A fraudster has been given just two months to find more than \u00a3250,000 or face three years in prison.<\/p>\n

Shaobo Qin faces the race against time after he claimed payments for disposing of waste packaging which did not exist.<\/p>\n

The 42-year-old, from Sutton Coldfield<\/a>, was a director of plastics and recycling exporter EDU Case Ltd, based at the Droicon Trading Estate at Portway Road, Rowley Regis.<\/p>\n

Qin was found to have \u2018deliberately and systematically\u2019 entered false data on the Environment Agency\u2019s National Packaging Waste Database (NPWD) for non-existent waste exports.<\/p>\n

He and his company made more than \u00a3255,000 from false entries between January 1 2022 and January 31, 2023, having claimed to have exported 1,239 metric tonnes of plastic waste in 2022.<\/p>\n

In reality, the company only exported 453.60 metric tonnes.<\/p>\n

The fraud emerged in an audit conducted by Environment Agency officers in 2023.<\/p>\n

A Birmingham<\/a> Crown Court judge said \u2018this was without doubt deliberate offending and pre-planned\u2019 and there had been a \u2018significant undermining of the regulatory regime\u2019.<\/p>\n

The judge accepted Qin had pleaded guilty at the earliest opportunity and that money had been put aside to repay the financial benefit made.<\/p>\n

As well as being ordered to pay a Proceeds of Crime confiscation order of \u00a3255,057, EDU Case Ltd was fined \u00a3200,000 \u2018to mark the seriousness of the offending\u2019.<\/p>\n

The Environment Agency was awarded \u00a321,995 in investigation costs \u2013 a total bill of \u00a3476,995.<\/p>\n

Qin pleaded guilty to fraud by false representation and was given a two-year prison sentence, suspended for 18 months.<\/p>\n

He was ordered to pay back \u00a3255,057 within two months or face three years in prison.<\/p>\n

He was also disqualified as a director for four years and ordered to complete 200 hours of unpaid work.<\/p>\n

Sham Singh, senior environmental crime officer for the Environment Agency, said: \u201cThis case shows the Environment Agency will pursue individuals and their enterprises who profit illegally.<\/p>\n

\u201cThis was a fraud on a large scale and undermines legitimate business and the investment and economic growth that go with it.<\/p>\n

\u201cWe support legitimate businesses and are proactively supporting them by disrupting and stopping the criminal element backed up by the threat of tough enforcement as in this case.<\/p>\n
