{"id":216149,"date":"2025-06-26T15:02:09","date_gmt":"2025-06-26T15:02:09","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/216149\/"},"modified":"2025-06-26T15:02:09","modified_gmt":"2025-06-26T15:02:09","slug":"top-court-backs-amnesty-for-catalan-separatists-dw-06-26-2025","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/216149\/","title":{"rendered":"Top court backs amnesty for Catalan separatists \u2013 DW \u2013 06\/26\/2025"},"content":{"rendered":"<p><a class=\"internal-link\" href=\"https:\/\/www.dw.com\/en\/spain\/t-18996264\" target=\"_blank\" rel=\"noopener\">Spain<\/a>&#8216;s Constitutional Court on Thursday upheld key provisions of a disputed amnesty law for Catalan separatists involved in a failed 2017 push for the <a class=\"internal-link\" href=\"https:\/\/www.dw.com\/en\/catalonia\/t-38779987\" target=\"_blank\" rel=\"noopener\">Catalonia&#8217;s<\/a> independence.<\/p>\n<p>Under the\u00a0law, more than 300 people have been pardoned.<\/p>\n<p>&#8220;This is magnificent news for Spain,&#8221; Prime Minister Pedro Sanchez told reporters in Brussels, adding that the amnesty served &#8220;to guarantee Spain&#8217;s unity as well as our development and prosperity and coexistence between citizens and regions.&#8221;<\/p>\n<p>In 2023, Sanchez&#8217;s <a class=\"internal-link\" href=\"https:\/\/www.dw.com\/en\/spains-socialists-nudge-towards-power-with-catalan-amnesty\/a-67355710\" target=\"_blank\" rel=\"noopener\">Socialist Party agreed to an amnesty<\/a> with two Catalan separatist parties. The agreement was made in exchange for their support in a parliamentary vote, which allowed <a class=\"internal-link\" href=\"https:\/\/www.dw.com\/en\/spain-pedro-sanchez-secures-new-term-in-divided-country\/a-67414406\" target=\"_blank\" rel=\"noopener\">Sanchez to remain prime minister<\/a> after the elections resulted in a hung parliament.<\/p>\n<p>Last year, <a class=\"internal-link\" href=\"https:\/\/www.dw.com\/en\/spain-gives-final-approval-to-catalan-amnesty-bill\/a-69222400\" target=\"_blank\" rel=\"noopener\">lawmakers narrowly approved the bill<\/a>, but the conservative opposition has deemed the legislation unconstitutional. They claim it was passed solely as a Socialist maneuver to ensure their continued rule.<\/p>\n<p>Court rejects most points of the\u00a0appeal<\/p>\n<p>The Constitutional Court announced that it had rejected most points of an appeal by the opposition conservative People&#8217;s Party (PP) against the amnesty&#8217;s constitutionality by a vote of six to four.<\/p>\n<p>&#8220;Amnesty is not banned by the Constitution, and its adoption, when it responds to an exceptional situation and a legitimate public interest, may be constitutionally admissible,&#8221; the court,\u00a0 which has a majority of judges nominated by the Socialists, said in a statement.<\/p>\n<p>The Constitutional Court&#8217;s ruling offers some relief to Sanchez and his Socialist Party, which has been caught up in <a class=\"internal-link\" href=\"https:\/\/www.dw.com\/en\/spanish-prime-minister-pedro-sanchez-says-he-will-not-resign\/a-68944683\" target=\"_blank\" rel=\"noopener\">corruption allegations<\/a> involving senior officials.<\/p>\n<p>PP leader Alberto Nunez Feijoo denounced the amnesty as &#8220;a corrupt transaction of impunity in exchange for power&#8221; and &#8220;an attack against the separation of powers.&#8221;<\/p>\n<p>Catalan independence &#8211; Society divided by a dream<video id=\"video-66183802\" controls=\"\" playsinline=\"\" preload=\"none\" poster=\"data:image\/png;base64,iVBORw0KGgoAAAANSUhEUgAAAAEAAAABCAQAAAC1HAwCAAAAC0lEQVR42mNkYAAAAAYAAjCB0C8AAAAASUVORK5CYII=\" data-id=\"66183802\" data-posterurl=\"https:\/\/static.dw.com\/image\/66139834_605.webp\" data-duration=\"28:36\"><\/p>\n<p class=\"vjs-no-js\">To view this video please enable JavaScript, and consider upgrading to a web browser that <a href=\"https:\/\/videojs.com\/html5-video-support\/\" target=\"_blank\" rel=\"noopener\">supports HTML5 video<\/a><\/p>\n<p><\/video><\/p>\n<p>Puigdemont will not benefit from amnesty<\/p>\n<p>The Constitutional Court ruling does not directly benefit <a class=\"internal-link\" href=\"https:\/\/www.dw.com\/en\/carles-puigdemont\/t-43237728\" target=\"_blank\" rel=\"noopener\">Carles Puigdemont<\/a>, the former Catalan separatist leader who fled abroad to avoid prosecution after leading Catalonia&#8217;s regional administration during the 2017 referendum. He currently lives in self-imposed exile in Belgium.<\/p>\n<p>The judge handling Puigdemont&#8217;s case said the amnesty does not apply to him because he is also being sued for embezzlement in diverting funds for the referendum, a charge he denies.<\/p>\n<p>Puigdemont has appealed the decision, saying that the funds earmarked for the referendum were not for his personal gain.\u00a0According to a court spokesperson, the Constitutional Court will not rule on the matter until later this year or next.<\/p>\n<p>The separatist leader was Catalonia&#8217;s head of government in 2017, when the region unilaterally declared independence from Spain.
