{"id":224827,"date":"2025-06-29T20:10:28","date_gmt":"2025-06-29T20:10:28","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/224827\/"},"modified":"2025-06-29T20:10:28","modified_gmt":"2025-06-29T20:10:28","slug":"uk-smoking-ban-risks-breaching-post-brexit-deal-ex-tory-justice-secretary-warns-3","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/224827\/","title":{"rendered":"UK smoking ban risks breaching post-Brexit deal, ex-Tory justice secretary warns"},"content":{"rendered":"<p><a href=\"https:\/\/www.independent.co.uk\/topic\/keir-starmer\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Keir Starmer;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Keir Starmer<\/a>\u2019s flagship smoking ban risks breaching a key post-Brexit deal with the <a href=\"https:\/\/www.independent.co.uk\/topic\/eu\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:European Union;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">European Union<\/a> and is \u201cheading straight for the courts\u201d, a former Tory justice secretary has warned.<\/p>\n<p><a href=\"https:\/\/www.independent.co.uk\/topic\/robert-buckland\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Robert Buckland;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Robert Buckland<\/a> says he was initially supportive of the plans, which will see Britain ban <a href=\"https:\/\/www.independent.co.uk\/topic\/smoking\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:smoking;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">smoking <\/a><a href=\"https:\/\/www.independent.co.uk\/news\/uk\/bill-wes-streeting-prime-minister-rishi-sunak-mps-b2529467.html\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:for an entire generation;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">for an entire generation<\/a>.<\/p>\n<p>But now he says the government \u201cmust hit pause\u201d or risk a legal car crash.<\/p>\n<p>Under the plans anyone currently aged 15 or younger will never be able to buy cigarettes legally, as <a href=\"https:\/\/www.independent.co.uk\/life-style\/smoking-ban-generation-alpha-vote-b2529470.html\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:the UK slowly becomes a smoke-free country.;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">the UK slowly becomes a smoke-free country.<\/a><\/p>\n<p>The idea was launched with great fanfare by <a href=\"https:\/\/www.independent.co.uk\/topic\/rishi-sunak\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Rishi Sunak;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Rishi Sunak<\/a>, but enthusiastically backed by Labour when the Tories were kicked out of power last summer.<\/p>\n<p><img decoding=\"async\" class=\"caas-img caas-lazy has-preview\" alt=\"Sir Robert says the right to buy legal goods like tobacco is protected under the Windsor Framework and the Good Friday Agreement (REUTERS)\" src=\"https:\/\/www.europesays.com\/uk\/wp-content\/uploads\/2025\/06\/f66caeef66e820e7c4c3bc97c1754608.jpeg\"\/><\/p>\n<p>Sir Robert says the right to buy legal goods like tobacco is protected under the Windsor Framework and the Good Friday Agreement (REUTERS)<\/p>\n<p>But now Sir Robert warns the policy risks breaching another key piece of legislation signed by Mr Sunak, the Windsor Framework with the EU.<\/p>\n<p>It is designed to deal with the post-Brexit problem about what to do at <a href=\"https:\/\/www.independent.co.uk\/topic\/northern-ireland\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Northern Ireland;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Northern Ireland<\/a>\u2019s border, the scene of many atrocities during the Troubles.<\/p>\n<p>There were fears that Brexit could make the land border between NI and the Republic of Ireland a so-called \u2018hard border\u2019 again, with checkpoints that risked becoming the focus of future attacks.<\/p>\n<p>In a bid to avoid that the UK and the EU agreed a system under which, when it comes to goods, NI aligns with EU laws.<\/p>\n<p>Sir Robert warns that EU law therefore requires that tobacco remain legal for adults over 18 in NI.<\/p>\n<p>But the new Bill would criminalise its sale to anyone born after 2008 across the UK, including in NI.<\/p>\n<p>It is understood the government believes that the measures drafted in the Bill are consistent with the UK\u2019s obligations under the Windsor Framework.<\/p>\n<p>Sir Robert says the disconnect means the Bill, in its current form, is on a collision course with international law and ministers are sleepwalking into a constitutional and legal car crash.<\/p>\n<p>\u201cIf the Bill applies in Northern Ireland, we breach EU law. If it doesn\u2019t, we fracture the UK\u2019s internal market. Either way, we\u2019re in breach of the treaty we signed just last year,\u201d he said.<\/p>\n<p>He added: \u201cThe Windsor Framework is not political window dressing, it\u2019s international law. And if Parliament pushes ahead with this Bill as-is, we are heading straight for the courts.<\/p>\n<p>\u201cNorthern Ireland\u2019s courts have already shown they will strike down UK laws that conflict with the Framework. That is not theoretical, it&#8217;s real, it&#8217;s recent, and it&#8217;s relevant.<\/p>\n<p>\u201cThe government must hit pause. Either negotiate an exemption\u2026 or remove Northern Ireland from the scope of the Bill. Anything else is reckless.\u201d<\/p>\n<p>\u201cThe right to buy legal goods like tobacco is protected under the Windsor Framework and the Good Friday Agreement.
