But the process is taking longer than ever.<\/p>\n<p>The number of probate cases taking over a year to be granted has surged by 134 per cent in the last three years, new research has revealed.<\/p>\n<p>Now, experts are warning that the upcoming changes to <a href=\"https:\/\/go.skimresources.com\/?id=55199X1622456&amp;isjs=1&amp;jv=15.7.1&amp;sref=https%3A%2F%2Finews.co.uk%2Fsearch%3Fq%3Dpension%23gsc.tab%3D0%26gsc.q%3Dinheritance%2520tax%26gsc.sort%3D&amp;url=https%3A%2F%2Fwww.google.com%2Furl%3Fclient%3Dinternal-element-cse%26cx%3D011782314020777428663%3Aycznkklrfq5%26q%3Dhttps%3A%2F%2Finews.co.uk%2Ftopic%2Finheritance-tax%26sa%3DU%26ved%3D2ahUKEwji_5Tjht2NAxXZVKQEHbQ-N2sQFnoECAUQAQ%26usg%3DAOvVaw0hJifB7acBvvSVB2ivKsoR&amp;xs=1&amp;xtz=-60&amp;xuuid=e6529002e383c6e51477c2c12f04c24b&amp;xjsf=other_click__auxclick%20%5B2%5D\" target=\"_blank\" rel=\"noopener\">inheritance tax (IHT)<\/a>, which will make pensions taxable, could worsen delays.<\/p>\n<p>Jon Greer, head of retirement policy at Quilter, said they are already witnessing \u201clarge delays\u201d, which is causing \u201csignificant stress\u201d for grieving families.<\/p>\n<p>With pensions set to become part of the taxable estate from April 2027, the situation is \u201clikely to worsen\u201d.<\/p>\n<p>He said: \u201cPension schemes are often unaware of a member\u2019s death immediately, delaying <a href=\"https:\/\/go.skimresources.com\/?id=55199X1622456&amp;isjs=1&amp;jv=15.7.1&amp;sref=https%3A%2F%2Finews.co.uk%2Fsearch%3Fq%3Dpension%23gsc.tab%3D0%26gsc.q%3D%2520tax%26gsc.sort%3D&amp;url=https%3A%2F%2Fwww.google.com%2Furl%3Fclient%3Dinternal-element-cse%26cx%3D011782314020777428663%3Aycznkklrfq5%26q%3Dhttps%3A%2F%2Finews.co.uk%2Ftopic%2Ftaxes%26sa%3DU%26ved%3D2ahUKEwjHrsrtht2NAxUKRKQEHbOOLnQQFnoECAcQAQ%26usg%3DAOvVaw3fT0fa1aoxosj7cjXx6vWb&amp;xs=1&amp;xtz=-60&amp;xuuid=e6529002e383c6e51477c2c12f04c24b&amp;xjsf=other_click__auxclick%20%5B2%5D\" target=\"_blank\" rel=\"noopener\">legal and tax processes<\/a>.<\/p>\n<p>\u201cThis means legal personal representatives will face an even greater challenge in gathering information from multiple pension schemes.<\/p>\n<p>\u201cThese delays, coupled with additional responsibilities, make an already difficult situation even more complex.\u201d<\/p>\n<p>New research from Canada Life shows how fraught the process already is, with 28 per cent of people surveyed having trouble finding documents like pension or <a href=\"https:\/\/go.skimresources.com\/?id=55199X1622456&amp;isjs=1&amp;jv=15.7.1&amp;sref=https%3A%2F%2Finews.co.uk%2Fsearch%3Fq%3Dpension%23gsc.tab%3D0%26gsc.q%3Dinsurance%26gsc.sort%3D%26gsc.page%3D2&amp;url=https%3A%2F%2Fwww.google.com%2Furl%3Fclient%3Dinternal-element-cse%26cx%3D011782314020777428663%3Aycznkklrfq5%26q%3Dhttps%3A%2F%2Finews.co.uk%2Ftopic%2Finsurance%26sa%3DU%26ved%3D2ahUKEwiAhdL4ht2NAxVWW0EAHVhWGrs4ChAWegQIBBAB%26usg%3DAOvVaw0lvAmECg1cxREW-Fp0jGWB&amp;xs=1&amp;xtz=-60&amp;xuuid=e6529002e383c6e51477c2c12f04c24b&amp;xjsf=other_click__auxclick%20%5B2%5D\" target=\"_blank\" rel=\"noopener\">insurance policies<\/a>.<\/p>\n<p>Another 27 per cent struggled to gather information from companies about debts, assets or bills. A quarter said the probate process took an emotional toll.<\/p>\n<p>The financial cost could rise sharply once the changes come in, Mr Greer said. <a class=\"post_in-line_link\" href=\"https:\/\/inews.co.uk\/topic\/hmrc?ico=in-line_link\" target=\"_blank\" rel=\"noopener\">HMRC proposes<\/a> charging interest on unpaid IHT after six months \u2013 currently at 8.25 per cent \u2013 even if delays aren\u2019t the fault of the family.<\/p>\n<p>Currently, on average, probate typically takes four to six weeks, but that\u2019s \u201ccertainly\u201d set to increase if more applications require additional checks, Mike Davis, managing director at My Probate Partner, said.<\/p>\n<p>With more estates set to be pulled into the IHT net, experts say the time to prepare is now \u2013 before the system becomes even more strained.<\/p>\n<p>Nick Flynn, retirement income director at Canada Life, said: \u201cTestators or owners of wills should have open conversations with their chosen executors \u2013 and where possible, seek advice from a financial adviser \u2013 to ensure everyone involved is well informed and equipped to navigate the process ahead.\u201d<\/p>\n<p>Mr Greer said being organised can include simple things such as keeping track of your pension savings, as well as using trusts during someone\u2019s lifetime, moving assets out of the estate so that they\u2019re not part of the probate process.<\/p>\n<p>He said: \u201cFor example, you can place life insurance policies in trust.
