{"id":181634,"date":"2025-06-13T17:26:12","date_gmt":"2025-06-13T17:26:12","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/181634\/"},"modified":"2025-06-13T17:26:12","modified_gmt":"2025-06-13T17:26:12","slug":"acting-head-of-us-employment-rights-agency-failing-to-protect-trans-and-nonbinary-workers-democrats-say-democrats","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/181634\/","title":{"rendered":"Acting head of US employment rights agency failing to protect trans and nonbinary workers, Democrats say | Democrats"},"content":{"rendered":"<p class=\"dcr-16w5gq9\"><a href=\"https:\/\/www.theguardian.com\/us-news\/democrats\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">Democrats<\/a> are demanding the acting chair of the Equal Employment Opportunity Commission enforce civil rights protections for transgender and nonbinary people.<\/p>\n<p class=\"dcr-16w5gq9\">A letter to Andrea Lucas, a copy of which was viewed by the Guardian, alleges the agency has \u201cabdicated this responsibility under the law when it comes to transgender and nonbinary workers\u201d.<\/p>\n<p class=\"dcr-16w5gq9\">The letter cites that shortly after Lucas\u2019s appointment as acting chair of the EEOC in January 2025, Lucas instructed the agency to halt the processing of claims related to gender identity discrimination, and that in April 2025 the agency instructed all employees to classify gender identity discrimination complaints as its lowest priority.<\/p>\n<p class=\"dcr-16w5gq9\">\u201cA categorization reserved for meritless charges \u2013 which essentially puts the processing of such complaints in an indefinite hold,\u201d the letter states.<\/p>\n<p class=\"dcr-16w5gq9\">The letter also notes the EEOC moved to dismiss six cases the agency had previously pursued against employers accused of gender identity discrimination, including EEOC v Boxwood Hotels, a <a href=\"https:\/\/www.eeoc.gov\/newsroom\/eeoc-sues-boxwood-and-related-hotel-franchises-discriminating-against-transgender-employee\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">lawsuit<\/a> in which the employer is alleged to have fired a transgender employee after the employee\u2019s manager repeatedly misgendered the employee and referred to them as \u201cit\u201d.<\/p>\n<p class=\"dcr-16w5gq9\">Signers of the letter include 70 members of Congress, led by Congressman Mark Takano, Robert C \u201cBobby\u201d Scott and Suzanne Bonamici. The letter comes as state legislatures in the US introduced <a href=\"https:\/\/www.americanprogress.org\/article\/the-lgbtqi-community-reported-high-rates-of-discrimination-in-2024\/\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">over 530 bills<\/a> targeting LGBTQ+ people in 2024.<\/p>\n<p class=\"dcr-16w5gq9\">The EEOC also removed the \u201cx\u201d gender marker on intake forms, removed materials on rights and protections on gender identity discrimination, and issued a memorandum informing fair employment practices agencies that they will not receive credit for intakes or resolutions related to gender identity, the letter added.<\/p>\n<p class=\"dcr-16w5gq9\">\u201cAlarmingly, in both the commission\u2019s filings in court and in your previous statements, you have invoked President Trump\u2019s sweeping executive order, which states it is the policy of the federal government to only recognize two sexes and seeks to have all agencies refuse to acknowledge the existence of transgender people,\u201d the letter continued.<\/p>\n<p class=\"dcr-16w5gq9\">\u201cThe commission is supposed to be an independent agency, and as a commissioner and its acting chair, your job is to enforce the law. The supreme court\u2019s ruling in Bostock is the law of the land, and the commission\u2019s previous cases, including Macy v Holder, Jameson v US postal service and Lusardi v Department of the Army, are binding precedents on the agency.
