{"id":219115,"date":"2025-06-27T17:06:11","date_gmt":"2025-06-27T17:06:11","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/219115\/"},"modified":"2025-06-27T17:06:11","modified_gmt":"2025-06-27T17:06:11","slug":"us-supreme-court-rules-key-provision-of-obamacare-constitutional-us-supreme-court","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/219115\/","title":{"rendered":"US supreme court rules key provision of Obamacare constitutional | US supreme court"},"content":{"rendered":"<p class=\"dcr-16w5gq9\">The <a href=\"https:\/\/www.theguardian.com\/law\/us-supreme-court\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">US supreme court<\/a> has ruled that a key provision of \u201cObamacare\u201d, formally known as <a href=\"https:\/\/www.theguardian.com\/us-news\/2021\/jun\/17\/us-supreme-court-obamacare-decision\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">the Affordable Care Act<\/a>, is constitutional. The case challenged how members of an obscure but vital healthcare committee are appointed.<\/p>\n<p class=\"dcr-16w5gq9\">The committee, the US Preventive Services Task Force (USPSTF), is a panel of 16 volunteer health experts who determine which evidence-based preventive health services private insurance companies must cover without cost for patients.<\/p>\n<p class=\"dcr-16w5gq9\">The requirement is a provision of the ACA \u2013 and one of the few instances when privately insured American patients pay nothing for healthcare.<\/p>\n<p class=\"dcr-16w5gq9\">The case, \u201cin line with other court decisions, strengthens the control of political appointees over the bureaucracy\u201d, said Dorit Reiss, a University of California San Francisco law professor and an expert in health law and vaccine policy.<\/p>\n<p class=\"dcr-16w5gq9\">The case, formally called Kennedy v Braidwood Management, Inc, affirms that final decisions come by secretaries, in this case health secretary Robert F Kennedy Jr, a known vaccine skeptic.<\/p>\n<p class=\"dcr-16w5gq9\">\u201cThis makes it harder for Congress to isolate expert decisions from political review. So the stakes in appointing the political heads \u2013 in this case the secretary \u2013 are very, very high,\u201d said Reiss.<\/p>\n<p class=\"dcr-16w5gq9\">While the court affirms the constitutionality of the task force itself, it also held that members force can be removed at will by the health secretary, and that the secretary may review the task force\u2019s recommendations before they take effect.<\/p>\n<p class=\"dcr-16w5gq9\">Kennedy used those powers only this June, when he <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/jun\/11\/rfk-jr-new-vaccine-advisers-panel\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">unilaterally fired<\/a> all sitting members of a critical vaccine advisory panel, and remade the panel with <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/jun\/13\/eight-new-cdc-vaccine-advisers-robert-f-kennedy\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">ideological allies<\/a>. The new panel members then delivered Kennedy a victory by recommending against a vaccine preservative called thimerosal, despite a scientific consensus that the ingredient was safe.<\/p>\n<p class=\"dcr-16w5gq9\">The court issued the opinion in a 6-3 ruling. The opinion was written by Justice Brett Kavanaugh, and joined by John Roberts, Sonya Sotomayor, Elena Kagan, Amy Coney Barrett and Ketanji Brown Jackson.<\/p>\n<p class=\"dcr-16w5gq9\">In 2020 alone, an estimated 150 million Americans benefitted from the preventive healthcare provision, according to the <a href=\"https:\/\/oneill.law.georgetown.edu\/scotus-preview-braidwood-and-the-fate-of-preventive-services-under-the-aca\/\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">O\u2019Neill Institute<\/a> at the Georgetown University law center in Washington DC. Although the provision requires insurers to cover a wide range of services \u2013 from annual check-ups to cancer screenings and immunizations \u2013 the case centered on the provision of Prep, or pre-exposure prophylaxis for HIV.<\/p>\n<p class=\"dcr-16w5gq9\">A small group of plaintiffs claimed provision of PrEP violated their religious beliefs. They were represented by <a href=\"https:\/\/www.theguardian.com\/world\/2021\/oct\/10\/texas-abortion-law-jonathan-f-mitchell-profile\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">Jonathan Mitchell<\/a>, the former solicitor general of Texas who pioneered the state\u2019s \u201c<a href=\"https:\/\/www.theguardian.com\/commentisfree\/2021\/sep\/02\/sonia-sotomayor-dissent-texas-abortion-ban-law-supreme-court\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">bounty hunter<\/a>\u201d abortion law.<\/p>\n<p class=\"dcr-16w5gq9\">Their arguments were backed by Republican and conservative groups, although the specific ACA provision was defended by both the Trump and Biden administrations. Major public health groups, hospitals, disease advocacy groups and Democratic attorneys general opposed ending the provision.<\/p>\n<p class=\"dcr-16w5gq9\">Although the court affirmed the constitutionality of the panel, it also affirms that any health secretary, including Kennedy, could remake the panel with allies.<\/p>\n<p class=\"dcr-16w5gq9\">The secretary could \u201coverride experts experts\u2019 conclusions and remove things like PeEP\u201d, said Reiss. However, she added that the power was not \u201cabsolute\u201d. If the secretary\u2019s recommendation contravened the decision of an expert panel and there was a lawsuit, the secretary would still need to make \u201ca convincing case that there was a reason to deviate from the panel, if there is a lawsuit\u201d, said Reiss.<\/p>\n<p class=\"dcr-16w5gq9\">That has left groups who advocate for healthcare access for HIV and Aids patients, such as the Aids Institute, to say it \u201ccelebrates\u201d the decision while acknowledging uncertainty about the future.<\/p>\n<p class=\"dcr-16w5gq9\">\u201cI think we have to be worried about what that means for future USPSTF decisions given what has happened with\u201d the vaccine panel, said Rachel Klein, the deputy executive director of the Aids Institute.<\/p>\n<p class=\"dcr-16w5gq9\">\u201cKnowing what preventive care is effective to keeping people healthy \u2013 and therefore cost-effective to cover \u2013 is crucial to helping people be as healthy as possible. That requires listening to medical and scientific experts.
