{"id":161111,"date":"2025-06-05T20:22:15","date_gmt":"2025-06-05T20:22:15","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/161111\/"},"modified":"2025-06-05T20:22:15","modified_gmt":"2025-06-05T20:22:15","slug":"supreme-court-makes-it-easier-to-claim-reverse-discrimination-in-employment","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/161111\/","title":{"rendered":"Supreme Court makes it easier to claim &#8216;reverse discrimination&#8217; in employment"},"content":{"rendered":"<p>WASHINGTON (AP) \u2014 A unanimous <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/hub\/us-supreme-court\" target=\"_blank\" rel=\"noopener\">Supreme Court<\/a> made it easier Thursday to bring lawsuits over so-called reverse discrimination, siding with an Ohio woman who claims she didn\u2019t get a job and then was demoted because she is straight.<\/p>\n<p>The justices\u2019 <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/www.supremecourt.gov\/opinions\/24pdf\/23-1039_c0n2.pdf\" target=\"_blank\" rel=\"noopener\">decision<\/a> affects lawsuits in 20 states and the District of Columbia where, until now, courts had set a higher bar when members of a majority group, including those who are white and heterosexual, sue for discrimination under federal law.<\/p>\n<p>Justice Ketanji Brown Jackson wrote for the court that federal civil rights law draws no distinction between members of majority and minority groups.<\/p>\n<p>\u201cBy establishing the same protections for every \u2018individual\u2019 \u2014 without regard to that individual\u2019s membership in a minority or majority group \u2014 Congress left no room for courts to impose special requirements on majority-group plaintiffs alone,\u201d Jackson wrote. <\/p>\n<p>The court ruled in an appeal from Marlean Ames, who has worked for the Ohio Department of Youth Services for more than 20 years.<\/p>\n<p>Though he joined Jackson\u2019s opinion, Justice Clarence Thomas noted in a separate opinion that some of the country\u2019s \u201clargest and most prestigious employers have overtly discriminated against those they deem members of so-called majority groups.\u201d<\/p>\n<p>Thomas, joined by Justice Neil Gorsuch, cited a brief filed by America First Legal, a conservative group founded by Trump aide <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-stephen-miller-policy-immigration-9cc6ad3118779b23bff88022ca5e2260\" target=\"_blank\" rel=\"noopener\">Stephen Miller<\/a>, to assert that \u201cAmerican employers have long been \u2018obsessed\u2019 with \u2018diversity, equity, and inclusion\u2019 initiatives and affirmative action plans.\u201d<\/p>\n<p>    <a class=\"AnchorLink\" id=\"html-embed-module-650000\"\/><\/p>\n<p>  AP Mobile App CTA<\/p>\n<p>  <img decoding=\"async\" class=\"logo\" src=\"https:\/\/www.europesays.com\/uk\/wp-content\/uploads\/2025\/06\/icon-2-copy.png\" alt=\"AP Logo\"\/><\/p>\n<p>Get the AP News App<\/p>\n<p>  <a id=\"store-link\" href=\"#\" target=\"_blank\"><br \/>\n    <img decoding=\"async\" id=\"store-badge\" class=\"badge\" src=\"#\" alt=\"Download App\"\/><br \/>\n  <\/a><\/p>\n<p>Two years ago, the court\u2019s conservative majority outlawed consideration of race in university admissions. Since taking office in January, President <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/illegal-immigrant-registry-trump-border-enforcement-37ce7a345c1617ce3a9427e0ef755021\" target=\"_blank\" rel=\"noopener\">Donald Trump<\/a> has ordered <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-dei-businesses-diversity-05fb71a91cab7e3bbe8729f6bdeb4983\" target=\"_blank\" rel=\"noopener\">an end to DEI policies<\/a> in the federal government and has sought to end government support for DEI programs elsewhere. Some of the new administration\u2019s anti-DEI initiatives have been <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/dei-diversity-equity-inclusion-trump-federal-judge-5b04fbc742bd32adf98ca108b4b12b37\" target=\"_blank\" rel=\"noopener\">temporarily blocked<\/a> in federal court.<\/p>\n<p>Federal agencies have moved quickly to implement Trump\u2019s vision and shift priorities to reflect that mission, including rooting out <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-veterans-affairs-christian-bias-f7750d2a357f02b250516e12d3eaff0c\" target=\"_blank\" rel=\"noopener\">discrimination against members of majority groups<\/a>. <\/p>\n<p>The head of the Equal Employment Opportunity Commission, responsible for enforcing workplace anti-discrimination laws, has pivoted the agency to focus on eliminating \u201call forms\u201d of race discrimination, including those stemming from <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/dei-eeoc-civil-rights-trump-discrimination-executive-orders-bc3aff73de5e3649b1daccf718eefdc2\" target=\"_blank\" rel=\"noopener\">DEI initiatives<\/a>.<\/p>\n<p>At the same time, Acting Chair Andrea Lucas has moved to deprioritize cases involving <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/transgender-discrimination-gender-civil-rights-88def3b2a735f09cb79d37fc1125b095\" target=\"_blank\" rel=\"noopener\">discrimination against transgender workers<\/a>, saying she rejects the idea that \u201ccivil rights exist solely to remedy harms against certain groups.\u201d<\/p>\n<p>Jackson\u2019s opinion makes no mention of DEI. Instead, she focused on Ames\u2019 contention that she was passed over for a promotion and then demoted because she is heterosexual. Both the job she sought and the one she had held were given to LGBTQ people.<\/p>\n<p>Title VII of the Civil Rights Act of 1964 bars sex discrimination in the workplace.
