Last week, <a data-link-tracking=\"InArticle|Link\" href=\"https:\/\/www.express.co.uk\/news\/uk\/2066418\/eu-plotting-biggest-change-air\" target=\"_blank\" rel=\"noopener\">EU transport ministers approved<\/a> a draft reform of EU Regulation 261\/2004, the bedrock of air passenger rights across Europe for the past two decades.\u00a0The UK\u2019s own regulation, UK261, currently replicates EU261 almost word for word.<\/p>\n<p>There are now concerns that the UK will amend its own regulations, leading to a &#8220;backwards&#8221; step in British air passengers\u2019 rights. Anton Radchenko, an expert in passenger rights and CEO of <a data-link-tracking=\"InArticle|Link\" href=\"https:\/\/airadvisor.com\/en\" rel=\"nofollow noopener\" target=\"_blank\">AirAdvisor<\/a>, said airline regulation reforms would particularly impact medium and <a data-link-tracking=\"InArticle|Link\" title=\"&#039;Little-talked-about central Asian state about to ruffle Moscow&#039;s feathers&#039;\" href=\"https:\/\/www.express.co.uk\/news\/world\/2067642\/central-asian-state-moscow\" target=\"_blank\" rel=\"noopener\">long distances across Europe<\/a>. He told the Express: &#8220;We are moving backwards, at a time when flight delays and disruptions are increasing across the continent.<\/p>\n<p>&#8220;According to estimates by AirAdvisor, over 60% of air passengers will see their rights diminished, even when clearly harmed by cancellations, delays and abusive new fees charged by airlines.&#8221;<\/p>\n<p>The move by the EU may significantly reduce compensation eligibility, weaken accountability, and open the door to new passenger fees \u2013 like <a data-link-tracking=\"InArticle|Link\" title=\"Brits travelling to Spain warned over new charge for cabin bags\" href=\"https:\/\/www.express.co.uk\/news\/uk\/2066174\/brits-travelling-spain-warned-new-rules\" target=\"_blank\" rel=\"noopener\">cabin baggage charges<\/a>.<strong><br \/><\/strong><\/p>\n<p>The proposed reform, which now goes to the European Parliament, redefines free hand luggage as a personal item no larger than 40x30x15 cm that must fit under the seat in front.<\/p>\n<p>Mr Radchenko explained that, if the proposal is accepted, compensation for long-haul flight delays or cancellations is set to be reduced from \u20ac600 to \u20ac500.<\/p>\n<p>Compensation would also be standardised at \u20ac300 for all flights under 3,500km, replacing the existing \u20ac250 and \u20ac400 levels.<\/p>\n<p>Passengers on long-haul routes would only be eligible for compensation after six hours of delay, and those on shorter routes after four hours, up from the current three-hour rule.<\/p>\n<p>He added: &#8220;If approved, the new rules will leave millions of consumers unprotected against the increasingly frequent problems in European aviation, opening the door to airline abuses and undermining trust in the bloc\u2019s air transport system.<\/p>\n<p>&#8220;The proposal approved by EU ministers dilutes or removes key protections, including the right to <a data-link-tracking=\"InArticle|Link\" title=\"UK travellers to face delays until November 2025 at EU borders\" href=\"https:\/\/www.express.co.uk\/travel\/articles\/2064020\/uk-travellers-eu-borders-face-delays-until-november-2025\" target=\"_blank\" rel=\"noopener\">compensation for delays<\/a> of three hours or more.\u00a0<\/p>\n<p>&#8220;This sets a dangerous precedent where delays may become routine and airlines will no longer be penalised. The current rules exist to maintain order and accountability in the sector.<\/p>\n<p>&#8220;The three-hour delay threshold has long been a global standard holding airlines responsible.
