{"id":1160055,"date":"2026-08-20T22:07:16","date_gmt":"2026-08-20T22:07:16","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/1160055\/"},"modified":"2026-08-20T22:07:16","modified_gmt":"2026-08-20T22:07:16","slug":"us-pressures-eu-to-narrow-supply-chain-scrutiny","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/1160055\/","title":{"rendered":"US Pressures EU to Narrow Supply Chain Scrutiny"},"content":{"rendered":"<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThe U.S. government is pressing the <a href=\"https:\/\/wwd.com\/tag\/european-union\/\" id=\"auto-tag_european-union\" data-tag=\"european-union\" rel=\"nofollow noopener\" target=\"_blank\">European Union<\/a> to shield American companies and their upstream suppliers from large portions of the bloc\u2019s recently narrowed <a href=\"https:\/\/wwd.com\/sourcing-journal\/industry-news\/european-union-final-approval-omnibus-csddd-csrd-1238863818\/\" data-type=\"link\" data-id=\"https:\/\/wwd.com\/sourcing-journal\/industry-news\/european-union-final-approval-omnibus-csddd-csrd-1238863818\/\" rel=\"nofollow noopener\" target=\"_blank\">sustainability rules<\/a>, warning that it will take \u201cany actions necessary\u201d if Brussels fails to address what Washington considers unreasonable burdens on U.S. commerce.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tIn a five-page submission published by the U.S. Mission to the <a href=\"https:\/\/wwd.com\/sourcing-journal\/industry-news\/shein-european-union-tariff-united-states-china-1239122365\/\" id=\"related_article_link_european-union\" data-tag=\"european-union\" rel=\"nofollow noopener\" target=\"_blank\">European Union<\/a>, Washington asked the bloc to significantly limit how its Corporate Sustainability Due Diligence Directive (<a href=\"https:\/\/wwd.com\/sourcing-journal\/industry-news\/corporate-sustainability-due-diligence-forced-labor-regulation-1238859621\/\" data-type=\"link\" data-id=\"https:\/\/wwd.com\/sourcing-journal\/industry-news\/corporate-sustainability-due-diligence-forced-labor-regulation-1238859621\/\" rel=\"nofollow noopener\" target=\"_blank\">CSDDD<\/a>) and Corporate Sustainability Reporting Directive (<a rel=\"noreferrer noopener nofollow\" target=\"_blank\" href=\"https:\/\/wwd.com\/sourcing-journal\/sustainability\/global-fashion-agenda-policy-matrix-europa-edit-1238860564\/\">CSRD<\/a>) apply to U.S. businesses. Its demands range from excluding non-EU companies from CSDDD\u2019s direct scope to limiting penalties, supplier audits and private lawsuits.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThe U.S. also wants responsibility for due diligence and enforcement confined to a company\u2019s EU subsidiaries or European business partners. CSDDD should apply only to goods produced in, or services supplied from, the EU, it said.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tFor fashion, one of the most consequential requests concerns suppliers that sit beyond the first tier of production. Washington said producers and farmers that do not directly supply a company covered by CSDDD should not face audits or information requests, particularly when their products are not sold in the European market.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThat could have significant implications for an industry in which brands frequently have no direct contractual relationship with cotton growers, chemical manufacturers, spinners, textile mills and other businesses deeper in their supply chains. Those tiers are also where many of fashion\u2019s<a href=\"https:\/\/wwd.com\/sourcing-journal\/industry-news\/eu-forced-labor-regulation-member-states-1238843769\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\"> most persistent<\/a> forced-labor, wage, safety and environmental risks can be difficult to trace.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThe U.S. government argued that the directives\u2019 \u201cextraterritorial reach\u201d could sweep in companies and suppliers with little connection to the European market while forcing American businesses to comply with overlapping or conflicting standards. It specifically objected to the EU\u2019s<a href=\"https:\/\/wwd.com\/sourcing-journal\/sustainability\/ellen-macarthur-foundation-resale-repair-policy-levers-1238976552\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\"> double-materiality model<\/a>, which requires companies to report both how sustainability issues affect their finances and how their activities affect people and the environment.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tU.S. law, by comparison, centers corporate disclosure requirements on information considered financially material to investors, the submission said.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tWashington wants the<a rel=\"noreferrer noopener nofollow\" target=\"_blank\" href=\"https:\/\/wwd.com\/sourcing-journal\/industry-news\/european-commision-ombudswoman-omnibus-csddd-simplification-1238859907\/\"> European Commission<\/a> to designate the U.S. a \u201cnegligible risk\u201d jurisdiction and establish presumed compliance for companies operating in countries with what it considers robust corporate-governance and supply-chain rules. It said the U.S. already maintains a \u201c<a rel=\"noreferrer noopener nofollow\" target=\"_blank\" href=\"https:\/\/wwd.com\/sourcing-journal\/industry-news\/french-hill-republicans-csddd-omnibus-trump-regulatory-burden-1238848673\/\">rigorous regulatory regime<\/a>\u201d governing supply-chain mapping and due diligence.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThe U.S. prohibits the importation of goods produced with<a rel=\"noreferrer noopener nofollow\" target=\"_blank\" href=\"https:\/\/wwd.com\/sourcing-journal\/sustainability\/uk-forced-labor-section-301-legislation-1239051767\/\"> forced labor<\/a> and has additional disclosure and sourcing requirements at the federal and state levels. But it has no economy-wide counterpart to CSDDD requiring large companies to identify, prevent and address human-rights and environmental harms throughout their operations and supply chains.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThe demands arrive after the EU has already substantially narrowed both directives through its<a href=\"https:\/\/wwd.com\/sourcing-journal\/industry-news\/eu-omnibus-csddd-csrd-taxonomy-legislation-due-diligence-1238848536\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\"> Omnibus I simplification package<\/a>. The final changes raised CSDDD\u2019s threshold for EU companies to more than 5,000 employees and 1.5 billion euros in net worldwide turnover. Non-EU companies fall within its direct scope only when they generate more than 1.5 billion euros in net turnover inside the EU. The overhaul also removed CSDDD\u2019s climate-transition-plan requirement and eliminated its harmonized civil-liability regime.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThe revised directive allows companies to focus their assessments on areas where adverse impacts are most likely or severe and gives them greater latitude to prioritize direct business partners. Companies are expected to comply with the updated due diligence requirements beginning in July 2029.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tCSRD\u2019s scope was similarly reduced to EU companies with more than 1,000 employees and annual turnover above 450 million euros. For a non-EU group, reporting applies when the parent generates more than 450 million euros in the bloc and its EU subsidiary or branch exceeds 200 million euros in turnover.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThe <a href=\"https:\/\/wwd.com\/tag\/european-commission\/\" id=\"auto-tag_european-commission\" data-tag=\"european-commission\" rel=\"nofollow noopener\" target=\"_blank\">European Commission<\/a> subsequently revised its reporting standards, cutting mandatory data points by more than 60 percent and estimating that the changes would reduce reporting costs by more than 30 percent per company.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tWashington acknowledged that the reforms represented progress but said they did not go far enough. The U.S. and EU agreed in their<a rel=\"noreferrer noopener nofollow\" target=\"_blank\" href=\"https:\/\/wwd.com\/business-news\/government-trade\/eu-us-trade-agreement-digital-sustainability-tariffs-fashion-2-1238065099\/\"> August 2025 trade framework<\/a> to work toward ensuring that CSDDD and CSRD would not create \u201cundue restrictions on transatlantic trade.\u201d The EU also committed to addressing U.S. concerns about applying CSDDD to companies from countries with \u201crelevant high-quality regulations.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThe latest submission effectively tells Brussels what Washington believes fulfilling that commitment should entail.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tBeyond the directives\u2019 scope, the U.S. wants fines against American businesses limited to revenue generated inside the EU. The<a rel=\"noreferrer noopener nofollow\" target=\"_blank\" href=\"https:\/\/wwd.com\/sourcing-journal\/industry-news\/germany-lksg-supply-chain-due-diligence-fashion-europe-csddd-1238862526\/\"> amended CSDDD<\/a> currently allows penalties of up to 3 percent of a company\u2019s worldwide net turnover.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tWashington also called for a regulator-led enforcement system that would permit civil claims only after a supervisory authority had determined that a company failed to comply. Any permitted claim should have to demonstrate a direct connection to harm occurring in or materially affecting the EU, it said.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThe submission raised separate concerns about<a href=\"https:\/\/wwd.com\/sourcing-journal\/industry-news\/factory-audit-fatigue-avedis-seferian-wrap-compliance-supply-chain-traceability-1238826374\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\"> third-party auditors<\/a>, alleging that customers have already threatened to terminate contracts with U.S. companies based on inaccurate verification reports. It asked the EU to require verifiers to be independent, accredited and overseen by member states.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tIt also urged the Commission and EU member states not to revive mandatory climate-transition plans through guidance or national implementation after lawmakers removed the provision from CSDDD.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThat legal distinction could determine how much room the EU has to accommodate Washington without reopening <a href=\"https:\/\/wwd.com\/tag\/legislation\/\" id=\"auto-tag_legislation\" data-tag=\"legislation\" rel=\"nofollow noopener\" target=\"_blank\">legislation<\/a> it finished overhauling only months ago. Several U.S. requests would appear to require changes to the directive itself rather than implementation guidance, including eliminating the provisions that place non-EU companies directly within CSDDD\u2019s scope and changing how penalties are calculated.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThe submission does not identify which agency drafted it, when it was delivered or which EU officials received it.
