But with the growing backlogs and the looming <a href=\"https:\/\/www.cityam.com\/people-and-organizations\/employment-rights-bill\/\" target=\"_blank\" rel=\"noopener\">Employment Rights Bill,<\/a> there are calls on the Government to intervene before the Tribunal\u2019s situation worsens.<\/p>\n<p>The open caseload at the Employment Tribunal increased by 32 per cent from January to March 24\/25 compared to the same quarter last year, as outlined by the Ministry of Justice (MoJ).<\/p>\n<p>The <a href=\"https:\/\/www.gov.uk\/government\/statistics\/tribunals-statistics-quarterly-january-to-march-2025\/tribunal-statistics-quarterly-january-to-march-2025#employment-tribunals\" target=\"_blank\" rel=\"noopener\">quarterly stats<\/a> revealed the Tribunal received 42,000 single claim receipts and disposed of 32,000 single claim cases. And at the end of March, there were 45,000 single claims opened.<\/p>\n<p>The Employment Lawyers Association (ELA) has called on the Government to allocate resources to Tribunals before the Employment Rights Bill comes into force as early as Spring 2026.<\/p>\n<p>Speaking to City AM, Caspar Glyn KC, Chair of the ELA, said: \u201cThe past figures are of real concern, but of yet more concern is the future.\u201d<\/p>\n<p>\u201cUnfair dismissal cases make up the largest part of the caseload, at 22 per cent, but today, an employee has to wait to be employed for two years to issue such a claim.\u201d<\/p>\n<p>Spending Review investment <\/p>\n<p><a href=\"https:\/\/www.cityam.com\/labour-pulls-back-from-day-one-protections-as-it-unveils-workers-rights-overhaul\/\" target=\"_blank\" rel=\"noopener\">One of the 28 reforms<\/a> in the new bill, if passed, means employees can issue claims on the first day of employment, compared to the current system of two years of service.<\/p>\n<p>\t\t\t\t\tRead more<\/p>\n<p>\t\t\t<a class=\"read-more__link\" href=\"https:\/\/www.cityam.com\/tribunal-backlog-worsens-ahead-of-employment-reforms\/\" target=\"_blank\" rel=\"noopener\">Tribunal backlog worsens ahead of employment reforms<\/a><\/p>\n<p>The new right is expected to trigger a significant wave of litigation against businesses.<\/p>\n<p>With the current backlog at the Tribunal, Glyn KC stated, \u201cThe evidence is clear.
