{"id":198115,"date":"2025-06-19T21:11:08","date_gmt":"2025-06-19T21:11:08","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/198115\/"},"modified":"2025-06-19T21:11:08","modified_gmt":"2025-06-19T21:11:08","slug":"google-faces-uphill-fight-in-appealing-4-billion-eu-fine","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/198115\/","title":{"rendered":"Google Faces Uphill Fight in Appealing $4 Billion EU Fine"},"content":{"rendered":"<p><a class=\"editor-rtfLink\" href=\"https:\/\/www.google.com\/\" target=\"_blank\" rel=\"noopener\">Google<\/a> has reportedly been dealt a setback in trying to overturn a record European antitrust fine.<\/p>\n<p>As the Financial Times (FT) <a class=\"editor-rtfLink\" href=\"https:\/\/www.ft.com\/content\/cd63dd58-37a6-4af8-8050-40b7405da2bb\" target=\"_blank\" rel=\"noopener\">reported<\/a> Thursday (June 19), that\u2019s because an adviser to the European Union\u2019s top court has sided with regulators who found that Google had used its Android mobile phone operating system to stifle competition from rivals.<\/p>\n<p><a href=\"https:\/\/www.srb.europa.eu\/en\/content\/juliane-kokott\" target=\"_blank\" rel=\"noopener\">Juliane Kokott<\/a>, advocate-general of the European Court of Justice (ECJ), the EU\u2019s highest court, found that a \u20ac4.12 billion ($4.7 billion) fine <a class=\"editor-rtfLink\" href=\"https:\/\/www.pymnts.com\/cpi-posts\/google-appeals-record-e4-12-billion-eu-antitrust-fine-over-android\/\" target=\"_blank\" rel=\"noopener\">issued against the tech giant<\/a> in 2018 by the European Commission should be upheld.<\/p>\n<p>The FT report said that while Kokott\u2019s view is not legally binding, the ECJ tends to follow these options. The court is expected to rule in the coming months, the report added.<\/p>\n<p>\u201cGoogle held a <a class=\"editor-rtfLink\" href=\"https:\/\/www.pymnts.com\/cpi-posts\/googles-antitrust-troubles-demonstrate-the-need-for-a-digital-regulator\/\" target=\"_blank\" rel=\"noopener\">dominant position<\/a> in several markets of the Android ecosystem and thus benefited from network effects that enabled it to ensure that users used Google Search,\u201d said Kokott. \u201cAs a result, Google obtained access to data that enabled it to turn to improve its service.\u201d<\/p>\n<p>A spokesperson for Google told the FT the company was \u201cdisappointed\u201d with the opinion, adding that \u201cAndroid has created more choice for everyone and supports thousands of successful businesses in Europe and around the world.\u201d\u00a0<\/p>\n<p>The victory here is a boost for the European Commission, the report added, as it seeks to enforce stricter regulations on the world\u2019s biggest tech companies.<\/p>\n<p>Another one of those companies is also trying to overturn an EC ruling. Apple last month filed an <a class=\"editor-rtfLink\" href=\"https:\/\/www.pymnts.com\/apple\/2025\/apple-appeals-european-commission-order-on-interoperability-with-competitors-products\/\" target=\"_blank\" rel=\"noopener\">appeal<\/a> against an order requiring the company to make its iOS operating system more compatible with other companies\u2019 products.<\/p>\n<p>The company filed its appeal with the EU\u2019s General Court in Luxembourg, The Wall Street Journal (WSJ) reported earlier this month.<\/p>\n<p>A spokesperson for Apple told WSJ that the EU\u2019s interoperability requirements threaten the user experience delivered by the way the company\u2019s technology works together and forces the company to share sensitive information with rivals.<\/p>\n<p>\u201cCompanies have already requested our users\u2019 most sensitive data \u2014 from the content of their notifications, to a full history of every stored Wi-Fi network on their device \u2014 giving them the ability to access personal information that even Apple doesn\u2019t see,\u201d the spokesperson said.<\/p>\n<p>The EC has said that \u2014 to comply with Europe\u2019s <a class=\"editor-rtfLink\" href=\"https:\/\/www.pymnts.com\/tag\/digital-markets-act\/\" target=\"_blank\" rel=\"noopener\">Digital Markets Act<\/a> \u2014 Apple needs to give device manufacturers and app developers more access to iPhone features that interact with smartwatches, headphones or TVs.<\/p>\n","protected":false},"excerpt":{"rendered":"Google has reportedly been dealt a setback in trying to overturn a record European antitrust fine.
