Australia\u2019s smallest state is marketed for its \u201cclean and green\u201d environment and produce, and the government runs tourism campaigns with the tagline <a href=\"https:\/\/www.tourismtasmania.com.au\/marketing\/campaigns\/brand-launch\/\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">\u201ccome down for air\u201d<\/a> that lean heavily on its stunning landscapes, coastlines and wildlife.<\/p>\n<p class=\"dcr-16w5gq9\">But the state also has a hard-earned reputation for backing environmentally damaging industries that grab national, and sometimes international, attention: hydroelectric dam expansion, logging of old-growth forests and, most recently, salmon farming.<\/p>\n<p class=\"dcr-16w5gq9\">The response to criticism of these industries often includes a reference to more than half of the state being protected in either public or private reserves. It\u2019s a good line, but one that doesn\u2019t survive much scrutiny. The Tasmanian world heritage wilderness covers about 20% of the state, but development, logging and mining are allowed in some areas counted as protected.<\/p>\n<p class=\"dcr-16w5gq9\">Where the line is deployed, it is mostly to suggest that nature already gets a pretty good run and environment protection should be reduced. The Liberal state government used it to defend a yet-to-be-delivered policy of <a href=\"https:\/\/www.theguardian.com\/environment\/2024\/dec\/12\/maps-reveal-parts-of-protected-tasmanian-native-forest-that-could-be-open-to-logging-environmentalists-say\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">opening up nearly 40,000 hectares of protected forests for logging<\/a> \u2013 a step that would reduce the amount of the state that is in protected reserves to less than 50%, and that even some members of the timber industry <a href=\"https:\/\/www.theguardian.com\/australia-news\/2024\/feb\/29\/tasmanian-premier-jeremy-rockliff-pledges-to-open-protected-native-forests-to-logging\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">say makes little sense<\/a>.<\/p>\n<p class=\"dcr-16w5gq9\">On Saturday, the Tasmanian Labor leader, Dean Winter, rolled out the line out as he launched an equally remarkable policy before the state election on 19 July: that the state\u2019s industries should not have to answer to Australia\u2019s environment laws.<\/p>\n<p class=\"dcr-16w5gq9\">To be fair, that\u2019s not how he put it. Winter said he would make a case to the federal environment minister, Murray Watt, that industries including salmon farming, energy and mining should be granted a similar exemption from the national Environment Protection and Biodiversity <a href=\"https:\/\/www.theguardian.com\/environment\/conservation\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" target=\"_blank\" rel=\"noopener\">Conservation<\/a> (EPBC) Act that has been granted to native forestry.<\/p>\n<p class=\"dcr-16w5gq9\">In his view, it would allow industries to be assessed through a \u201cstreamlined single regulatory framework\u201d. He said it would not mean that laws were bypassed, only that environmental assessments weren\u2019t duplicated.<\/p>\n<p class=\"dcr-16w5gq9\"><a href=\"https:\/\/www.theaustralian.com.au\/nation\/politics\/tasmanian-labor-leader-dean-winter-urges-pm-to-adopt-radical-forestrystyle-plan-to-cut-green-tape\/news-story\/b886b7b8471e46ac6949b19415c2a2a9\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">In an interview with The Australian<\/a>, Winter said this approach \u201cworks well\u201d for forestry. He suggested it would have led to faster approvals<strong> <\/strong> on some long-running contentious proposals, including a windfarm planned for an environmentally sensitive island used by migratory birds, a tailings dam on the edge of the Tarkine wilderness, and salmon farming in Macquarie harbour.<\/p>\n<p class=\"dcr-16w5gq9\">The Liberal government, led by premier Jeremy Rockliff, pumped out a press release saying it also wanted faster approvals, accusing Winter of stealing a policy it released earlier this year.<\/p>\n<p class=\"dcr-16w5gq9\">Both parties have a point. It is widely acknowledged that the EPBC Act is not fit for purpose. Decisions on some developments have taken longer than necessary.<\/p>\n<p class=\"dcr-16w5gq9\">On the other hand, some developments are problematic and shouldn\u2019t be approved quickly, or at all. It says something about the debate that this even needs saying, but: environment laws should protect the environment.<\/p>\n<p class=\"dcr-16w5gq9\">A 2021 five-yearly state of the environment report found that wasn\u2019t happening \u2013 that nature was <a href=\"https:\/\/www.theguardian.com\/environment\/2022\/jul\/19\/labor-says-it-wont-put-head-in-the-sand-as-it-releases-shocking-environment-report\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">in poor and deteriorating health<\/a>, in part because forest and other vegetation has continued to be knocked down without proper oversight.<\/p>\n<p class=\"dcr-16w5gq9\">Where do Winter\u2019s claims about native forest logging fit into this? Awkwardly, at best.<\/p>\n<p class=\"dcr-16w5gq9\">The exemption for logging in the EPBC Act is included in regional forest agreements signed between the Commonwealth and individual states. Small problem: the states have not always lived up to their commitments.<\/p>\n<p class=\"dcr-16w5gq9\">In 2006, then Australian Greens leader Bob Brown won a federal court case against Forestry Tasmania over its failure to protect three endangered species. It didn\u2019t last &#8211; the wording of the agreement was changed to prevent further challenges, and the judgment overturned &#8211; but more cases followed. He concluded there were \u201cfundamental shortcomings\u201d in how the system was working and significant change was needed. He called for the introduction of national environmental standards \u2013 benchmarks against which major operations, including logging, would be measured \u2013 and an accreditation system that included \u201cstrong Commonwealth oversight\u201d.<\/p>\n<p class=\"dcr-16w5gq9\">In other words, Samuel found the current system wasn\u2019t actually \u201cworking well\u201d. The former federal environment minister, Tanya Plibersek, agreed that a revamp of the EPBC Act should include national environmental standards <a href=\"https:\/\/www.theguardian.com\/australia-news\/2023\/may\/25\/nationals-and-cfmeu-dig-in-behind-native-logging-in-nsw-despite-government-analysis-supporting-closure\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">being applied to regional forest agreements<\/a>.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" alt=\"Bogong moths and the traditional owners scaling mountains to track them \u2013 video\" src=\"https:\/\/www.europesays.com\/uk\/wp-content\/uploads\/2025\/06\/1750702990_120_1919.jpg\" height=\"259\" width=\"460\" class=\"dcr-1qi2at0\"\/>Bogong moths and the traditional owners scaling mountains to track them \u2013 video<\/p>\n<p class=\"dcr-16w5gq9\">That revamp is still yet to happen. The work to re-write the laws was delayed in the last parliamentary term, and is now starting again under the new minister.<\/p>\n<p class=\"dcr-16w5gq9\">It is too soon to know where Watt will land on the forestry exemption, and a range of other issues. For the moment he is sticking to federal Labor\u2019s mantra \u2013 that a deal can be reached to satisfy industry and conservation advocates.<\/p>\n<p class=\"dcr-16w5gq9\">Quite how that will happen, given the evidence of environmental decline and the extent to which it is disregarded by those who wear being anti-green as a badge of honour, is difficult to imagine. Not impossible. But difficult.<\/p>\n<p class=\"dcr-16w5gq9\">Speaking before he met interest groups last week, Watt says he thought environmental standards would be a necessary part of it, but he had an open mind. The Tasmanian debate is playing out in parallel to this, but an air of unreality hangs over <a href=\"https:\/\/www.theguardian.com\/australia-news\/2025\/jun\/07\/tasmanian-parliament-politics-confusion-chaos\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">what most people agree is an unnecessary early election<\/a>.<\/p>\n<p class=\"dcr-16w5gq9\">Neither major party has explained why they implicitly disagree with Samuel on regional forest agreements. Neither has levelled with the public about the economic decline of the native forestry industry, other than to promise they will support jobs in what Winter calls \u201ctraditional industries\u201d. Meanwhile, nearly 90% of Australian timber <a href=\"https:\/\/www.theguardian.com\/australia-news\/2023\/jul\/26\/labor-push-for-publicly-owned-plantations-to-end-native-forest-logging\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">comes from plantations<\/a>.<\/p>\n<p class=\"dcr-16w5gq9\">Both parties say they won\u2019t deal with the Greens, who go into the election with five out of 35 MPs and a good chance of again being a key balance-of-power player. And a <a href=\"https:\/\/www.planning.tas.gov.au\/other-resources\/state-of-the-environment\/state-of-the-environment-report-2024\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">Tasmanian state of the environment report<\/a> released last year gathers dust.<\/p>\n<p class=\"dcr-16w5gq9\">It told a similar story to the national report \u2013 that, on a majority of indicators, nature in the state was in poor or declining health. The Liberals <a href=\"https:\/\/nre.tas.gov.au\/Documents\/Tasmanian%20Government%20Response%20to%20the%202024%20State%20of%20the%20Environment%20Report.pdf\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">accepted only six of the report\u2019s 16 recommendations in full<\/a> and announced no new policies to address the problems identified.
