The Article III Project, a Trump-aligned group, arranged 164,000 phone calls, emails and social media messages to members of Congress in recent weeks urging lawmakers to back Trump in this judiciary fight. They called for impeaching Judge James Boasberg &#8211; one of the federal judges who has drawn MAGA&#8217;s ire &#8211; after he <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/04\/08\/trump-deportation-case-supreme-court\/82990229007\/\" data-type=\"link\" data-id=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/04\/08\/trump-deportation-case-supreme-court\/82990229007\/\" target=\"_blank\" rel=\"noreferrer noopener\">ordered a temporary halt<\/a> to Trump&#8217;s effort to deport some immigrants. They also want lawmakers to cut the federal budget for the judiciary by $2 billion after Judge Amir Ali ordered the Trump administration to unfreeze that amount of foreign aid.<\/p>\n<p>The group is supporting bills introduced by Sen. Chuck Grassley, R-Iowa, and Rep. Darrell Issa, R-California, aimed at stopping federal district judges from issuing nationwide court orders, which have blocked some of Trump&#8217;s policies. Trump complained in <a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/114490277514269016\" data-type=\"link\" data-id=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/114490277514269016\" target=\"_blank\" rel=\"noopener\">a May 11 social media post<\/a> about a \u201cradicalized and incompetent Court System.\u201d<\/p>\n<p>\u201cThe American people resoundingly voted to enforce our immigration laws and mass deport terrorist illegal aliens,&#8221; said White House spokesman Kush Desai. &#8220;Despite what activist judges have to say, the Trump administration is legally using every lever of authority granted to the executive branch by the Constitution and Congress to deliver on this mandate.\u201d<\/p>\n<p>The clash with the courts has sparked talk of a breakdown in the constitutional order. After the Supreme Court ordered the Trump administration to &#8220;facilitate&#8221; the return of a Maryland resident wrongly deported to El Salvador and the administration continued to resist bringing him back, U.S. Sen. Adam Schiff, D-California, declared: &#8220;The constitutional crisis is here. President Trump is disobeying lawful court orders.&#8221;<\/p>\n<p>Bannon <a href=\"https:\/\/www.youtube.com\/watch?v=IGKFJPbaFLc\" data-type=\"link\" data-id=\"https:\/\/www.youtube.com\/watch?v=IGKFJPbaFLc\" target=\"_blank\" rel=\"noopener\">talked in an NPR interview<\/a> about a &#8220;constitutional crisis that we&#8217;re hurtling to.&#8221; Trump and allies such as Davis have complained that the judges ruling against him are left wing partisans. &#8220;Once judges take off their judicial robes and enter the political arena and throw political punches, they should expect powerful political counter punches,&#8221; Davis said.<\/p>\n<p>Yet some of the president&#8217;s biggest legal setbacks have come from Republican-appointed judges, including <a href=\"https:\/\/www.washingtonpost.com\/politics\/2025\/04\/24\/republican-judges-oppose-trump\/\" data-type=\"link\" data-id=\"https:\/\/www.washingtonpost.com\/politics\/2025\/04\/24\/republican-judges-oppose-trump\/\" target=\"_blank\" rel=\"noopener\">multiple judges appointed by Trump<\/a>. Judge Fernando Rodriguez of the Southern District of Texas is a <a href=\"https:\/\/www.txs.uscourts.gov\/content\/appointment-united-states-district-judge-fernando-rodriguez-jrbrownsville-division\" data-type=\"link\" data-id=\"https:\/\/www.txs.uscourts.gov\/content\/appointment-united-states-district-judge-fernando-rodriguez-jrbrownsville-division\" target=\"_blank\" rel=\"noopener\">Trump appointee<\/a> who <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/05\/01\/trump-judge-alien-enemies-act-deportation-venezuelans\/83387647007\/\" data-type=\"link\" data-id=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/05\/01\/trump-judge-alien-enemies-act-deportation-venezuelans\/83387647007\/\" target=\"_blank\" rel=\"noopener\">ruled<\/a> against him on using the 1798 Alien Enemies Act to deport certain migrants. Another Trump appointee, Judge Trevor McFadden with the D.C. District, <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/04\/08\/judge-trump-ap-gulf-of-mexico\/82998355007\/\" data-type=\"link\" data-id=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/04\/08\/judge-trump-ap-gulf-of-mexico\/82998355007\/\" target=\"_blank\" rel=\"noopener\">ruled last month<\/a> that the Trump administration must reinstate access to presidential events for the Associated Press news agency, which had been barred because it continued to use the term &#8220;Gulf of Mexico&#8221; instead of Gulf of America in its coverage.<\/p>\n<p class=\"related-link\"><strong style=\"margin-right:3px\">More: <\/strong><a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/04\/08\/judge-trump-ap-gulf-of-mexico\/82998355007\/\" rel=\"noreferrer noopener\" target=\"_blank\">Judge lifts Trump restrictions on AP while lawsuit proceeds over &#8216;Gulf of Mexico&#8217;<\/a><\/p>\n<p>Jones, who had a lifetime appointment to serve as a federal judge beginning in 2002 until he left to become president of Dickinson College in 2021, called the rhetoric directed at judges by the Trump administration &#8220;abominable&#8230; and entirely inappropriate.&#8221;<\/p>\n<p>&#8220;It absolutely misrepresents the way the judges decide cases,&#8221; he said. &#8220;And unfortunately, many people are listening to this and and they&#8217;re getting a completely mistaken impression of how judges do their jobs.&#8221;<\/p>\n<p>Due process rights, and the Fifth and Fourteenth Amendments<\/p>\n<p>One of the biggest points of contention has been due process rights, which are guaranteed under the Constitution&#8217;s Fifth and Fourteenth Amendments. They prohibit the federal and state governments from depriving any person \u201cof life, liberty, or property, without due process of law.\u201d<\/p>\n<p>The same rights American citizens have to contest government actions against them in court extend to undocumented immigrants facing detention and deportation.<\/p>\n<p>Trump came into office promising mass deportations and has moved aggressively, including invoking the Alien Enemies Act, which allows for the targeting of certain immigrants &#8220;without a hearing and based only on their country of birth or citizenship,&#8221; <a href=\"https:\/\/www.brennancenter.org\/our-work\/research-reports\/alien-enemies-act-explained\" data-type=\"link\" data-id=\"https:\/\/www.brennancenter.org\/our-work\/research-reports\/alien-enemies-act-explained\" target=\"_blank\" rel=\"noopener\">according to<\/a> the Brennan Center for Justice.<\/p>\n<p class=\"related-link\"><strong style=\"margin-right:3px\">More: <\/strong><a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/04\/29\/100-days-trump-immigration-policies\/83231167007\/\" rel=\"noreferrer noopener\" target=\"_blank\">Trump has cracked down on immigration and the border. At what cost?<\/a><\/p>\n<p>Courts have balked at his tactics.<\/p>\n<p>In the most high-profile case,<a href=\"https:\/\/www.usatoday.com\/news\/politics\/supreme-court\/\" target=\"_blank\" rel=\"noopener\"> the Supreme Court<\/a> ruled the <a href=\"https:\/\/www.usatoday.com\/story\/news\/nation\/2025\/04\/10\/scotus-deported-abrego-garcia\/83029450007\/\" target=\"_blank\" rel=\"noopener\">Trump administration must \u201cfacilitate\u201d<\/a> the return of Kilmar Abrego Garcia, a Maryland resident wrongly sent to a notorious prison in El Salvador.<\/p>\n<p>The Supreme Court <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/05\/16\/supreme-court-block-migrant-deportation-alien-enemies-act\/83186051007\/\" data-type=\"link\" data-id=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/05\/16\/supreme-court-block-migrant-deportation-alien-enemies-act\/83186051007\/\" target=\"_blank\" rel=\"noopener\">on May 16 <\/a>also temporarily blocked the Trump administration from using the Alien Enemies Act to more quickly deport a group migrants held in Texas, sending the case back to the appeals court to decide the merits of whether the president\u2019s use of the legislation is lawful, and if so what process should be used to remove people.<\/p>\n<p>The administration hasn\u2019t brought Abrego Garcia back, and Trump has expressed frustration with the judiciary\u2019s insistence on due process. He lashed out after the latest Supreme Court ruling, <a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/114519753109701350\" data-type=\"link\" data-id=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/114519753109701350\" target=\"_blank\" rel=\"noopener\">writing on social media<\/a> that the court &#8220;is not allowing me to do what I was elected to do.&#8221;<\/p>\n<p>Trump Deputy Chief of Staff Stephen Miller brought up the debate on May 9 <a href=\"https:\/\/x.com\/cspan\/status\/1920911944866808017\">when he said<\/a> the administration is investigating suspending <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/05\/10\/trump-stephen-miller-habeas-corpus-constitution\/83554334007\/\" target=\"_blank\" rel=\"noopener\">habeas <\/a>due process rights, which only is allowed by the Constitution to preserve public safety <a href=\"https:\/\/constitution.congress.gov\/constitution\/article-1\/\" target=\"_blank\" rel=\"noopener\">during \u201cRebellion or Invasion.\u201d<\/a><\/p>\n<p>\u201cIt\u2019s an option we\u2019re actively looking at,\u201d<a href=\"https:\/\/x.com\/cspan\/status\/1920911944866808017\"> Miller said.<\/a> \u201cLook, a lot of it depends on whether the courts do the right thing or not.\u201d<\/p>\n<p>Conservative media figure Rogan O&#8217;Handley told USA TODAY he saw online commentary about suspending habeas corpus and began promoting it to the 2.2 million followers of his @DC_Draino X handle. Two days later, on April 30, Trump was asked during a Cabinet meeting about his administration\u2019s planned response to the rash of nationwide injunctions against his deportation efforts and <a href=\"https:\/\/www.youtube.com\/watch?v=wn2XtufOAHc\" data-type=\"link\" data-id=\"https:\/\/www.youtube.com\/watch?v=wn2XtufOAHc\" target=\"_blank\" rel=\"noopener\">seemed to allude<\/a> to suspending habeas.<\/p>\n<p>The idea \u2013 <a href=\"https:\/\/constitutioncenter.org\/the-constitution\/articles\/article-i\/clauses\/763\" target=\"_blank\" rel=\"noopener\">last done in Hawaii <\/a>in 1941 after Japan bombed Pearl Harbor \u2013 highlights how the Trump administration is determined to push through any legal or constitutional obstacle to its deportation plans.<\/p>\n<p>Trump and Chief Justice John Roberts<\/p>\n<p>Among Trump&#8217;s biggest obstacles so far during the second term is the judiciary, which repeatedly has blocked some of his actions, calling his methods unlawful and drawing his ire.<\/p>\n<p>\u201cWe need judges that are not going to be demanding trials for every single illegal immigrant,&#8221; <a href=\"https:\/\/www.dailymotion.com\/video\/x9j14po\" target=\"_blank\" rel=\"noopener\">Trump told reporters<\/a> recently on Air Force One. &#8220;We have millions of people that have come in here illegally, and we can&#8217;t have a trial for every single person.\u201d<\/p>\n<p>Immigration cases don&#8217;t go before a jury, but instead are decided solely by an immigration judge.<\/p>\n<p>Miller has <a href=\"https:\/\/x.com\/stephenm\/status\/1920249713820942798?s=12&amp;t=h7vnpOACjMOEdARJ3oapOg\">complained about a \u201cjudicial coup\u201d<\/a> while Bannon, the podcaster and White House chief strategist during Trump&#8217;s first administration,\u00a0<a href=\"https:\/\/www.youtube.com\/watch?v=IGKFJPbaFLc\" target=\"_blank\" rel=\"noopener\">says there is a \u201cjudicial insurrection.\u201d<\/a><\/p>\n<p>The conflict has been brewing for months.<\/p>\n<p>Trump <a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/114183576937425149\" target=\"_blank\" rel=\"noopener\">said March 18 on social media<\/a> that a federal judge who ruled against him in an immigration case should be impeached, drawing a rare rebuke from Roberts, the chief justice of the United States and another Bush appointee.<\/p>\n<p>\u201cFor more than two centuries, it has been established that impeachment is not an appropriate response to disagreement concerning a judicial decision,\u201d<a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/03\/18\/chief-justice-john-roberts-trump-impeachment\/82516448007\/\" target=\"_blank\" rel=\"noopener\"> Roberts said<\/a> in March.<\/p>\n<p>Tensions have only escalated.<\/p>\n<p>On April 25 federal authorities announced charges against <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/04\/25\/milwaukee-county-judge-hannah-dugan-arrested-fbi-immigration\/83271644007\/\" target=\"_blank\" rel=\"noopener\">a Wisconsin judge<\/a> and former New Mexico judge, accusing them of hampering immigration enforcement efforts. <a href=\"https:\/\/www.jsonline.com\/story\/news\/local\/milwaukee\/2025\/05\/02\/hannah-dugan-known-in-milwaukee-as-advocate-for-poor-stern-judge\/83343891007\/\" target=\"_blank\" rel=\"noreferrer noopener\">Milwaukee County Judge Hannah Dugan<\/a>\u00a0pleaded <a href=\"https:\/\/www.jsonline.com\/story\/news\/2025\/05\/15\/what-to-expect-at-court-appearance-for-wisconsin-judge-hannah-dugan\/83605808007\/\" data-type=\"link\" data-id=\"https:\/\/www.jsonline.com\/story\/news\/2025\/05\/15\/what-to-expect-at-court-appearance-for-wisconsin-judge-hannah-dugan\/83605808007\/\" target=\"_blank\" rel=\"noopener\">not guilty May 15.<\/a><\/p>\n<p>On May 22, the <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/05\/22\/house-passes-trump-bill-congress\/83747173007\/\" data-type=\"link\" data-id=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/05\/22\/house-passes-trump-bill-congress\/83747173007\/\" target=\"_blank\" rel=\"noreferrer noopener\">House passed Trump&#8217;s sweeping tax legislation<\/a> and included language inside the more than 1,100-page measure that could protect the Trump administration if a judge determined officials violated a court order. The language limits a judge&#8217;s ability to hold someone in contempt of court if they &#8220;fail to comply with an injunction or temporary restraining order.&#8221;<\/p>\n<p>Suspending habeas corpus?<\/p>\n<p>Constitutional scholars told USA TODAY the Trump administration can\u2019t suspend habeas corpus without congressional approval.<\/p>\n<p>\u201cIf President Trump were to unilaterally suspend habeas corpus that\u2019s flagrantly unconstitutional,\u201d said University of North Carolina School of Law professor Michael Gerhardt.<\/p>\n<p>Duke Law Professor H.
