The claim that international law is fine as far as it goes, but can be put aside when the conditions change, is a claim that was made in the early 1930s by \u2018realist\u2019 jurists in <a href=\"https:\/\/www.thesun.co.uk\/where\/germany\/\" rel=\"noopener\" target=\"_blank\">Germany<\/a> most notably Carl Schmitt, whose central thesis was in essence the claim that state power is all that counts, not law.<\/p>\n<p>\u201cBecause of the experience of what followed 1933, far-sighted individuals rebuilt and transformed the institutions of international law, as well as internal constitutional law.\u201d<\/p>\n<p>The year 1933 was the year that <a href=\"https:\/\/www.thesun.co.uk\/who\/adolf-hitler\/\" rel=\"noopener\" target=\"_blank\">Adolf Hitler<\/a> rose to power as German Chancellor.<\/p>\n<p>They were not mentioned by name, but the Tories said that a comparison was made.<\/p>\n<p><a href=\"https:\/\/www.thesun.co.uk\/who\/robert-jenrick\/\" rel=\"noopener\" target=\"_blank\">Shadow Justice Secretary Robert Jenrick<\/a> said: \u201cIt is appalling that Hermer would insinuate those who think we should leave the ECHR are like the Nazis.<\/p>\n<p>\u201c<a href=\"https:\/\/www.thesun.co.uk\/who\/david-lammy\/\" rel=\"noopener\" target=\"_blank\">David Lammy<\/a> tried that disgusting smear with <a href=\"https:\/\/www.thesun.co.uk\/news\/brexit\/\" rel=\"noopener\" target=\"_blank\">Brexiteers<\/a> and it didn\u2019t work for him &#8211; it won\u2019t work for Hermer either.
