after it admitted to \u201cunconscionable conduct\u201d by denying legitimate claims made by patients over a five-year period.<\/p>\n<p>The Australian Competition and Consumer Commission, the country\u2019s consumer watchdog, began legal proceedings against Bupa after it said the UK company had engaged in \u201cmisleading and deceptive\u201d practices between May 2018 and August 2023.<\/p>\n<p>The regulator has agreed the fine with Bupa, but a court will formally set the penalty, which could change.<\/p>\n<p>The crackdown is the latest in a series of actions by <a href=\"https:\/\/www.ft.com\/australia\" data-trackable=\"link\" target=\"_blank\" rel=\"noopener\">Australia<\/a>\u2019s regulators against companies including <a href=\"https:\/\/www.ft.com\/content\/d9ee3bfe-8405-4680-b782-d3221ca38178\" data-trackable=\"link\" target=\"_blank\" rel=\"noopener\">Qantas<\/a>, HSBC and the country\u2019s <a href=\"https:\/\/www.ft.com\/content\/7bf9da72-4dcf-4095-9e14-df0131bd97cb\" data-trackable=\"link\" target=\"_blank\" rel=\"noopener\">supermarkets<\/a> and banks over poor governance and consumer protection.<\/p>\n<p>The action against Bupa relates to \u201cmixed coverage\u201d claims in which patients were checking their eligibility or made an application involving multiple procedures, usually during a hospital visit.<\/p>\n<p><a href=\"https:\/\/www.ft.com\/stream\/178e736a-da2d-4366-8fdf-8b41c4bdfb23\" data-trackable=\"link\" target=\"_blank\" rel=\"noopener\">Bupa<\/a> rejected such claims in their entirety if one of the procedures was not covered by the customer\u2019s policy, even though other parts of the claim were legitimate, according to the ACCC.<\/p>\n<p>Gina Cass-Gottlieb, chair of the commission, said the rejected claims led thousands of customers to pay out of pocket, upgrade their policies or, in some cases, discontinue treatment because of cost.<\/p>\n<p>\u201cBupa\u2019s conduct affected thousands of members over more than five years, and caused harm to consumers some of whom delayed, cancelled or went without treatment for which they were, at least partially, covered under their health insurance policies,\u201d Cass-Gottlieb said in a statement.<\/p>\n<p>Nick Stone, head of Bupa Asia Pacific, said the insurer had admitted to the \u201cunconscionable conduct\u201d and so far paid out A$14.3mn in compensation to customers to cover 4,100 claims and eligibility checks. \u201cThis should never have happened,\u201d he src=\"https:\/\/www.europesays.com\/uk\/wp-content\/uploads\/2025\/06\/https:\/\/www.ft.com\/__origami\/service\/image\/v2\/images\/raw\/https%3A%2F%2Fd1e00ek4ebabms.cloudfront.net.jpeg\" alt=\"Jim Chalmers\"\/><\/a><\/p>\n<p>Bupa Asia Pacific, which comprises its Australian, New Zealand and Hong Kong operations, was the insurer\u2019s largest unit last year, generating 37 per cent of the group\u2019s \u00a316.9bn revenue and nearly half its \u00a3914mn in underlying profit.<\/p>\n<p>The British company entered Australia in 2002 and has acquired local competitors to become Australia\u2019s second-largest private health insurer, behind Medibank Private, with 4.5mn customers.<\/p>\n<p>The Australian government subsidies private health insurance to ease pressure on the public system, driving take-up rates. <\/p>\n<p>Bupa has also expanded into running aged care and healthcare centres in Australia and has been linked with a potential bid for hospital operator Healthscope, which collapsed into administration last month.<\/p>\n<p>Bupa has declined to comment on whether it would seek to take over the
