealed when Trump issued his clemency. Pardoned defendants who did not have active appeals are not entitled to reimbursement because their convictions remain on the books, the Justice Department argued in the filing.<\/p>\n<p>The Department of Justice did not immediately respond to a request for comment.<\/p>\n<p>Capitol repairs<\/p>\n<p>Most defendants convicted for the Capitol insurrection were required to pay restitution to the Architect of the Capitol, who maintains the building and grounds, to help cover the costs of repairing the estimated $3 million in damage.
