unlawful<\/a>.<\/p>\nThe case had been brought by campaign group Transport Action Network (TAN). According to TAN the case sets a precedent that ministers cannot disregard duties set by Parliament even if they might find them \u201cinconvenient.\u201d<\/p>\n
The Infrastructure Act of 2015 gave the funding of \u201cactive travel\u201d the same status as that for railways and roads requiring regularly updated strategies and stable funding.<\/p>\n
However, in March 2023, the Treasury told the Department for Transport to cut $270 million of dedicated funding for active travel. Though this decision was criticized by both the National Audit Office and Public Accounts Committee of MPs, the cuts were not reversed by the then Conservative government. TAN filed a legal challenge three months later but, the following year, the High Court accepted the Department for Transport\u2019s defense that the funding it had promised was just a \u201cguestimate.\u201d<\/p>\n
In a unanimous decision, the Court of Appeal today ruled in TAN\u2019s favor. Giving judgment, Lady Justice Elisabeth Laing said that:<\/p>\n
\u201cThere is nothing vague about a requirement to \u2018specify the resources to be made available by the Secretary of State\u2019. The word is \u2018specify\u2019 not \u2018project\u2019, \u2018estimate\u2019 or \u2018guess\u2019\u2026If the Secretary of State finds it inconvenient, or \u2018impractical\u2019 to comply with the procedure for variation, then the Secretary of State can persuade Parliament to amend the legislation.\u201d<\/p>\n
TAN director Chris Todd said: \u201cGiven how good walking and cycling is for the economy, for improving access to jobs, for the NHS and health\u2013in fact, all of Labour\u2019s missions\u2013it has been a mystery why Labour continued defending a Conservative cut. Investing in small scale schemes, rather than glossy mega-projects like roads, means higher returns for the country and real benefits for communities.\u201d<\/p>\n
Because the funding cut was for the period up to March 2025 and the appeal was heard after that date, the court could not order the government to return the funding. TAN is now urging the government to provide fresh funding to cover the shortfall.<\/p>\n
\u201cWe\u2019ve noted the decision of the Court of Appeal and we are considering next steps,\u201d said a spokesperson for the Department for Transport. A possible next step is for the government to appeal today\u2019s decision to the Supreme Court.<\/p>\n
The Department for Transport spokesperson stressed that the decision to defund active travel was made by the previous, Conservative administration: \u201cThe reduction in active travel funding in March 2023 was under the previous government and the current government has reversed these cuts both last year and this year,\u201d said the spokesperson, adding that the U.K. government is \u201cinvesting nearly $404 million to build up to 300 miles of new cycle lanes and [sidewalks]<\/p>\n
to help more people cycle, walk, wheel and scoot. This will lead to 43,000 fewer sick days every to year to ease pressure off the NHS and add $1.9 billion to the economy, helping us deliver our Plan for Change.\u201d<\/p>\n
